WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Texas Local Government Code; and, WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the authority to adopt a comprehensive zoning ordinance and map regulating the location and use of buildings, other structures and land for business, industrial, residential and other purposes, and to amend said ordinance and map for the purpose of promoting the public health, safety, morals and general welfare, all in accordance with a comprehensive plan; and, WHEREAS, the hereinafter described property is currently zoned as "S-P-2" Generalized Site Plan District under the City's Comprehensive Zoning Ordinance; and, Ordinance No. 480-667B WHEREAS, a change in the zoning classification of said property was requested by a person or corporation having a proprietary interest in said property; and, WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether these changes should be granted or denied: safety of the motoring public and the pedestrians using the facilities in the area immediately surrounding the sites; safety from fire hazards and damages; noise producing elements and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood; location, lighting and types of signs and relation of signs to traffic control and adjacent property; street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood; adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street loading spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health ad the general welfare; effect on light and air; effect on the over-crowding of the land; effect on the concentration of population, and effect on transportation, water, sewerage, schools, parks and other public facilities; and, WHEREAS, the City Council of the City of Southlake, Texas, further considered among other things the character of the districts and their peculiar suitability for particular uses and the view to conserve the value of the buildings, and encourage the most appropriate use of the land throughout this City; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a public necessity for the zoning changes, that the public demands them, that the public interest clearly requires the amendments, and that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and, Ordinance No. 480-667B WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other dangers, promotes the health and the general welfare, provides adequate light and air, prevents the over-crowding of land, avoids undue concentration of population, and facilitates the adequate provision of transportation, water, sewerage, schools, parks and other public requirements; and, WHEREAS, the City Council of the City of Southlake, Texas, has determined that there is a necessity and need for the changes in zoning and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the tract or tracts of land requested for a change since the tract or tracts of land were originally classified and therefore feels that the respective changes in zoning classification for the tract or tracts of land are needed, are called for, and are in the best interest of the public at large, the citizens of the city of Southlake, Texas, and helps promote the general health, safety and welfare of the community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake, Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is hereby amended so that the permitted uses in the hereinafter described areas be altered, changed and amended as shown and described below: Being described as Lot 1 R1 and Lot 1 R2 , Block A, Ravenaux Village, an addition to the City of Southlake, Tarrant County, Texas, being approximately 6.14 acres, and more fully and completely described in Exhibit "A" from "S-P-2" Generalized Site Plan District to "S-P-2" Generalized Site Plan District as depicted on the approved Site Plan and Concept Plan attached hereto and incorporated herein as Exhibit "B", and subject to the following conditions: Ordinance No. 480-667B February 18, 2025; Approved 2nd Reading (6-0) subject to the Staff Report dated February 11, 2025 and Concept Plan Review Summary No. 2, dated January 17, 2025, noting the following: • Approving the zoning change and concept plan amending the existing "S-P-2" generalized site plan district zoning as it relates to the building site on Lot 1 R2, Block A, Ravenaux Village, to add an ambulatory surgery center as a permitted use and change the building from a 3-story, 22,000 sq. ft. building to a 2-story, 30,000 sq. ft. building, as presented. • Applicant has agreed this evening to review preserving the tree clearly discussed this evening via construction adjustment, subject to staff approval. CONCEPT PLAN REVIEW SUMMARY Case No.: ZA24-0073 Review No.: Two Date of Review: 1/17/25 Project Name: Concept Plan — Chapel Crossing Phase Two; 245 W SH 114 1) Correct the data summary to include number of stories and max. height of each building (Lots 1R1 & 1R2). Informational Comments: • The following variances to Driveway Ordinance No. 634, as amended, were approved with the original Zoning Change and Concept/Site Plan for Southlake Office Plaza (ZA13-106) and with Chapel Crossing (ZA19-0064). These will be carried over as variances with the current request: • Section 5.2.c prohibits commercial driveways on local and collector streets. A variance was requested to allow a commercial driveway onto Countryside Ct., which is a local street. (Please note that Countryside Ct. serves primarily non-residential traffic). • Section 5.2.d requires a minimum stacking depth of 100' for both driveways. A variance was requested to allow the stacking depths as shown on the Site Plan and Concept Plans with approximately 43' of stacking depth shown on the E. S.H. 114 driveway and approximately 48' of stacking depth shown on the Countryside Ct. driveway. Prior to issuance of a building permit, a Site Plan meeting the requirements of Zoning Ordinance No. 480, as amended, Section 40, must be approved by City Council following a recommendation by the Planning and Zoning Commission. The Site Plan must include existing and proposed development and it must comply with the underlying zoning and the approved Concept Plan. • Only one trash receptacle enclosure is shown on the plan. Both lots will share the existing trash receptacle enclosure on the proposed Lot 1 R1. A shared use and maintenance agreement must be in place prior to issuance of a Certificate of Occupancy for the proposed building on Lot 1R2. Ordinance No. 480-667B Tree Conservation/Landscape Review TREE CONSERVATION COMMENTS: The proposed Tree Conservation Plan is not consistent with the previously approved Tree Conservation Plan, Case ZA19-0064. If the development were proposed as traditional zoning the percentage of existing tree cover at the time the first such permit was issued shall be used to calculate the minimum existing tree cover that must be preserved. Previously all the existing trees on the property were shown to be preserved and included within the Existing Tree Cover Preservation Calculations. There was 7.13% of existing tree cover on both properties and a minimum of 70% was required to be preserved. A total of 46.59% was approved to be removed and 53.41% to be preserved. Now, there is 9.41% of existing tree cover on the property proposed for development and 100% is proposed to be removed. * Except as provided by subsection 7.2.b. of the Tree Preservation Ordinance, a Tree Conservation Analysis or Tree Conservation Plan shall be approved if it will preserve existing tree cover in accordance with the percentage requirements established by Table 2.0. If the property has previously received a tree permit related to development, the percentage of existing tree cover at the time the first such permit was issued shall be used to calculate the minimum existing tree cover that must be preserved under this section. For property sought to be zoned for the Downtown zoning district or a planned development zoning district, including an S-P-1 Site Plan, S-P-2 Site Plan, Transition, Rural Conservation, Planned Unit Development, or Employment Center zoning district, the City Council shall consider the application for a Conservation Analysis or Plan in conjunction with the corresponding development application (as established in Table 1.0). The Planning and Zoning Commission shall review the application and make a recommendation to the City Council regarding the application. The City Council shall approve the Plan or Analysis if the Council finds that the Plan or Analysis provides for the: placement of building pads, parking areas, driveways, streets, and utility easements so as to maximize the preservation of environmental features of the property including mature tree stands, natural creeks and ponds, and significant grades; ii. maximizes the preservation of tree cover preservation areas indicated on the Environmental Resource Protection Map; Ordinance No. 480-667B iii. maximizes the preservation of existing tree stands with the potential to buffer residential areas from the noise, glare, and visual effects of nonresidential uses; iv. maximizes the preservation of existing trees, if any, adjoining a natural or man-made drainage creek; v. maximizes the preservation of existing protected trees along rural roadways and other streets as identified and prioritized in the Street Typology designation; and vi. mitigation of altered trees through proposed tree replacement procedures pursuant to this Ordinance. Please be aware that all existing trees shown to be preserved on the City Council approved Tree Conservation Plan must be preserved and protected during all phases and construction of the development. Alteration or removal of any of the existing trees shown to be preserved on the approved Tree Conservation Plan is a violation of the Tree Preservation Ordinance and the zoning as approved by the Southlake City Council. Please ensure that the layout of all structures, easements, utilities, structures grading, and any other structure proposed to be constructed do not conflict with existing trees intended to be preserved. LANDSCAPE COMMENTS: 1. Label all bufferyards on the Site Plan and Landscape Plan. Indicates informational comment. # Indicates required items comments Public Works/Engineering Review GENERAL COMMENTS: 1. The minimum radius along the fire lane shall be 30'. GRADING AND DRAINAGE: 2. The I value used shall follow the most current version of the ISWM manual. The current version shows an I value for a Tc of 10 minutes as 9.76 in/hr. • The capacity of the existing detention pond and storm pipes will need to be verified to ensure there is adequate capacity during construction plan review. UTILITY 3. The proposed sanitary sewer line from the existing manhole to, at a minimum, the property line shall be a public line and will be required to be located within the existing easements or within a new easement. • Verify that a 4"water meter is necessary. The impact fees for a 4" meter are substantially different than that for a 2" meter. Also, please be aware that dual meters are not permitted, so if a 4" meter is required then 2- 2" meters cannot be used. • Ensure that the water line, fire hydrants, and water meters are located within a water easement for the commercial development. Ordinance No. 480-667B Fire Department Review GENERAL COMMENTS: The required backflow protection (double check valve) for the sprinkler systems can be located on the riser if the riser is within 100 feet of the water main, measured linearly along the length of the pipe. If the riser is further than 100 feet from the main, the double check valve shall be in a vault. Riser rooms shall be a minimum of 5'X5' if the double check is located in a vault, or a minimum of 6'X6' if it is located on the riser. (Not indicated on the plan) The Fire Department Connection for the sprinkler system must be within 100 feet of a fire hydrant, and within 50 feet of fire department fire lanes on the property. (Not indicated) FIRE LANE COMMENTS: Fire lanes require a minimum 30 foot inside turn radius and a minimum 54 foot outside turn radius. (Radii throughout the plan do not meet the minimum requirement) Fire apparatus access needs to be an all-weather surface, asphalt or concrete, 24 feet wide and able to support the imposed loads of fire apparatus. (Minimum of 85,000 pounds GVW) (Complete fire lane and tie-in to existing fire lane not indicated on plan) FIRE HYDRANT COMMENTS: Fire hydrants are required at a maximum spacing of 500 feet for commercial locations with completely sprinkled buildings. (Hydrants indicated are over spaced) General Informational Comments • Approval of a Site Plan by City Council following a recommendation by the Planning and Zoning Commission will be required prior to issuance of a building permit for the new building.The proposed zoning requires that the elevations for the second building be consistent with the Phase I building, including the stone treatments. • The following variances to Driveway Ordinance No. 634, as amended, were previously approved with the original Zoning Change and Concept/Site Plan for Southlake Office Plaza (ZA13-106 & ZA19-0064). All driveways have been constructed and are existing. No new driveways are proposed. The proposed changes to the site do not show to increase the daily design hour volumes which would require modifications to the existing driveways: 1. Section 5.2.c prohibits commercial driveways on local and collector streets. A variance is requested to allow a commercial driveway onto Countryside Ct., which is a local street. (Please note that Countryside Ct. serves primarily non-residential traffic). 2. Section 5.2.d requires a minimum stacking depth of 100' for both driveways. A variance is requested to allow the stacking depths as shown on the Site Plan and Concept Plans with approximately 43' of stacking depth shown on the E. S.H. 114 driveway and approximately 48' of stacking depth shown on the Countryside Ct. driveway. • No review of proposed signs is intended with this site plan. A separate building permit is required prior to construction of any signs. Ordinance No. 480-667B • Building permit(s) are required prior to commencement of any work. • All mechanical equipment must be screened of view from right-of-ways and residential properties in accordance with the Zoning Ordinance No. 480, as amended. • All lighting must comply with the Lighting Ordinance No. 693, as amended. • All development must comply with the Drainage Ordinance No. 605 and the Erosion and Sediment Control Ordinance No. 946, as amended. Development must comply with all requirements in Zoning Ordinance No. 480, Section 43, Overlay Zones. • The applicant should be aware that prior to issuance of a building permit a fully corrected site plan, landscape plan, irrigation plan, and building plans must be submitted for approval and all required fees must be paid. This may include but not be limited to the following fees: Park Fee, Roadway lmapct Fee, Water& Sewer Impact and Tap Fees, and related Permit Fees. • In addition to the City of Southlake impact fees, please be aware that through the wholesale water customer contract with the City of Fort Worth, all new water connections are required to pay the City of Fort Worth impact fee. The City of Fort Worth impact fee assessment is based on the final plat recordation date and building permit issuance. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. The approved Concept Plan(Exhibit B, dated September 29, 2014), shows the expansion building adjacent and attached to the Phase I building, on a single lot. With this revision,we propose to separate the expansion building from the existing building, and carve out a separate lot for it to be located on. The revised Concept Plan, submitted herein,proposes substituting a separate,2 Story Office building,of approximately 30,000 s.f.,located on the NW portion of the site,within a new, separate lot. This new structure would be instead of the previously approved 23,000 s.f addition to the existing building. The façade of the new structure would be of a similar nature to the existing Phase I structure, complementary in design and materials. Also included in our submission is a Tree Conservation Plan and a Landscape Plan,using the previously approved Landscape Plan as a guide,but making sure to meet the Buffer yards and Interior Landscaping requirements for the site as a whole. The requested zoning is S-P-2 Generalized Site Plan District,following the 0-1 Office District Uses with all previous conditions of approval remain in effect. In addition,we are questions the following exceptions and additional requirements: 1.A parking requirement of one space for every 225 square feet of building area,regardless of occupancy. 2. Exhibit A:the Nissan Murano.Once an automo- tive fashionista,its threads have weathered the in- tervening years well,de- spite their age.Luckily, this is a look that had legs. But its long production run has more to do with corporate neglect than any true product strategy. Nevertheless,despite all of the action behind the scenes,the company has managed to finally rede- sign the Murano,its mid- size SUV. Wearing a design that’s once more up-to-the- minute chic,the 202 5 Murano is 2.6 inches wider than the previous rendition,although overall length and height are about the same.The front- end features slim LED headlights visually con- nected by a thin trim bar. Beneath it,the Murano’s daytime running lights are visually integrated into the horizontal front grille, much like the redesigned Nissan Kicks.Its clean, strong horizontal form lends strength to the front end.Out back,the tail- lamps are integrated into a single light bar.The side window shape recalls that of the athletic Infiniti FX, while the black roof hides the body’s true shape, lending it more of a coupe-like appearance. Inside,its cabin boasts a spa-like ambiance with dual 12.3-inch screens, one for the instrument cluster,the other for in- fotainment,which proves easy to use.That said,the instrument cluster has poor graphic hierarchy, making it hard to discern what to look at first,as everything has the same visual weight.Meanwhile, the 10-speaker Bose audio system is typical of the brand —all highs and lows. Front seats are large and comfortable,with an ideal seating position. There’s good interior space in both rows,al- though predictably the second row has a low cushion,making it better for tikes.Front bucket seats have decent back bolstering but a very flat seat bottom cushion.Nis- san has done a good job of ensuring every comfort and convenience feature is accounted for,including massaging seats,quilted leather,rear seat sun- shades and a panoramic sunroof. Under the hood resides Nissan’s variable-com- pression turbocharged 2.0-liter four-cylinder engine and a nine-speed automatic transmission generating 241 horse- power and 260 pound-feet of torque,an increase of 20 pound-feet compared to the outgoing Murano. Opting for the base SV grade nets a choice of front-wheel or all-wheel drive.Mid-level SL and top-of-the-line Platinum models come solely with all-wheel drive. Nissan is proud of this powerplant’s complicated engineering.Yet it’s not nearly as good as a well- designed conventional gas engine or gas-electric hybrid.The engine buzzes unpleasantly when pressed and shows some turbo lag,which proves to be a constant companion, even during modest,gen- tle requests for power.The transmission seems engi- neered for comfortable shifts and fuel efficiency, even in Sport mode,so there’s little thrill to be had.Shifting manually reveals the engine to have some true potency that’s strangled by the need for fuel efficiency.And while the four-cylinder engine possesses complicated engineering to return superior fuel efficiency, which it noticeably lacks. My initial test drive result- ed in just 2 1.4 mpg in mixed suburban/highway driving —not a great showing. Body lean comes on quickly in corners,enough to convince you that this is a vehicle made for com- fort and modest cruising. There’s little here to incite you to seek out that twisty, curving country road. The 202 5 Nissan Mura- no is lovely to behold.It’s a cruiser,not a bruiser;an aesthetically pleasing two-row crossover for those whose idea of auto- motive art is how it looks. ORDINANCE NO. 480-667B AN ORDINANCE AMENDING ORDINANCE NO. 480, AS AMENDED, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF SOUTHLAKE, TEXAS; GRANTING A ZONING CHANGE ON A CERTAIN TRACT OR TRACTS OF LAND WITHIN THE CITY OF SOUTHLAKE, TEXAS BEING LEGALLY DESCRIBED AS LOT 1 R1 AND LOT 1 R2 , BLOCK A, RAVENAUX VILLAGE, AN ADDITION TO CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, BEING APPROXIMATELY 6.209 ACRES, AND MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A" FROM "S-P-2" GENERALIZED SITE PLAN DISTRICT TO "S-P-2" GENERALIZED SITE PLAN DISTRICT AS DEPICTED ON THE APPROVED SITE PLAN AND CONCEPT PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B", SUBJECT TO THE SPECIFIC REQUIREMENTS CONTAINED IN THIS ORDINANCE; CORRECTING THE OFFICIAL ZONING MAP; PRESERVING ALL OTHER PORTIONS OF THE ZONING ORDINANCE; DETERMINING THAT THE PUBLIC INTEREST, MORALS AND GENERAL WELFARE DEMAND THE ZONING CHANGES AND AMENDMENTS HEREIN MADE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATIONS HEREOF; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE. SECTION 7. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense.
