Acti g City Secretary 35 CITY OF SOUTHLAKE REGULAR MEETING OF THE CITY COUNCIL MARCH 2, 1976 The City Council of the City of Southlake, Texas, met in regu- lar session in the Council Chamber of City Hall, 667 North Carroll Avenue in Southlake on Tuesday, March 2, 1976, with the following members present: Wade Booker, Mayor Sam Davis, Mayor Pro Tem W. 0. Nunn, Councilman Ben H. Berry, Councilman Absent: Billy Joe Knox, Councilman James H. Winfrey, Councilman Staff Members Present: William D. Campbell, City Attorney D. R. Hughes, Police Chief Craig Eaton, Consultant Planner. Mayor Booker called the meeting to order at 7:30 P.M. The in- vocation was given by Councilman Nunn. The Minutes of the last regular meeting were approved as read. ORDINANCE NO. 227; changing the maximum speed limit in the school zone on State Highway 114 from 45 M.P.H. to 35 M.P.H., and set- ting the maximum speed limit at 55 M.P.H. along certain other sections of State Highway 114, was unanimously passed and ap- proved on motion by Councilman Nunn; seconded by Councilman Davis. (Said Ordinance attached hereto and made a part hereof.) ORDINANCE NO. 161-68, amending Zoning Ordinance No. 161, regu- lating outdoor signs along State Highway 114 and FM 1709 in ac- cordance with the Federal Act, was unanimously passed and ap- proved on motion by Councilman Davis; seconded by Councilman Nunn. (Said Ordinance attached hereto and made a part hereof.) Councilman Davis moved that the bills presented be approved for payment; seconded by Councilman Nunn. Motion passed unanimously. (See attached list.) The PUBLIC HEARING ON THE PROPOSED ZONING ORDINANCE was opened for discussion. The Mayor requested anyone wishing to speak to 36 come forward to the podium, state their name for the record and limit their remarks to 2 to 3 minutes. Bob Lyford asked that his property be left as is (AG District) because he does not think Southlake needs a heavy industrial area. A. C. Urbanosky expressed concern over Goode's Airport and said he would like to see a list made of changes so everyone could see it. Councilman Nunn asked if he wants a zoning ordinance and Mr. Urbanosky replied, "Yes, we need it." He also said he objected to the wording regarding the flood plain. Bob Goode stated his case for the continuing operation of his airport, wanting to remain H Commercial District as is now zoned. Bill Spangler spoke against the proposed ordinance stating he is not for industrial zoning where it is. Harold Knight asked why the current ordinance was being updated in the first place. The Mayor answered that one reason is there is no heavy industrial zoning without which there is no suppor- tive tax base and without that Southlake would be a bedroom city that lower income families could not survive in. Mr. Knight said he would like to retain his property as is and that he is against the proposed plan. Weldon Banks spoke against the ordinance stating he does not want his land zoned for industrial use. Ralph Polson stated he saw no reason to spend money trying to please COG, EPA, etc. until they are "pinned down" as to their requirements. Malcolm Davis commended the Planning & Zoning Commission for their efforts and asked that a list be made of all the requests for changes and what is being done with the requests. In this way, he said a decision could be made and everyone could get back to business. John Stevenson addressed the Council at length stating that some of the conflicts and pressures under the present ordinance brought out the need for updating and he feels, with the rough spots worked out in the proposed ordinance the City can have an ordi- nance that is acceptable to the majority. Jim Armstrong spoke in favor of Goode's airport saying it bene- fits the community. 37 Martin Vale stated there must be adjustment to change. He gave examples of current needs the city cannot remedy because there is not a sufficient tax base. He summed up by saying the general plan should be adopted. Louise Morrison spoke commending the Council and Commission for their efforts and stated that there should be a compromise, so that most everyone can be pleased. A. C. Urbanosky returned to the podium to speak about the flood plain designation. Discussion followed. Mrs. Robertson asked if her residence burned down could she rebuild it in a commer- cial district. The City Attorney advised she could not. The Planning & Zoning Commission had discussed and agreed informally under such a circumstance to allow rebuilding. Marcus Wayland addressed the Council stating he is opposed to the ordinance because zoning would increase taxes. The City Attorney explained the relation between zoning and taxation. Discussion followed. Other questions and answers followed. Discussion arose concern- ing the sewer. Councilman Nunn re-stated the Council's position of evolutionary and orderly changes according to a plan. Coun- cilman Davis moved that the proposed zoning ordinance in its present form be disapproved until changes to be made are incor- porated, and that a citizens' advisory committee be appointed to work with the Planning & Zoning Commission. Martin Hawk addressed the Council stating he understood that the recommendations of the Planning & Zoning didn't quite reflect the words of the Planning & Zoning members and he would like to hear from them. He went on to say he does not feel anyone is against growth of a sort but "not the kind of growth t at th proposed ordinance would have" and that the present ('ornc i~ be accepted with the recommended changes. Discussion followed regarding Bob Goode's airport with Eleanor Kasper and Councilman Berry saying they feel he should be zoned so he can continue with his airport. On the advice of the City Attorney, Councilman Davis amended his motion to add when and if a new study is ready, public notices will be sent out as was done initially; seconded by Councilman Nunn. Motion passed unanimously. Ed Norman stated it would be good for the City to have an indus- trial committee to seek industries. Mayor Booker asked if anyone in the audience would like to serve 38 on the Citizens Advisory Board to please leave their name at City Hall. Martin Hawk said he would serve, as did Ed Norman, Ed Seydler, A. C. Urbanosky and Marcus Wayland. There being no further business, the meeting adjourned. C' ay-or ATTEST: City Secretary
