Item 8 - Staff ReportCase No. ZBA25-0009 S T A F F R E P O R T August 8, 2025 CASE NO: ZBA25-0009 PROJECT: 3269 & 3270 Lake Drive – Variance for Setback EXECUTIVE SUMMARY: Jon Sutton is requesting a Variance to Zoning Ord. No. 480, as amended, Sec. 9.5 requiring a front yard of not less than 40 feet, a side yard of not less than 25 feet, a rear yard of not less than 40 feet, and the maximum lot coverage to not exceed 10% of the lot area on property described as Tract 3B01F and Tract 3B01B, Childress, John Heirs Survey; A 254 and located at 3269 & 3270 Lake Drive, Southlake, Tarrant County, Texas. Current Zoning: “AG” Agricultural District. SPIN Neighborhood #2. REQUEST: The purpose of this request is to seek approval of variances to allow side, rear, and front yard setback reductions and to allow an increase in maximum lot coverage to increase the buildable area of the property to build an addition to an existing home. The applicant owns both unplatted tracts of land located at 3269 and 3270 Lake Drive. The residential building on 3270 Lake Drive was demolished in 2024, and there is currently no structure on that site. The applicant will be utilizing both tracts as a single property with one homesite. The combined size of the tracts is approximately 18,306 square feet. The existing home is 2,176 square feet and the home that was demolished was approximately 1,800 square feet. The request includes the construction of an 858 square foot porte-cochere and a 1,934 square foot addition to the residence for a total of 2,792 square feet of new improvements. The additions will be attached to the existing home with a cohesive façade. The following variances are requested: 1. Zoning Ordinance No. 480, Sec. 9.5.c requires a front yard of not less than 40 feet; the applicant is requesting a setback of 21.3 feet. This is the current front yard setback for the existing home, and the addition will be setback a minimum of 33.5 feet. 2. Zoning Ordinance No. 480, Sec. 9.5.c requires a side yard of not less than 25 feet; the applicant is requesting a side yard setback of 14.1 feet along the western property line. This is the current side yard setback for the existing home, and the addition will not impact this setback. 3. Zoning Ordinance No. 480, Sec. 9.5.d requires a rear yard of not less than 40 feet; the applicant is requesting a rear yard setback of 14.9 feet. This is the current rear yard setback for the existing home, and the addition will be setback a minimum of 21.5 feet. Department of Planning & Development Services Case No. ZBA25-0009 4. The building was built in 1961. WATER & SEWER: The property located at 3269 Lake Drive transitioned from a septic system to public sewer service in 2023 and is currently served by a 1-inch water meter. The property at 3270 Lake Drive is also served by a 1-inch water meter. An 8- inch public sewer main is located along Lake Drive. STAFF COMMENTS: The application and exhibits are provided in this Staff Report. To authorize in specific cases variances from the terms of this ordinance as will not be contrary to the public interest, where due to special conditions, a literal enforcement of the provisions of this ordinance would result in unnecessary hardship and where the spirit of the ordinance is observed and substantial justice is done. A variance shall not be granted by the Board of Adjustment except in accordance with the following: 1) That special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same district; 2) That literal interpretation of the provisions of this ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this ordinance; 3) That the special conditions and circumstances do not result from the actions of the applicant; 4) That granting of the variance requested will not confer on the applicant any special privilege that is denied by this ordinance to other lands, structures, or buildings in the same district.
