Subject: Approve an Encroachment and Joint Use Agreement for the
placement of stone walls and a stone dock located within a
drainage easement at 1808 Jubilee Lane.
Action
Requested: Approve an Encroachment and Joint Use Agreement for the
placement of stone walls and a stone dock located within a drainage
easement at 1808 Jubilee Lane.
Background
Information: The purpose of this item is to seek City Council approval of an
Encroachment and Joint Use Agreement for the placement of stone
walls and a stone dock located within a variable width drainage
easement. This agreement will allow the developer to place stone
walls along the banks of the existing pond to prevent future erosion
and a stone dock within the easement along the west side of the
property. There are no City utilities or infrastructures within this
easement.
The drainage easement was dedicated for the existing ponds on the
property. The proposed stone walls and stone dock have been
designed to not impede the drainage flow or alter the required
volume of the existing pond The stone walls will be cut into the
existing pond banks to allow for the existing pond volume to remain
unchanged. The stone dock will be placed above the water surface
elevation and will not impede drainage flow. Based on the drainage
memo by Redinger Group, LLC, the proposed improvements will not
cause adverse impacts and will not impact the capacity of the
existing pond along the west of the property.
The property owner is responsible for the maintenance related to this
stone dock and stone walls. The agreement speaks to this, and staff
is providing a letter, shown in Attachment C, to reinforce this for
future owners.
