2025-016 ResolutionCITY OF SOUTHLAKE, TEXAS RESOLUTION NO. 25-016 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR COMMERCIAL SCHOOL, INCLUDING TRADE SCHOOL ON PROPERTY DESCRIBED AS LOT 8, BLOCK 5, CORNERSTONE BUSINESS PARK ADDITION, AN ADDITION TO THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, LOCATED AT 545 S. NOLEN DR., STE. 250, SOUTHLAKE, TEXAS. MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A", AND AS DEPICTED ON THE APPROVED PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "B" AND PROVIDING AN EFFECTIVE DATE. WHEREAS, a Specific Use Permit for commercial school, including trade school has been requested by a person or corporation having a proprietary interest in the property zoned as 1-1" Light Industrial District; and, WHEREAS, in accordance with the requirements of Sections 45.1(47) and 45.18 of the City's Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted to allow commercial school, including trade school on property within the City of Southlake, Texas, more fully and completely described in Exhibit "A", and as depicted on the approved plan attached hereto and incorporated herein as Exhibit "B" and providing an effective date, subject to the provisions contained in the comprehensive Resolution 25-016 zoning ordinance and the restrictions set forth herein. The following specific requirements and special conditions shall be applicable to the granting of this Specific Use Permit: April 1, 2025, Approved subject to the Staff Report dated March 25, 2025, and Specific Use Permit Review Summary No. 2, dated March 25, 2025, and noting the following: • Approving the Specific Use Permit for a commercial school for wrestling instruction subject to term of the primary lease and any extensions exercised by the tenant SUP REVIEW SUMMARY Case No.: ZA25-0007 Review No.: Two Date of Review: 02/28/25 Project Name: Specific Use Permit - Commercial School for Wresting Instruction at Yeah Dental Equipment Note: A Specific Use permit shall automatically expire if a building permit is not issued and construction begun within 6 months of the granting of the Specific Use permit or if the use shall cease for a period of 6 months. Due to a change in plans in operations, Yeah Dental does not require as much space as initially anticipated. The owners of Yeah Dental would, therefore, like to request a SPECIFIC USE PERMIT for the space. The owners of Yeah Dental have children who wrestle and they would like to convert the excess space into a small wrestling school for the community. It will be owned and operated by the owners of Yeah Dental. Proposed use is less than 50% of the time(and would mainly occur during non -business hours) and use will be less than half of the entire space. While our space is zoned L-1, we respectfully request a specific use permit (secondary use) based on other businesses in within 2 blocks of our current space (in our commercial cluster of buildings) having a similar use as our proposed one. They offer athletic training/instruction along the lines of what our wrestling school would offer. The sports instructional schools are: Impact Performance & Fitness at 525 S. Nolen Dr. #100 D-Bat Baseball Academy at 410 S. Nolen Dr. Resolution 25-016 SUP Review Summary Response 1. Provide a detailed plan for how pick-up and drop-off will be coordinated. Parents or guardians will park their vehicles and escort their children into the facility. Most parents or guardians will then leave and return at the conclusion of the class to retrieve their children. As the students will mainly be minors, it is expected that the parents/guardians will escort them into the facility and escort them out at the end of class. The wrestling school will have its own entrance right where the crosswalk is (noted with the red star) so there is ease of entering/exiting. Children will be supervised and will only be released to the parent/guardian. Est 2. Provide details on how many people will be using the space, what their roles will be, hours of operation and the timing of events. - Since these classes are designed for children, they will typically be held after school, on weekends, and during school holidays. Planned hours are weekday evenings and several hours on weekends (approximately 6:00 to 9 p.m. on weekdays and 10:00 a.m. to 4:00 p.m. on weekends). - There is no anticipated negative impact on traffic or parking, as classes are generally held outside of business hours but also the size of the wrestling school is not expected to be overwhelming where the other businesses are unduly adversely affected. Resolution 25-016 - Each class will likely average approximately ten students with one or two instructors present. The instructors will be teaching wrestling. Classes are scheduled at all times with consideration for our neighboring tenants so as not to disrupt their normal business operations. As we share a business space, it is in our best interest to ensure that our business operations are not negatively affected by the wrestling school. We plan to conduct classes in a manner that will not unduly cause issues with surrounding businesses. 3. In addition to the plan showing the layout of the building, please provide detail on the type and amount of equipment that will be used. -Wrestling mats (see below for image) which are similar to gymnastics mats. No other equipment is needed for wrestling. It is a simple sport with minimal equipment requirements. Provide a small-scale location map showing the surrounding buildings and parking area, including proposed traffic flow.
