a Fire Truck was considered as an
emergency item. Sparger informed
Council as to the degree of repairs
that needed to be done to the cab and
tank in order to get the unit back in
service. Several bids had been
acquired by Chief Steele.
After discussion, motion was made and

While discussing the Fiscal Year 1981
Budget, Mayor Hawk briefed the Citizen
present on the make up of a budget. H
also outlined the Capital Outlay items
that will be covered in a Bond Program
in the fall. The proposed budget was
reviewed, department by department.
The raises proposed for employees were
based on a loo increase for the most
part.
During the public hearing, the follow-
ing citizens had comments:
Leonard Russell was concerned about
water being used by private contractor 3.
Harold Knight requested to know the
amount budgeted for engineering study
for TRA.
Ed Rhodes had questions concerning
taxes in Southlake for the upcomming
year.
The public hearing was closed and FY 81
Mayor Hawk asked for approval of the BUDGET
FY81 Budget with one change. The APPROVED
funding for the Single Appraisal
Tax District will come out of
contingency reserve for general fund.

Mary Dorsett of 3010 Lake Drive,
addressed Council stating her concerns
over weeds in residential areas.
She indicated Southlake has a City
Ordinance but possibly we need some-
thing stronger. Weeds are covered
in Ordinance No. 162-G.
Councilperson Massey presented an
amendment to Ordinance No. 161,Sectio

DEVELOPERS AGREEMENT
An agreement between the City of Souhtlake and the Developer
of BRIARWOOD ESTATES SUBDIVISION, PHASE I for the installation
of certain community facilities within and to service an
addition to the City of Southlake, Tarrant County, Texas.
1. GENERAL REQUIREMENTS
A. It is agreed and understood by the parties hereto that
the Developer shall employ an engineer licensed to
practice in the State of Texas for the design and
preparation of the plans and specifications for the
construction of all facilities covered by this agreement.
B. The City of Southlake hereby agrees to withhold all
building permits for said lots or parcels until
completion and acceptance of useable increments of
all facilities listed in this agreement.
All subgrade of street must be complete.
C. All of the facilities listed in Paragraph II of this
agreement will be constructed within three (3) years
from date of the signing by both parties of this agreement.
Before work is commenced, an irrevocable letter of credit
will be furnished in favor of the City of Southlake for an
amount equal to 110% of the value of the construction of
the facilities listed herein and will be forfeited should
the Developer default on any of articles of this agreement.
The letter of credit will be accompanied by an escrow
agreement with the lending institution acting as a
escrow agent providing for the release of such monies
by the lending institution only upon the written approval
of the City. The letter of credit will contain a forfeiture
clause.
D. Upon completion of the work as defined by this agreement,
the Developer will furnish certificates of deposit along
with an executed escrow agreement in favor of the City
covering all facilities constructed against defects
in materials and/or workmanship and against all repairs
and/or reconstruction for a period on one (1) year after
completion of all facilities and their final acceptance
by the City. Such certificates of deposit shall be in
an amount equal to 13% of the total cost of all facilities.
E. It is further agreed and understood by the parties hereto
that upon acceptance by the City, title to all facilities
and improvements mentioned herein above shall be vested at all
times in the City of Southlake, and the Developer hereby
relinquishes any right, title or interest in and to said
facilities or any part thereof.
F. On all facilities included in this agreement for which the
Developer awards his own construction contract, the Developer
agrees to the following procedure:
1. To employ a construction contractor who is qualified
in all respects to bid on public projects of a similar
nature.
2. To secure approval by the City of any and all final
payments to the contractor. Said approval is made in
accordance with the requirements of this agreement and
is not to constitute approval of the quantities on which
payment is based.
3. To delay connection of building to service lines of
water mains constructed under this contract until said
water mains and service lines have been completed to
the satisfaction of the City.
G. The Developer will mow and otherwise maintain the
aesthetics of all land and lots which have not been sold,
built on, and occupied. Should the Developer fail in this
responsibility, the City may contract for this service and
bill the Developer for the cost.
H. There will be no tie on fee collected by the City for the
two dwellings currently in existance on the property.
II. FACILITIES:
A. ON-SITE WATER:
1. The Developer hereby agrees to install water facilities
to service lots as shown on the final plat for the
BRIARWOOD ESTATES ADDITION, PHASE I. to the City of
Southlake. Water facilities shall include six (6")
water lines, able to support fire hydrants and fire hydrant
installation. These are to be installed within a S00'
radius. These facilities will be installed in accordance
with plans and specifications to be prepared by the
Developer's engineer and approved by the City. Further,
the Developer agrees to complete this installation at
its own cost and in accordance with Ordinance No. 170.
2. It is further agreed and understood that the Developer
shall be responsible for all construction costs,
materials, and engineering and Developer's letter of
credit, Paragraph T.C.
3. The Developer hereby agrees to construct the necessary
drainage facilities within the addition. These
facilities shall be in accordance with the plans and
specifications to be prepared by the Developer's
engineer, and approved by the City.
B. "Standard Sub-division Paved Street, Estate Type", means
a two lane street with drainage ditches on each side. The
street shall have a crown of six to eight inches (6" to 8")
and a crown width of thirty-six (36') which shall include
a twenty-six (26') wide and eight inch (8") compacted gravel
base with a twenty-four (241) wide surface treatment in the
center of the said gravel base. The surface treatment
shall be double course of hot asphalt penetration. Core
saTppllit lust be made by the Developer at his expense. See
C. The Developer will be responsible for the installation
of street signs designating the names of the streets
inside the subdivision.
D. All street improvements will be spbject to inspections
and approval by the City of Southlake.
III. SANITARY SEWER: (Septic System)
A. It is understood and agreed that Septic Disposal facilities
shall be constructed on each lot by the lot purchaser
or builder in such a manner as to comply with all of the
following minimum requirements: Health Department
requirements, Tarrant County, Texas; State Department
of Health, State of Texas requirements, Texas Water
Quality Board regulations, State of Texas, and any applicable
City Ordinance concerning Septic Disposal facilities.
B. It is understood that the City of Southlake requires
all lots zoned A-6 (Duplexes) to use a aerobic home
sewage treatment system. One system for each two family
lot is acceptable. The system shall be equivilant to or
better than Nutt Shell system and shall be approved by the
City of Southlake.
IV. SCREENING
The developer shall provide at his expense a screen of cedar
trees spaced at 10 to 15 foot intervals along the property
line adjoining Anderson Industries.

Dear Mr, Hawk:
We have become concerned of late with the manner in which subdivision
plats and supporting documents are being reviewed and processed through
both our office and City staff. It appears more and more that final
plats are being approved and perhaps recorded without having engineer-
ing plans submitted and reviewed for the required facilities. The
only engineering plans that we have reviewed in several months is
Harbor Oaks Addition.
The reason it is important to have engineering plans is mainly to
verify the adequacy of the drainage easements shown on the plats.
Drainage studies being submitted for review of the plats are very
preliminary and are usually drawn on the city map of scale 1" = 800'
and 10 foot contour interval.
It is possible that engineering plans for some of these subdivisions
(such as Lakewood Acres and Highland Estates) are now being prepared.
Our point is that we recommend some additional checkpoints be estab-
lished to assure the City that in fact the street and drainage im-
provements necessary to serve each subdivision are adequate in
accordance with the adopted ordinances of the City of Southlake.
One method we would suggest is to not record the final plat until
engineering plans are approved.

The annual meeting of the City of Southlake, Board of Tax
Equalization, was held on June 21,1980 at 9:30 a.m.
The meeting was called to order by chairman, Roger Baird.
Members in attendance were: Roger Baird, chairman
Harold Knight
Harald Foerster
Also in attendance were the Tax Assessor, Will Zschiesche,
and the City Secretary/Tax Collector, Sandy LeGrand.
The members of the board took the Oath of Office.
There being no business, Harold Knight moved to adjourn the
meeting. Harald Foerster seconded the motion. Motion Carried.
The meeting was adjourned by chairman Roger Baird at 12 noon.
