PROJECT: Specific Use Permit for Electric Vehicle Charging Spaces at Park Village EXECUTIVE
SUMMARY: Richard Medina of Electrify America, LLC, is requesting approval of a Specific Use
Permit for electric vehicle charging spaces, on property described as Lot 1, Block
1, Park Village., City of Southlake, Tarrant County, Texas located at 1035 E.
Southlake Blvd. Current Zoning: “S-P-1” Detailed Site Plan District. SPIN
Neighborhood #9.
DETAILS: Electrify America, LLC is requesting approval of a Specific Use Permit for electric
vehicle (EV) charging spaces consisting of four dual EV charging stations installed
at four dedicated parking spaces. One of the parking spaces will be handicapped
accessible. The EV charging spaces will be located at the southeast end of the
Park Village retail center located at 1035 E Southlake Blvd. The charging stations
will be utilized as public electric vehicle charging spaces.
Electric vehicle charging spaces are allowed with an approved Specific Use Permit
and limited to a maximum utilization of 10% of required parking spaces. The
proposed installation of four EV charging spaces will replace five existing parking
spaces. To maintain the overall parking count, one additional non-EV parking
space will be added on the north side of the shopping center, resulting in no net
change to the total number of parking spaces on site.
On May 8, 2025, the Planning and Zoning Commission recommended approval (7-
0), requesting the applicant to bring the primary term of the lease and any options
to City Council for City Council to evaluate; noting that the applicant has agreed to
bring options with regard to the paint color of the equipment and shielding and
screening options of the equipment, and also requesting staff to make a
recommendation on any term of the approval based on prior approvals of similar
equipment.
Per the Planning and Zoning Commission’s direction, staff has reviewed past
Specific Use Permit approvals for electric vehicle charging spaces. The following
SUPs included additional conditions:
• ZA16-068; 4 EV charging spaces at Verizon at 500 W. Dove Rd.; Approved
specifically requiring the bollards located in front of the charging stations to
be painted grey.
• ZA16-105; 6 EV charging spaces at 1401 Federal Way; Approval specified
the SUP will be valid for the term of the lease for this specific tenant (Tesla)
and any subsequent options and extensions, and all wiring for the electrical
charging stations must be below ground.

TRANSPORTATION
ASSESSMENT: This request is not likely to have a sizable effect on traffic on or around the
property.
SOUTHLAKE
COMPREHENSIVE PLAN: Southlake’s Mobility Master Plan recommends exploring opportunities for
electric vehicle recharge stations in public and private development where
appropriate.
HISTORY: - The property was annexed into the City in 1956.
- A Zoning Change and Site Plan (ZA08-059) from “AG” Agricultural District
to “S-P-2” Generalized Site Plan District with “C-2” Local Retail
Commercial District uses and regulations for The Plaza on Southlake Blvd.
was approved by City Council on December 2, 2008. The site plan for the
property, which is located at 1001 E. Southlake Blvd., includes nine one-
story retail and office buildings totaling approximately 65,000 square feet.
- A Zoning Change and Concept Plan (ZA12-090) from “AG” Agricultural
District to “S-P-2” Generalized Site Plan District for Southlake Park Village
that included approximately 217,000 square feet of retail development and
a parking garage was approved by the Planning and Zoning Commission
on November 8, 2012 and approved by City Council at 1st reading
December 4, 2012. The case was withdrawn prior to a 2nd reading at
Council.
- A Preliminary Plat (ZA12-091) for Southlake Park Village was approved
by the Planning and Zoning Commission on November 8, 2012. The case
was withdrawn before moving forward to City Council.
- A Zoning Change and Site Plan (ZA13-060) from “S-P-2” Generalized
Site Plan District and “AG” Agricultural District to “S-P-1” Detailed Site Plan
District for Park Village was approved October 15, 2013.
- A Preliminary Plat (ZA13-061) for Lot 1, Block 1 and Lot 1, Block 2, Park
Village was approved October 15, 2013.

- A Final Plat (ZA13-119) Lot 1, Block 1 and Lot 1, Block 2, Park Village
was approved November 7, 2013.
- A Zoning Change and Site Plan (ZA14-037) from “S-P-1” Detailed Site
Plan District to “S-P-1” Detailed Site Plan District for Park Village to
approve revisions to the Landscape Plan was approved May 20, 2014.
- A Zoning Change and Site Plan (ZA14-106) from “S-P-1” Detailed Site
Plan District to “S-P-1” Detailed Site Plan District for Park Village to revise
the elevations for the patio cover on the east side of Building “K” for
Gloria’s Latin Cuisine at 1121 E. Southlake Blvd. was approved October
21, 2014.
- A Site Plan (ZA15-001) for a covered patio for Luna Grill at 1141 E.
Southlake Blvd. (Building M, Suite 540) was approved February 17, 2015.
- A Site Plan (ZA15-064) for a covered patio for Taverna Rossa at 1151 E.
Southlake Blvd. (Building N, Suite 300) was approved August 18, 2015.
- A Site Plan (ZA15-088) for a covered patio for Malai Kitchen at 1161 E.
Southlake Blvd. (Building O, Suite 220) was approved October 6, 2015.
- A Zoning Change and Site Plan (ZA16-058) from “S-P-1” Detailed Site
Plan District to “S-P-1” Detailed Site Plan District for Park Village to
approve revisions to the Landscape Plan was approved November 1,
2016. To mitigate drainage problems, at grade planting beds and tree wells
within 20’ of a building were approved to be replaced with self-contained
raised planters. Replacement of the at grade planting beds and tree wells
with above ground planters has not yet occurred.
- A Site Plan (ZA17-067) for Protein Fit Kitchen patio covers at 1151 E.
Southlake Blvd. (Building N, Suite 390) was approved by City Council on
October 2, 2017 to expire July 31, 2018 with a variance to allow metal
support columns. The patio covers were removed when the Site Plan
expired.
- A Zoning Change and Site Plan (ZA20-0021) for revisions to the Park
Village development to include modifications to the fountain and
landscaping, enhancements to the plaza area paving, the addition of a
shade structure, modifications to the northeast and northwest corners of
the property, and, to address existing drainage issues, at grade planters
and tree wells within 20’ of a building to be removed throughout the site
was approved by City Council November 17, 2020.
- A Site Plan (ZA21-0010) for The Jane Patio Cover at 1151 E. Southlake
Blvd. (Building N, Suite 390) was approved April 20, 2021.
- A Specific Use Permit (ZA23-0024) was submitted for an electric charging
station but the case was closed due to inactivity.

PLANNING & ZONING
COMMISSION ACTION: May 8, 2025; Approved (7-0), subject to the Staff Report dated May 2,
2025, also subject to the Specific Use Permit Review Summary No. 2,
dated May 2, 2025, and noting:
• Requesting the applicant to bring the primary term of the lease and
any options to City Council for City Council to evaluate;
• Also noting that the applicant has agreed to bring options with
regard to the paint color of the equipment and shielding and
screening options of the equipment, and
• Also noting that we requested staff to make a recommendation on
any term of the approval based on prior approvals of similar
equipment.
STAFF COMMENTS: The Specific Use Permit Review Summary No. 2 dated May 2, 2025 is
attached.
Note: A specific use permit shall automatically expire if a building permit is
not issued and construction begun within six (6) months of the granting of
the specific use permit or if the use shall cease for a period of six (6)
months.
45.20 SPECIFIC REGULATIONS FOR ELECTRIC VEHICLE CHARGING SPACES
1) Electric vehicle charging equipment may only be installed when accessory to the primary
permitted use.
2) No more than 10% of the total number of required parking spaces may be designated as electric
vehicle charging spaces.
3) Each charging space shall be posted with signage indicating the space is only for electric vehicle
charging purposes. Days and hours of operations shall be included if time limits or tow away
provisions are to be enforced by the owner. Information identifying voltage and amperage levels
or safety information must be posted.
4) Design should be appropriate to the location and use. Facilities should be able to be readily
identified by electric vehicle drivers but blend into the surrounding landscape/architecture for
compatibility with the character and use of the site.
5) Equipment shall be located so as not to impede pedestrian travel, create trip hazards on
sidewalks, or interfere with accessibility requirements.
6) Regulations for the electric vehicle charging equipment and spaces shall be established in the
specific use permit. These regulations may include but are not limited to location; size of
equipment; signage, including directional signage (if any); and lighting (if any).
45.5 FACTORS TO BE CONSIDERED - In granting or denying an application for a specific use permit, the
City Council shall take into consideration the following factors:
a. Safety of the motoring public and of pedestrians using the facility and the area immediately surrounding
the site.
b. Safety from fire hazard, and measures for fire control.
c. Protection of adjacent property from flood or water damage.
d. Noise producing elements; and glare of vehicular and stationary lights and effect of such lights on
established character of the neighborhood.

e. Location, lighting and type of signs; and relation of signs to traffic control and adverse effect on
adjacent properties.
f. Street size and adequacy of pavement width for traffic and reasonably expected to be generated by the
proposed use around the site and in the immediate neighborhood.
g. Adequacy of parking, as determined by requirements of this chapter for off-street parking facilities for
similar uses; location of ingress and egress points for parking and off-street loading spaces; and
protection of the public health by all-weather surfacing on all parking areas to control dust.
h. Such other measures as will secure and protect the public health, safety, morals and general welfare.
i.City Council may grant variances to specific regulations associated with a specific use set forth in
Sections 45. To receive a variance, the applicant must demonstrate one of the following (As amended by
Ordinance No. 480-MMMM):
(a) A variance will reduce the impact of the project on surrounding residential properties; or
(b) Compliance with this ordinance would impair the architectural design or creativity of the project; or
(c) A variance is necessary to assure compatibility with surrounding developed properties; or
(d) The proposed construction is an addition to an existing project that does not meet the
requirements of this ordinance.

Tree Conservation/Landscape Review
LANDSCAPE COMMENTS:
1. The Landscape Plan shall be prepared, signed, and dated by a State of Texas Registered Landscape
Architect.
2. Required interior, parking, and east bufferyards landscaping are proposed to be removed for the
construction of the charging station but the replacement plant material does not match the type and
species of the plant material proposed to be removed. So the landscaping will be consistent with the
development landscaping, match the replacement plant material type and species with the type and
species of plant material that are proposed to be removed.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR
ELECTRIC VEHICLE CHARGING SPACES ON COMMERCIAL
PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS,
LOCATED AT 1035 E SOUTHLAKE BLVD, BEING DESCRIBED AS
LOT 1, BLOCK 1, PARK VILLAGE AS DEPICTED ON THE
APPROVED SITE EXHIBIT ATTACHED HERETO AND
INCORPORATED HEREIN AS EXHIBIT “A” AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for Electric Vehicle Charging Spaces on commercial
property has been requested by a person or corporation having a proprietary interest in the
property zoned as “S-P-1” Detailed Site Plan District; and,
WHEREAS, in accordance with the requirements of Section 45.1 (49) and 45.19 of the
City’s Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City
Council have given the requisite notices by publication and otherwise, and have afforded the
persons interested and situated in the affected area and in the vicinity thereof; and,
WHEREAS, the City Council does hereby find and determine that the granting of such
Specific Use Permit is in the best interest of the public health, safety, morals and general welfare
of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for Electric Vehicle Charging Spaces on commercial
property at 1035 E. Southlake Blvd. being described as Lot 1, Block 1, Park Village as depicted
on the approved Site Exhibit attached hereto and incorporated herein as Exhibit “A” and
providing an effective date, subject to the provisions contained in the comprehensive zoning
ordinance and the restrictions set forth herein.
