The Minutes of the December 1S, regular
City Council Meeting were approved,
as were the Minutes of the December
21, Special City Council Meeting.
MAYORS REPORT:
Mayor Sparger announced that the new
Police Car was delivered on this date.
Latta made the statement to Council
in an effort to answer questions
concerning the future water storage
of Southlake, that in order to
obtain State Certification of our
water system, a rule of thumb is,
1 million gallons of over head
storage for 3 thousand people, is

ORDINANCE J
AN ORDINANCE AMENDING ORDINANCE NO. 118 AS AMENDED BY
ORDINANCE 231-1 OF THE CITY OF SOUTHLAKE, TEXAS, BY RE-
STATING THE EXISTING PREAMBLE; SUBSTITUTING A NEW PARA-
GRAPH XXV.-SPEED LIMIT; PROVIDING A SEVERABILITY CLAUSE;
REPEALING ORDINANCES OR PARTS OF ORDINANCES INCONSISTENT
OR IN CONFLICT HEREWITH; PROVIDING FOR AN EFFECTIVE DATE;
RE-STATING PENALTIES FOR VIOLATIONS; AND DIRECTING PUBLI-
CATION OF THE CAPTION AND PENALTY CLAUSE.
WHEREAS, pursuant to Section 169 of Article 6701d, Revised
Civil Statutes of Texas as amended, the City of Southlake, Texas has
authority to establish prima facie maximum reasonable and prudent
speeds within its corporate boundaries for vehicles on streets and
highways; and,
WHEREAS, based upon speed studies and taking into considera-
tion engineering and traffic investigations and recommendations on
the part of the Chief of Police of the City of Southlake, Texas, and
after public hearing held; and after the said City Council finding
that maximum prima facie speed limits on the public streets and
highways mentioned hereafter should be so regulated in the interest
of preservation of the public health, safety and welfare;
NOW THREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF SOUTHLAKE, TEXAS:
A. That Subsection 5 of Article XXV of Ordinance 118, as
amended by Ordinance 231-1, entitled "Speed Limit" shall read as
follows:
XXX
5. The prima facie maximum reasonable and prudent speed on the
portion of any street, road or highway designated below shall be
twenty (20) miles per hour, for any vehicles traveling thereon, during
and between the hours of 7:30 o'clock a.m. to 8:45 o'clock a.m. , both
inclusive, and during and between the hours of 2:30 o'clock p.m. to
3:45 o'clock p.m., both inclusive, Monday through Friday, provided
that an appropriate sign giving notice thereof is erected. It shall
be an absolute defense to any alleged violation of this ordinance, and
specifically this subsection, that the day upon which the alleged
violation occurred was a day when the nearest public or private insti-
tution or elementary or secondary education had no classes in session.
The location of the said school zones referred to immediately above
are as follows, to wit:
B. The penalty for violation of Amendment to Ordinance 118 of
the City of Southlake, Texas, as amended, shall be a misdemeanor
punishable by a fine of not less than ONE DOLLAR ($1.00) and no more
than TWO HUNDRED DOLLARS ($200.00).
C. If any portion of this amendment shall be declared for any
reason unconstitutionally invalid, then such decision shall not
affect the validity of the remaining portions of this amendment.
D. This amendment hereby repeals any other ordinance or
portion thereof of the City of Southlake, Texas, in direct conflict
herewith.
E. The City Secretary of the City of Southlake, Texas is
hereby directed to publish this amendement under the applicable laws
but may publish only the caption and penalty clause thereof and this
said ordinance shall take effect and be in full force and effect from
and after the date of its passage and publication as provided by law.
