OFFICIAL RECORD CITY OF SOUTHLAKE, TEXAS ORDINANCE NO. 480-328A AN ORDINANCE AMENDING ORDINANCE NO. 480, AS AMENDED, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF SOUTHLAKE, TEXAS; GRANTING A ZONING CHANGE ON A CERTAIN TRACT OR TRACTS OF LAND WITHIN THE CITY OF SOUTHLAKE, TEXAS BEING LEGALLY DESCRIBED AS LOT 2R, BLOCK A, RAVENAUX VILLAGE, AN ADDITION TO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, ACCORDING TO THE PLAT RECORDED IN CABINET A, SLIDE 6215, PLAT RECORDS, TARRANT COUNTY, TEXAS, BEING APPROXIMATELY 13.738 ACRES, AND MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A" FROM "S-P-1" DETAILED SITE PLAN DISTRICT WITH "CS" COMMUNITY SERVICE DISTRICT USES TO "S-P-1" DETAILED SITE PLAN DISTRICT WITH "CS" COMMUNITY SERVICE DISTRICT USES AS DEPICTED ON THE APPROVED SITE PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B", SUBJECT TO THE SPECIFIC REQUIREMENTS CONTAINED IN THIS ORDINANCE; CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDINANCE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND THE ZONING CHANGES AND AMENDMENTS HEREIN MADE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Texas Local Government Code; and, WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the authority to adopt a comprehensive zoning ordinance and map regulating the location and use of buildings, other structures and land for business, industrial, residential and other purposes, and to amend said ordinance and map for the purpose of promoting the public health, safety, morals and general welfare, all in accordance with a comprehensive plan; and WHEREAS, the hereinafter described property is currently zoned as "S-P-1" Detailed Site Plan District under the City's Comprehensive Zoning Ordinance; and WHEREAS, a change in the zoning classification of said property was requested by a person or corporation having a proprietary interest in said property; and WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether these changes should be granted or denied: safety of the motoring public and the pedestrians using the facilities in the area immediately surrounding the sites; safety from fire hazards and damages; noise producing elements and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood; location, lighting and types of signs and relation of signs to traffic control and adjacent property; street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood; adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street loading spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health ad the general welfare; effect on light and air; effect on the over-crowding of the land; effect on the concentration of population, and effect on transportation, water, sewerage, schools, parks and other public facilities; and, WHEREAS, the City Council of the City of Southlake, Texas, further considered among other things the character of the districts and their peculiar suitability for particular uses and the view to conserve the value of the buildings, and encourage the most appropriate use of the land throughout this City; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a public necessity for the zoning changes, that the public demands them, that the public interest clearly requires the amendments, and that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other dangers, promotes the health and the general welfare, provides adequate light and air, prevents the over-crowding of land, avoids undue concentration of population, and facilitates the adequate provision of transportation, water, sewerage, schools, parks and other public requirements; and, WHEREAS, the City Council of the City of Southlake, Texas, has determined that there is a necessity and need for the changes in zoning and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the tract or tracts of land requested for a change since the tract or tracts of land were originally classified and therefore feels that the respective changes in zoning classification for the tract or tracts of land are needed, are called for, and are in the best interest of the public at large, the citizens of the city of Southlake, Texas, and helps promote the general health, safety and welfare of the community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake, Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is hereby amended so that the permitted uses in the hereinafter described areas be altered, changed and amended as shown and described below: Being Lot 2R, Block A, Ravenaux Village, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet A, Slide 6215, Plat Records, Tarrant County, Texas, and being approximately 13.738 acres, and more fully and completely described in Exhibit "A" from "S-P-1" Detailed Site Plan District with "CS" Community Service District uses to "S-P-1" Detailed Site Plan District with "CS" Community Service District uses as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit "B," and subject to the following conditions: 1. Applicant agrees to construct a 24-inch rock wall at the end of the hammerhead and will put in a 4 foot break with some flagstone type features on the ground between the landscaping 2. Requiring applicant to replace the light fixtures on the existing poles and to set the timers on the lights 3. Applicant agrees to make arrangements for parking on the east side of the building for evening and overnight usage 4. Requiring the applicant to construct a concrete channel at the bottom of the detention area and to stain the concrete channel with an application that blends it aesthetically 5. Requiring the applicant to plant the inner bufferyard with similar plantings as the north side 6. Subject to Site Plan Review Summary No. 2, dated June 13, 2008, and incorporated herein as Attachment C. SECTION 2. That the City Manager is hereby directed to correct the Official Zoning map of the City of Southlake, Texas, to reflect the herein changes in zoning. SECTION 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said Zoning Ordinance and all other applicable and pertinent ordinances for the City of Southlake, Texas. All existing sections, subsections, paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are not amended hereby, but remain intact and are hereby ratified, verified, and affirmed. SECTION 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and the general welfare of the community. They have been designed, with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to provide adequate light and air; to prevent over-crowding of land; to avoid undue concentration of population; and to facilitate the adequate provision of transportation, water, sewerage, drainage and surface water, parks and other commercial needs and development of the community. They have been made after a full and complete hearing with reasonable consideration among other things of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 5. That this ordinance shall be cumulative of all other ordinances of the City of Southlake, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of said tract or tracts of land described herein. SECTION 7. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 9. The City Secretary of the City of Southlake is hereby directed to publish the proposed ordinance or its caption and penalty together with a notice setting out the time and place for a public hearing thereon at least fifteen (15) days before the second reading of this ordinance, and if this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of its provisions, then the City Secretary shall additionally publish this ordinance in the official City newspaper one time within ten (10) days after passage of this ordinance, as required by Section 3.13 of the Charter of the City of Southlake. SECTION 10. This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained. Introduction: The subject of this zoning request is a 13.738-acre tract of land, platted as Lot 2R, Block A, being part of Ravenaux Village Subdivision and situated South of Hwy 114, West of White Chapel, and North of Countryside Court, in the City of Southlake, Texas. The property is currently developed and zoned SP-1 W/ CS - Community Service District uses, presently including a main worship center, study center, fellowship facility and a youth center, for which a site plan was approved by City Council as Case No: ZA99-128 in 2000. The adjacent land uses include Ravenaux Village Subdivision to the West, and currently un-developed property to the East & South. The specific intent of our submittal is to introduce our proposed Amended Master Site Plan, illustrating Phase II as new two (2) story educational / recreational facility and Phase 111 being a proposed future two (2) story worship center, to include associated overall site improvements. The proposed Master Site Plan contained herein has been carefully considered and crafted to meet the aim of not generating any significant negative environmental impact to the surrounding properties. Proposed site development features an attractive North / South arrangement of building facilities and a new parking addition similar in layout to the previously approved by City Council as Case No. ZA99-128. All the various building uses are centrally located on our site thus creating a comprehensive internal pedestrian envirorunent and a perimeter vehicular circulation system. The scale and orientation of the development has been designed to provide for and encourage a safe vehicular and walking environment, with desirable architecture and high quality environment compatible with and in harmony with the surroundings and the rest of the City. Due to the growth of the Countryside Bible Church congregation, it has become necessary for said educational facility to become a reality. This opportunity will allow the utilization of future available floor space within the existing worship center to be used for much needed church worship services. B Statement of Intent and Pumose: The purpose and intent of this zoning application is to maintain the existing zoning of {SP-i W/ CS - Community Service Uses consistent with the current City of Southlake, Comprehensive Zoning Ordinance, Section and present an 14 mended Master Site Plan reflecting the creation of a pedestrian friendly, campus style worship center development that meets the following objectives: I . Provide for an orderly church expansion program by crating a high duality, well-designed and attractive community service development master site plan meeting the needs of the Countryside Bible Church congregation, as well as that of a diverse and vibrant City, in a manner complimentary to the high quality of life existing in the City of Southlake. 2. Allows for a mixture of church related uses, to include pedestrian and vehicular circulation, in such a way so as to provide an effective transition from land uses bordering the site. 3. Our proposed amended master site plan reflects the following positive contributions to our community: a- It maintains a similar parking area addition and traffic pattern as previously approved by City Council on 2040. b_ Does not cause or create nor impair access to or from adjacent properties of future development, public facilities, schools or parks. C. Does not create any delay to the response time of emergency vehicles. d. Does not create a negative impact, continuity, or sense of community, in the City as a whole, and most importantly, to the adjacent residential neighbors, C. Does not conflict or disrupt an existing or proposed City public improvement, proposed open space Master Plan or Trail System Master Plan. Makes provisions for necessary traffic turnaround relief at the end of Ravenaux Drive by the addition and completion of the originally requested hammerhead drive, thus eliminating the use of existing private driveways to turn around resulting in possible lawn damage caused by said vehicles. 4_ Site design solution creates a residential sensitive environment by providing an astatically pleasing green zone separation between the adjacent properties and vehicular circulation. The interior court yards provide a pedestrian friendly atmosphere with various internal landscape areas and waterscapes creating points of interest. Said design elements uphold the design standards established within the City o£' Southlake. 5. Encourage efficient use of the land by facilitating an open development environment, with building facilities being centralized within the site. 6. Provides for an orderly and pleasing development within the City, which promotes health, safety, and general welfare of the entire community.. C- Project Pleasing Intent: For the sake of clarity the proposed development project is consistent with the following phases: 1. Phase L Shall be considered as all the existing development improvements, originally approved by City Council as Zoning Case No: ZA99-128, dated February 15, 2000. 2. Phase II: It is our intent to consider this phase as the proposed (2) story education / recreational facility, noted as Building "E", to include the site improvements delineated on our Master Site Plan Submittal, Said project is estimated to have a construction start during the 3;d quarter of 2008, with a tentative completion during the 4°s quarter of year 2009. 3. Phase III. Will be considered as the proposed future (2) story worship center, noted as Building "F"-to include necessary site improvements illustrated on our Master Site Plan. The start time for said phase is anticipated to be within 5-6 years from completion of phase II. au"A 06Nua ZA08-093 Mater Site Plan Design Narrative Case No. ZA08-043 Page 4 of 4 U. Outdoor Site Lkled►W It is our intent to comply with Ordinance No. 693-B, Outdoor Lighting - with regards to the parking lot lighting illustrated on our Master Site Plan, in order to protect the existing Ravenaux Village Subdivision Residents and other adjacent properties. 1. Proposed light poles shall be 16 feet high and have high pressure sodium light fixtures with necessary shielding to deflect lighting from spilling onto adjacent residential properties. 2. Said parking lot lighting shall also be equipped and controlled by timers to maintain a structured lighting schedule. F- Schedule Of Worship Services do Related Uses: It is anticipated that Countryside Bible Church will operate under the following weekly schedule of events - upon completion of the proposed phase II - Educational I Recreational Building "E"• (See Attached Facility Usage Schedule) F. Saernrnationy It is the intent of Countryside Bible Church to continue to be a good neighbor, respect their privacy and in no way disrupt the quality of life presently experienced by the Ravenaux Village Subdivision Residents. All waterlines in easements or ROW must be constructed to City standards. WATER COMMENTS: 1. The minimum size for water lines is 8". 2. For all commercial and industrial uses, fire hydrant shall be spaced a maximum of 300 linear feet apart, or 600 linear feet if buildings are sprinklered. * Water lines cannot cross property lines without being in an easement or ROW. * There is an existing 8 inch diameter waterline located within this property that will be relocated to serve this development. * The water meters must be located in an easement or right-of-way. * Minimum easement width for utilities along the rear is 30". * The fire line may need to be separate from the service lines. SANITARY SEWER COMMENTS: 1. The minimum size for sanitary sewer lines is 8". All sanitary service lines must connect to a public sanitary system line that is built to City standards. * All sewer lines in easements or ROW must be constructed to City standards. * There is an existing 8 inch diameter sewer line located within this property to this development. * Extend the sewer line to the western property line for future service. DRAINAGE COMMENTS: 4. The difference between pre and post development runoff shall be captured in the detention pond(s). The proposed detention ponds shall control the discharge of the 5, 10 and 100 year storm events. Detention may be required with any new proposed building construction. Describe how increased runoff from site is being detained. Access easements are needed for maintenance of the detention pond. 5. Documentation supporting and certifying that detention is not necessary will be required prior to approval of construction plans. 6. The size of the proposed storm sewer will require some easements outside the ROW. The storm sewer must be installed outside the edge of pavement. Verify that the size, shape, and/or location of the detention pond, as depicted on the site/concept/development plan, will be adequate to meet the detention requirements. Any changes to the size, shape, and/or location of the proposed pond(s) may require a revision to the concept/site/development plan and may need to be approved by the Planning and Zoning Commission and the City Council. * All storm sewers collecting runoff from the public street shall be RCP. * Provide a construction entrance with 3-4" size rock. * This property drains into a Critical Drainage Structure and requires a fee to be paid prior to beginning construction. * The drainage from this development is generally to the west and slightly north * The discharge of post development runoff must have no adverse impact on downstream properties and meet the provisions of Ordinance # 605.
