CITY OF SOUTHLAKE
REGULAR MEETING OF THE CITY COUNCIL
APRIL 6, 1976
The City Council of the City of Southlake, Texas, met in reg-
ular session in the Council Chamber of City Hall, 667 North
Carroll Avenue in Southlake on Tuesday, April 6, 1976, with
the following members present:
Wade Booker, Mayor
W. O. Nunn, Councilman
Ben H. Berry, Councilman
Incoming Councilmen: Bob Goode
Pat Hawk
Colon A. Sweet
Staff Members Present: William D. Campbell, City Attorney
Wallace G. Cline, Water Superintendent
D. R. Hughes, Police Chief
R. P. Steele, Fire Chief.
Mayor Booker called the meeting to order at 7:30 P.M. The in-
vocation was given by Councilman Nunn. Mayor Booker admini-
stered the oaths of office to each new councilmen. The Minutes
of the last regular meeting were approved as corrected. The
Minutes of the Special Meeting of April 5th to canvass the votes
were approved as read.
RESOLUTION NO. 76-6, reappointing Dr. M. D. Simmons as the City
Health Officer was put before the Council. Following questions
and answers, Councilman Goode moved to adopt Resolution No.
76-6; seconded by Councilman Berry. Motion passed unanimously.
(Said Resolution attached hereto and made a part hereof.)
The RADIO MAINTENANCE CONTRACT with Bell Communications was
next considered. Mayor Booker informed the Council the monthly
service charge would now be $235.50 a month. Discussion fol-
lowed. Councilman Nunn suggested the matter be tabled for fur-
ther study. Councilman Goode agreed to check the figures with
Bell Communications.

RESOLUTION NO. 76-7, contracting with Tarrant County for fire
fighting services outside our city limits was put before the
Council. Following discussion, Councilman Nunn moved to adopt
Resolution 76-7; seconded by Councilman Goode. Motion passed
unanimously. (Said Resolution attached hereto and made a part
hereof.)
The Resolution calling for the City of Southlake to join with
other Member cities of the Tarrant County Mayors' Council in
establishing a Utility Rate Study Committee was discussed pro
and con. Councilman Hawk said he would like to have more time
to think about it and was not ready to vote on it. Councilman
Goode moved to table it; seconded by Councilman Hawk. Motion
passed unanimously.
RESOLUTION NO. 76-8, urging Congress to continue Revenue Shar-
ing was put be ore the Council. Discussion followed. Council-
man Nunn moved that this Resolution be adopted; seconded by
Councilman Hawk. Councilmen Nunn, Berry, Hawk and Sweet voted
"For". Councilman Goode abstained. Motion carried. (Said
Resolution attached hereto and made a part hereof.)
Councilman Berry moved that the bills presented be approved for
payment; seconded by Councilman Nunn. Motion passed unanimously.
There being no further business, the meeting adjourned.

RESOLUTION NO. 76-6
WHEREAS, it is to the best interest of the citi-
zens of the City of Southlake that there be a
City Health Officer for the protection of their
health and welfare; And,

WHEREAS, State law requires the appointment of
a City Health Officer to serve the City of South-
lake; And,
WHEREAS, Dr. M.D. Simmons of the City of South-
lake is currently said City Health Officer whose
term of office expires April 15, 1976; Now,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, THAT:
Dr. M. D. Simmons be and he is hereby re-
appointed to serve as City Health Officer
for a term of one (1) year from this date
to the third Tuesday of April, 1977.
ADOPTED this 6th day of April, 1976.

RESOLUTION NO. 76--7
WHEREAS, pursuant to the provisions of Article
2351A-3, Revised Civil Statues of Texas, the
Commissioners' Court of Tarrant County, Texas,
has tendered to the City of Southlake, Texas,
the sum of $3,000, in consideration of the
Volunteer Fire Department of said city to fur-
nish fire protection to real and personal pro-
perty located outside of the boundaries of said
City and within such distance as such volunteer
Fire Department may reasonably be expected to
reach and render service in case of fire, and
has submitted for consideration its contract in
connection therewith; Now,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, THAT:
The offer of the Commissioners' Court of Tarrant County, Texas,
be, and is hereby accepted and that the Mayor of Southlake,
the City, under the attest of the Secretary and seal of the
City, be, and is hereby authorized to deliver said contract
to the Commissioners' Court of Tarrant County, Texas, for its
approval.

AGREEMENT

COUNTY OF TARR-A I' X
THIS CONTRACT AND AGREEMENT made and entered into by and between TARRANT
COUNTY, acting by and through its Commissioners' Court, hereinafter referred
to as COUNTY, and the City of Southlake, "Texas, Municipal Corporation, acting
by and through its City Council, hereinafter referred to as WIT!
WITNLSSE'TH:
The above named CITY has a volunteer fire department recognized by the
Insurance Commission of the State of Texas, and has by an order or resolution
of its governing authorities, petitioned by the Commissioners' Court of COUNTY
to enter into a contract with said CITY for the use of the fire truck and
other fire fighting equipment of said CITYfor the purpose of fire protection
to real and personal property located outside of the boundaries of said CITY.
and within such distances as such volunteer fire department may reasonably
be expected to reach and render service in case of fire, and said COUNTY has
agreed to enter, and does by these presents enter into a contract by the terns
of which TARRLNT COUNTY" acting by its Commissioners' Court will pay to said
CITY for the purposes aforesaid, the sum of THREE THOUSAND ($3,000.00) DOLLARS
per annum, such amounts to be paid in a lump sum or in equal monthly installments
within the discretion of the Commissioners' Court of Tarrant County, taking
into consideration the needs and demands of said CITY and its volunteer fire
department.
Said COUNTY shall be under no obligation with respect to providing fire
fighting equipment., or any other expense incidental to the carrying out of
this contract, and shall have no right, title or interest in and to the fire
fighting cquipment belenging to said CITY,
This contract shall be in full force: and effect for and during the entire
period of 1976, and no longer, unless reneged or extended by further contract.
Ise funds to be paid by said Tarrant County for the use of the fire fight-
ing equipment, and the use W service thereof by the fire department of such
CITY for fighting fires outside of the limits of said CST shall be paid out
of the General Fund of Tarrant County, and shall he paid to the above named
incorporated CITY a hereinabove prov:idcd.

RESOLUTION NO. 76-8
WHEREAS, the Congress of the United States
adopted the concept of the general Revenue
Sharing Program whereby local governments
received Federal funds for local use with
minor restrictions; And,
WHEREAS, Revenue Sharing has been of great
use and benefit to the City of Southlake in
the conduct of its regular fiscal business;
And,
WHEREAS, an attempt is being made by certain
factions in Congress to discontinue the Re-
venue Sharing Program; Now,
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, THAT:
Acting together and in concert with the Mayors' Council of
Tarrant County, does hereby support and endorse the Revenue
Sharing Program and proclaim it to be a valuable and fis-
cally responsible program and does oppose any attempt by any
factions in Congress to eliminate Revenue Sharing.
