Section 418.183(f): Texas Disaster Act. The City Council may deliberate information: 1)
for purposes of preventing, investigating, or responding to an act of terrorism or related
criminal activity and involving emergency response providers, their staffing, contact
information and tactical plans; 2) that relates to the risk or vulnerability of persons or
property, including infrastructure, to an act of terrorism; 3) that relates to the assembly
of an explosive weapon, the location of a material that may be used in a chemical,
biological or radioactive weapon, or unpublished information pertaining to vaccines or
devices to detect biological agents or toxins; 4) that relates to details of the encryption
codes or security keys for a public communication system; 5) that relates to a terrorism- l
related report to an agency of the United States; 6) that relates to technical details of
particular vulnerabilities of critical infrastructure to an act of terrorism; 7) that relates to
information regarding security measures or security systems intended to protect public
and private property from an act of terrorism. The Texas Disaster Act specifically
requires that a tape recording of the closed meeting be made.
Section 418.106(d) & (e): Local meetings to discuss emergency management plans
regarding pipeline safet . The City Council may discuss emergency management plans
involving pipeline safety and/or security of pipeline infrastructures or facilities when

A motion was made to approve Ordinance No. 480-711 (ZA15-139), 1st Reading,
Zoning Change and Site Plan for Tower Plaza USPI Medical Office Building subject to
Staff Report dated February 9, 2016 and Site Plan Review Summary No. 2, dated
January 29, 2016 granting the following variance requests: Driveway Ordinance (The
required minimum driveway stacking for this development is 100 feet.) The variance
request is to allow a stacking length of± 72' on the south (Zena Rucker Road) drive and
± 84' on the east (Tower Boulevard) drive, and noting the following from this evening's
discussion:
• The pharmacy will not have a drive-through lane;
• Modifying development regulation #5 to read as follows: " Building roof heights
shall not exceed those on the plans and elevations; in no case shall a building
exceed two stories nor 38 feet in height";
• Deleting Development Regulation #6;
• Modifying Development Regulation #8, stating a minimum of 38% of the tree
canopy shall remain instead of 27 %;
• All buildings will meet articulations standards and the Development Regulation
#9 will be removed;
• Noting that four canopy trees will be added to the north bufferyard along FM
1709 and that all bufferyards in Phase 1 and Phase 2 along City rights-of-way will
be installed prior to the issuance of a Certificate of Occupancy on the phase 1
building and the bufferyard along FM 1709 will be installed;
• Adding regulation #10 from the previous zoning regulations (Case ZA 10-054) as
shown on Attachment C, Page 3 of the Staff Report addressing site
improvements on Phase 2 to the current regulations;
• Noting that the covered parking will be removed;
• Subject to the Planning and Zoning Commission's recommendation with the
following addition: dumpster materials will be required to match building
materials, Zena Rucker Road will be constructed and accepted by the City prior
to the issuance of a Certificate of Occupancy to Phase 1 for that section, and
noting the applicant's willingness to evaluate or address the following items:
evaluate ways to address the hospital use to better identify their specific plans;
identify any additional opportunities for additional tree mitigation; identify potential
generator placement for ambulatory center; potential improvements to the north
facing/FM 1709 elevation of the north building; potential improvements to the
service door appearance on Buildings 1 and 2; noting that all mechanical,
electrical, utility risers will be screened and not visible; and,
• Instructing the applicant to bring a clean set of development regulations to the
second reading.
