placement of a raised curb and concrete driveway within a
drainage easement at 1480 W. Kirkwood Blvd.
Action
Requested: Approve an Encroachment and Joint Use Agreement for the
placement of a raised curb and concrete driveway within a drainage
easement at 1480 W. Kirkwood Blvd.
Background
Information: The purpose of this item is to seek City Council approval of an
Encroachment and Joint Use Agreement for the placement of raised
curb and concrete driveway located within a 15-foot drainage
easement. This agreement will allow the developer to place the 8-
inch high curb and concrete driveway within the easement along the
west side of the property to allow for vehicular access into the
proposed building.
The drainage easement was dedicated for a 30-inch storm drain
pipe that routes drainage from W. Kirkwood to Kirkwood Branch
Creek that ultimately outlets into Lake Grapevine. The easement
was not dedicated for cross lot drainage and/or surface drainage.
The proposed encroachment of the raised curb and concrete
driveway have been reviewed by Public Works Streets and
Drainage. It has been determined that the proposed encroachment
will not adversely affect the public infrastructure or hinder Public
Works ability to do any necessary maintenance.

Considerations: This is a no cost agreement.
