Budget o b PF b OF lb `x20 REGULAR MEETING OF THE CITY COUNCIL DECEMBER 2, 1969 The City Council of the City of Southlake, Texas, met in regular session in the Council Chamber of City Hall on Tuesday, December 2, 1969, with the following members presamt: J. L. Clow, Mayor Thurman Hearn, Mayor Pro Tem J.. D. Cate, Jr., Councilman M. J. O'Brien, Councilman Wade Booker, Councilman A Absent: W. B. Brown, Councilman Also Present: William D. Campbell, City Attorney Mayor Clow called the meeting to order at 7:30 P.M. The minutes of the last .regular meeting were approved as read. Fire Department Report was given by Fire Chief Bob Steele. Copy attached hereto.) It was decided to pay for the tickets to the annual Firemen banquet ($132.00) out of the 1970 Fire Department budget. Chief Steele suggested that Ordinance No. 162 should be amended to read, under Paragraph C, "The City Fire Marshal and/or Fire Chief may prohibit. . . Council- do man Booker so moved; seconded by Councilman Hearn. Motion carried unanimously. (Copy attached entitled Ord.162-A.) Firecracker Ordinance, as prepared by the City Attorney, was read to the Council by the Mayor. Discussion followed. The motion was made by Councilman Booker to adopt said ordinance, which becomes City Ordinance No. 169, prohibiting the sale and shooting of fireworks within the corporate limits of the City of Southlake; seconded by Councilman Cate. The vote was as follows: For: Councilmen Booker and Cate. Against: Councilmen Hearn and O'Brien. The tie was broken by the Mayor voting for the ordinance. The motion tarred 2. (Co attached and made a 3- (Copy part hereof.) d 1970 Budget,and Tax Levy was adopted with changes made on motion + by Councilman Booker; seconded by Councilman Cate. Motion carried unanimously. (Copy of Ord. No. 158-A and Ord. No. 158-2 attached and made a part hereof.) Police Department Report by Chief G. D. Ince (copy attached). Motion by Councilman O'Brien to have the City Attorney draw up an ordinance regarding weight law; seconded by Councilman Booker. Motion carried unanimously. Motion by Councilman O'Brien to pur- SECTION 3. A. If said taxes are paid one-half (1/2)on or before November 30, 1969, then the taxpayer shall have until and including the 30th day of the succeeding June within which to pay the other one-half (1/2) of said taxes without penalty or interest. B. If said taxpayer, after paying said one-half (1/2) of his taxes on or before November 30, 1969, shall fail or 40 refuse to pay, on or before June 30th next succeeding said November, the other one-half (1/2) of said taxes, a penalty +ei of 8% of the amount of said unpaid taxes shall accrue thereon. C. If any taxpayer fails to pay one-half (1/2) of the said taxes, on or before the 30th day of November of the year for which the assessment is made, then unless he pays all of such taxes on or before the 31st day of the succeeding January, the following penalty shall be payable thereon, to-wit: During the month of February,.one percent (1%); During the month of March, two percent (2%); During the month of April, three percent (3%); Ad During the month of May, four percent (4%); During the month of June, five percent (5%); and on and after the first day of July, eight percent (8%). D. As provided above, in the event such taxes become delinquent, the same shall bear interest at the rate of 6% per annum from the date of their delinquency. 'S'ECTION 4. The taxes herein levied shall be a first and prior lien against the property upon which they are assessed and the said first lien shall be superior and prior to all other liens, charges, and encumbrances, and this lien shall attach to personal property to the same extent and with the same. priorities as to real estate.. SECTION 5. The liens provided herein shall attach as of Jaunary 1,1969. SECTION 6. Should any part of this ordinance be declared invalid, for any reason, that invalidity shall not effect the remainder of this ordinance, which remainder shall continue in full force and effect.
