Section 551.087: Deliberation regarding economic development negotiations. The City
Council may discuss or deliberate regarding commercial or financial information
received from a business prospect that the city seeks to have locate, stay, or expand in
or near the city and which the City is conducting economic development negotiations; or
to deliberate the offer of a financial or other incentive to a business prospect as
described above.
Section 418.183(D: Texas Disaster Act. The City Council may deliberate information: 1)
for purposes of preventing, investigating, or responding to an act of terrorism or related
criminal activity and involving emergency response providers, their staffing, contact
information and tactical plans; 2) that relates to the risk or vulnerability of persons or
property, including infrastructure, to an act of terrorism; 3) that relates to the assembly
of an explosive weapon, the location of a material that may be used in a chemical, I
biological or radioactive weapon, or unpublished information pertaining to vaccines or
devices to detect biological agents or toxins; 4) that relates to details of the encryption
codes or security keys for a public communication system; 5) that relates to a terrorism-

The Works Session was called to order by Mayor Hill at 5:30 p.m.

Clayton Reed gave the invocation. Mayor Hill led the pledges of allegiance to the United
States and Texas Flags.
3A. PROCLAMATIONS FOR EAGLE SCOUT RECIPIENTS
Mayor Hill presented proclamations to Troop 168 Eagle Scout candidates, Austin Simer
and Harrison Peyrovi, in recognition of meeting the extensive requirements for
becoming Eagle Scouts. Specifically, Austin built the three wooden game tables with
benches for the playground at Old Union Elementary School and Harrison created a

bike safety video for the students at Durham Intermediate School. Their Eagle Scout
Courts of Honor will be held on Sunday, November 20, 2016.

The Regular Session of the City Council was called to order by Mayor Hill at 6:08 p.m.

Mayor Hill announced the City Council would go into Executive Session pursuant to the
Open Meetings Act, Chapter 551, Texas Government Code, Sections 551.071,
consultation with attorney; and 551.087, deliberation regarding economic development
negotiations. City Council adjourned for Executive Session at 6:08 p.m. Executive
Session began at 6:21 p.m. and concluded at 6:57 p.m.

Mayor Hill reconvened the meeting at 7:04 p.m. There was no action necessary as a
result of Executive Session.

applicant is requesting a variance to allow a maximum height of approximately 59-feet
3-inches. Approximately 1/4 of the southern portion of the building is outside of the
1,000-foot distance from SH114. Approximately 3/4 of the northern portion of the
building is within the 1,000-foot distance from SH114 which would allow a maximum
height of 90-feet.
• Noting, this SUP will have an expiration date of January 31, 2017 as requested
by the applicant and noting if a building permit is not issued and construction
begun by this date, the SUP shall automatically expire.

Motion was made to approve Ordinance No. 480-720 (ZA16-051), 1st Reading, Zoning
Change and Concept / Site Plan for Delta Southlake Center (formerly known as White
Chapel Village) subject to Staff Report dated November 8, 2016, and Site Plan Review
Summary No. 6, dated November 8, 2016, and noting the following:
• Granting the variance as it relates to the Lighting Ordinance No. 693, as
amended, requiring a maximum illumination projected from one property to
another to not exceed 0.2 footcandles horizontal and 0.5 footcandles vertical as
requested to allow illumination of 3.0 footcandles horizontal and vertical;

exact materials and design of the retaining walls on the property;
• Noting the applicant's agreement to provide, before second reading, an eight foot
hedge screening around the pool area;
• Noting the applicant's agreement, before second reading, to meet with staff and
submit an agreement regarding preservation of the trees on the northwest corner
of the property with a generally specific tree identification of what is going to be
preserved on the general northwest corner of the property;
• Noting the applicant's agreement to attempt to have a representative of the

Plan is approved for multi-story office/retail buildings and parking garage, a
