INVOCATION: Mayor Sam Sparger The Minutes of the.September 7, meeting were approved as presented. MAYORS REPORT Mayor Pro Tem Latta reported on a meeting which was held this week with representatives from Motorola, Circle Communications and City Staff. Latta said they came to a mutual understanding concerning the mainten- ance of our communications system. Latta read a letter from John Francis of Motorola. (A copy of the letter is hereby attached to the minutes). Ordinance No. 275, setting the Tax ORDINANCE Levy for Fiscal Year 1983 was approvedjgO. 275 TAX LEVY Mayor Sparger read our Tax roll inform - tion as presented to the City by Tarra t Appraisal District. He added the roll shows our net taxable value as $69,128,802.00. Ordinance No. 172 was discussed in ORDINANCE connection with truck traffic on NO. 172 South Carroll Avenue. The Ordinance DISCUSSED named existing truck routes. The current Ordinance was reviewed and City Attorney, Bill Smith, answered questions for the Council. Representatives from Mid-Cities Ready Mix Concrete and Express Concrete Co. were present for the meeting at the request of the Mayor, due to the fact that the cement mixer trucks are the basis for the complaints. Several alternatives were suggested in an effort to eleviate the heavy truck traffic on residential streets in Southlake. It was noted that for the trucks to go Highway 26 around on Highway 114, would be approximately 3.9 miles further. Citizens present who spoke during the meeting include: Bill Rucker, C.A. Prade, John Campbell Marcus Wayland, Rick Stacy, Randy Stacy, Herb Felstead, Ken Foriet, Kathy Campbell. Mayor Sparger, after extensive discussion, polled the Council and the agreed to a meeting being held in an effort to come to a compromise where the citizens, and city concrete companies might be able to work to- gether to solve the problem of damaged streets, accessive truck traffic and speed limit control. The meeting will be set for Thursday of this week. Council agreed that more study is needed to be made on the subject before approval. The item was tabled until the next City Council meeting. ZA 82-31. The zoning request for ZA 82-31 Agricultural to A-4 Single Family ZONING District for a 2.885 acre tract of CHANGED land out of the L.H. Chivers Survey, TO A-4 Abstract 300 was approved as recommen - Latta x x ed by the Planning and Zoning Loris x Commission. 4Vesterholm x x McCombs x There were no comments during the Bone x public hearing. ZA 82-32. The request for a Special Exception Use Permit for outdoor storage of building materials was discussed. The property, a 9.99 acre tract of land out of the L.B.G. Hall Survey was discussed. It was noted that the Planning and Zoning Commission recommended denial by unanimous vote. Reasons stated were location to the city park and noise. P & Z member, Larry Samartin, showed slides of the present location of the operation. John Dunn, president of Dunn-Bar was present and answered questions for the Council and Audience. During the public hearing, the follow- ing persons spoke: Mr. Rider, Ken Feriet, Herb Felbsted, Randy Stacy, Ralph Evans, Larry Smith, Virgil Cash and Kim Campbell. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: 1. That there is hereby levied and shall be collected as provided by law an ad valorem tax for the year 1982 on all preperty, real or personal, except such property as may be exempt from taxation by the Constitution and the Statutes of the State of Texas, situat- t_-d within the corporate limits of the City of Southlake, Texas, on January 1,1982, and that the amount to be applied to the value of such property shall be FORTY-`.ONEAND ONE HALF CENTS (41 21-) p r hundred dollars of assessed valuation. (Which is appropriated by 1.00% of Market Value). 2. That. the tax so levied and assessed shall be apportioned to the following accounts and funds in the amounts set forth: GENERAL FUND .232 GENERAL OBLIGATION BOND INTEREST AND SINKING FUND .18 TOTAL LEVY .412 Collections of the taxes levied shall be deposited to credit of each of the above accounts and funds in their proportionate share of the total levy after taking into consideration a 2 uncollectable factor which is to be accounted for in the General Fund. 3. That the taxes provided for herein are in accordance with appropriate State Statutes. 4. Ad Valorem Taxes levied by this Ordinance shall be due and. payable on October 1,1982, and shall become delinquent on the first day of February, 1983. Payment of such tax is due in one full installment. 5. If the TAX is unpaid after February 1,1983, such tax will become delinquent and penalty and interest will attach and accure as provided by the Statutes of the State of Texas, including Article 1060a and 7336, V.T.C.A.S. 6. In the event the taxes become delinquent and in the event such delinquent taxes are referred to any attorney for collection, and additional amounf of 20% of the total amount of tax, pentaly and interest then due shall be added as collection costs and paid by the taxpayer. 7. Taxes herein levied and uncollected shall be a first, prior, and superior lien against the property, and the said lien shall be superior and prior to all other liens, charges and encumbrances, and such lien shall attach to personal property with the same priority as to real property. 8. The lien provided herein shall be attached as of January 1,1983. 9. Should any section, provision or clause of this Ordinance be de- clared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of this Ordinance as a whole or any part therefore other than the part so declared to be invalid. 10. This Ordinance shall become effective from and after the date of its approval and adoption as provided by law.
