City Matters: a) Gas for City Administration Use b) Copy Machine (second-hand) c) Reply from Jimmy Walker re Trailer d) Approval of Bills 59 REGULAR MEETING OF THE CITY COUNCIL MAY .?5 , 1970 The City Council of the City of Southlake, Texas, met in regular session in the Council Chamber of City Hall on Tuesday, May 5, 1970, with the following members present: J. L. Clow, Mayor Wade Booker, Mayor Pro Tem Thurman Hearn, Councilman Ralph Polson, Councilman Absent: W. B. Brown, Councilman Billy Joe Knox, Councilman ' Also present: William D. Campbell, City Attorney Mayor Clow called the meeting to order at 7:40 P.M. The invocation was given by Rev. Gene Tyson of White's Chapel Methodist Church. The minutes were approved as corrected. ORDINANCE NO. 173 was read to the Council by Mayor Clow wherein certain property consisting of five acres, more or. ' less, owned by James Harrell, Raymond Davis and Joel Hedge, out of the John Childress Survey, Abstract No. 254, is to be annexed to the City of Southlake; WHEREUPON Councilman Hearn made the motion to adopt Ordinance No. 173, annexing said ' property to the City of Southlake; seconded by Council- man Polson. Motion carried unanimously. ' ORDINANCE NO. 161-11 was then introduced by Mayor Clow who informed the Council this ordinance designates the zoning of the property described above as "H" District, Heavy Com- mercial; WHEREUPON the motion was made by Coungilman Hearn to adopt Ordinance No. 161-11 designating the property described therein as being zoned "H" District, i.e., Heavy Commercial; seconded by Councilman Booker. Motion carried unani ousl . (Oopies of both ordinances attached and made a part hereoI.) Fire Department Report was given by Fire Chief Steele (copy ' attached hereto . He further reported that the Fish Fry was being planned, that Unit 3002 was still in the process of being repaired, that Units 3001 and 3008 are okay, and he requested and was given permission for space in the Police 63 Department temporarily for a desk and file cabinet and phone. Councilman Booker directed the City Secretary to get bids on insulating the upstairs portion of the building. Police Department Report given by Chief Ince. (Copy attached.) Planning & Zoning Commission recommendation concerning ZA 70-2 was read to the Council by Mayor Clow. (Copy attached. A public hearing on same was set for May 22, 1970, at 7:30 P.M. Crypts: Mr. Henry Golembiewski made a brief presentation of the Episcopal Church's plans to build a church on certain property in the City of Southlake under which burial crypts ' would be constructed. (The Council Chamber was filled with interested citizens who were permitted to present their views to the Council.) Mr. Campbell, City Attorney, advised that our zoning ordinance would have to be amended to permit a cemetery since there is no provision for same in it now and that a cemetery is not legally construed as a church use. City Matters: Motion by Councilman Hearn to permit the City Secretary 20 gallons of gas a month for use in the course of city business; seconded by Councilman Polson. Motion carried 16 unanimously. The City Secretary thanked the Council for their generosity. The City Secretary informed the Council that Mr. Jimmy Walker, in response to a letter from the City, telephoned to say the trailer was in the process of being sold and when sold would be removed...' Councilman Hearn suggested that this matter be followed up in thirty days. The matter of a copy machine was tabled at this time. ' Motion by Councilman Hearn to approve the bills presented; seconded by Councilman Polson. Motion carried unanimously. Matters not on the Agenda: Chief Ince reminded the Council five signs were needed to indicate truck routes. Motion was made by Councilman Booker to purchase five such signs at a cost of $3.75 each; seconded by Councilman Hearn. Motion carried unanimously. Dr. M. M. Vale informed the City Council that Glen Remer is using his property for commercial purposes without proper zoning. Mayor Clow advised that a non-conforming use, which Mr. Remer's property has, does not permit expansion without properzoning and that the matter would be checked into. Also, Dr. Vale informed the Council that Reliable Transport Company is causing oil to be washed along the road causing pollution to the soil and stock tanks of nearby property owners, parti- Council Mtg. 5/5/70-Pg. 2 cularly his father- and mother-in-law's place.
