Mayor Sparger informed Council of a
meeting with Reed Stewart, County
Tax Collector, in regards to the
county taking over the City tax
collections. He indicated the
charge to the city for this service
will be 400 per tract with a $450.
set-up fee.

A slide presentation was given by
Jack Petty, who requested the zoning
change. The presentation was very
thorough, showing the entire area
in which he would like to build his
business.
Bob Heath, Planning and Engineering
Manager for DFW Airport also gave a
presentation concerning the propose
cross-wind runway, which the center
line crosses through Southlake. He
indicated that this is the key to
triple arrival streams for the air-
port. Mr. Heath added that the sub-
ject property is in the "B" noise
zone and unhealthy for sound, also,
that the federal agencies do not
recommend residences in this area.
Heath, when ask, answered that the
runway would be built but no date
could be given and no funds have
been set aside for it.
Sonny James, a resident at 305 South
Kimball Avenue, presented a petition
from numerous citizens in Southlake.
He contended that the "area" is a
residential area and that the land
use map the city used has never
been officially adopted and should
not be used as a guide.
Property owners who were opposed to
the request include: Drew Shelton,
Ben Flannigan, Joe McNuff, Andrea
Peterson, Ann Flannigan, Dennis
Roberts, Janice Miller, Gerald
Thompson, Linda James, Joe Wright,
Nancy Wood and Wanda Stowe.

RECOMMENDATION FROM THE COMMITTEE TO REVIEW OSDINANCE NO. 278
The Committee recommends that the City of Southlake adopt
the Uniform Building Code as its standard for construction quality
in the City of Southlake. The committee also believes that Ordinance
No. 278 needs to be repealed.
The Committee believes that the city should control
aesthetics on commercial construction on all highways through the
City of Southlake. These highways are now Highway 114 and FM1709.
No member of the committee wishes to make an ordinance dealing
with this. The committee does recommend that Council appoint
a review committee that will function for this purpose.
The committee will have approval powers but if the
committee denies approval the applicant will have recourse to
the City Council.

REPORT TO SOUTHLAKE CITY COUNCIL
FROM COMMITTEE FOR REVIEW OF ORDINANCE 278
OVERVIEW
This Committee was formed to review the building ordinance
problems in Code 278. In general, the problem areas are:
1. 75% masonry construction of exterior walls; and
2. interior walls of four-hour fireproof protection
between businesses in a common building.
There are other problems dealing with definitions of
"equivalent materials" and other general terms.
The Committee met on Monday, January 31, and February 7,
1983, and agreed to recommend the following:
1. The City adopt the Uniform Building Code as its
standard. The rationale here is that there are
fire provisions built into this Code designed for
use and occupancy. There are problems in dealing
with smaller structures (less than 15,000 square
feet) because fireproof materials may not be
required. This can be avoided by possibly including
a local amendment that states - "all exterior
construction shall be of fireproof material of one
hour or greater."
2. The Committee believes 278 should be repealed if
the Uniform Building Code is adopted.
The question in the minds of the Committee members is:
Should this Committee make recommendations for purposes
of aesthetics?

Dear Mayor Sparger:
We have examined the proposed zoning change request with particular emphasis
on comptability of proposed land use and the Master Plan development of
Dallas/Fort Worth Regional Airport. In the ultimate design of the Airport
Master Plan, a second diagonal runway (Runway 13R/31L) will be constructed
on the northwest side of the Airport. This runway will be 11,000 feet long
and will accommodate air carrier aircraft. The land surrounding this run-
way will be affected accordingly by aircraft arrivals and departures.
We direct your attention to two Airport-related matters which should be
considered in land use planning in the vicinity of the subject case.
First, this property lies within Aircraft Sound Exposure Zone "B", and is
immediately adjacent to Zone "C". These Aircraft Sound Exposure Zones are
identified on the "Aircraft Sound Exposure Map: Dallas/Fort Worth Regional
Airport and Environs", prepared by the North Central Texas Council of
Governments in 1971. The following excerpts concerning land use guidance
within these zones are presented for your information;
"Zone B (Middle Zone of Effect): Activities where un-
interrupted communication is essential should consider
sound exposure in design. Generally, residential
development is not considered a suitable land use,
although multi-family developments where sound control
features have been incorporated in building design
might be considered. Open air activities and outdoor
living must consider aircraft sound."
"Zone C (Zone of Greatest Effect): Such sound-
sensitive activities as schools, offices, hospitals,
churches, and other similar activities should not
locate and build in this envelope. No residential
developments of any type are recommended, regardless
of sound specifications, and all regularly occupied
structures should consider sound control in their
design."

Further, this property is affected by the Airport Zoning Ordinance of the
Dallas/Fort Worth Airport (Number 71-100). This ordinance regulates and
restricts the heights of structures in the vicinity of the Airport.
All heights specified by this ordinance are expressed in feet above mean
sea level (MSL).
In addition, it is requested that an Avigation Easement (sample attached)
on the subject property be obtained in favor of the Dallas/Fort Worth

("aircraft" being defined as any contrivance now known or hereafter invented,
used or designed for navigation of or flight in the air), by whomsoever owned or
operated, in the airspace over Owner's property, at heights above the imaginary
surfaces as established by and shown on "The Hazard Zoning Maps of the Joint
Airport Zoning Board for the Dallas-Fort Worth Regional Airport" identified and
incorporated in the Airport Zoning Ordinance of the Dallas-Fort Worth Regional
Airport, Zoning Ordinance No. 71-100, to which reference is hereby made for all
purposes and which maps are incorporated herein by reference, to an infinite
height above same. Such release shall include, but not be limited to, any
damages to Owner's described property, such as noise, vibration, fumes, dust,
fuel and lubricant particles, and all other effects from the operation of an
aircraft flight over said property, or landing at, or taking off from, or
operating at or on the Dallas-Fort Worth Regional Airport, whether such claim be
for injury or death to person or persons or damages to or taking of property.

WITNESSETH:
The above named CITY has a volunteer fire department recognized:'-by,
the Insurance Commission of the State of Texas, and has, by an order or ri~94 ~
tion of its governing body, been authorized to enter into an Agreement with` y`
COUNTY for providing for the use of the fire truck and other fire fighting
equipment of the said CITY for the purpose of fire protection to real and,_per-
sonal property located outside the boundaries of said CITY and within suth,dist-
ance as such volunteer fire department may be reasonably expected tp reach and
render service in case of fire. The CITY hereby agrees to provide s ,services.
COUNTY has appropriated a sum to be paid and distribute4 in,' nce
with the attached Exhibit "A". CITY and COUNTY be.r+eby agree What Apr An
consideration of the monies to be paid by COUNTY to-CITY in accordeftce we
plan of said Exhibit "A", the CITY shall provide, through its volunteer fire
department, fire protection services to the areas hereinabove expressed and
COUNTY shall pay, in accordance with such arrangement, for said services.
It is specifically understood by the parties hereto that the total sum
paid by COUNTY for fire protection services to the unincorporated areas of the
COUNTY shall in no event exceed the amount budgeted by COUNTY for such fire pro-
tection, which sum is, for the year 1983, One Hundred Thirty Thousand,.SX
hundred Eighty Dollars ($130,580.00). -
COUNTY shall be under no obligation with respect to providing fire
fighting equipment, or any other expenses incidental to the carrying out of this
Contract, and shall have no right, title, or interest in and to the fire fighting
equipment belonging to said CITY.
For purposes of determining the payments due under this Contract, this.
Contract shall be in full force and effect for and during the period beginning
December 1, 1982, and ending November 30, 1983, that being the period for which
a
payments shall be made from the 1983 County budget, as per the schedule provided
in the attached Exhibit "A". For response purposes this Agreement shall remain
in force until the 1984 County budget is approved by the Commissioners' Court',
and a new Contract is initiated retroactive to December 1, 1983.
The funds to be paid by COUNTY for use of the fire fighting equipment
and service by the fire department of such CITY for fighting fires outside the,
limits of said CITY shall be paid out of the general fund of Tarrant County, and
shall be paid to the above-named incorporated CITY as hereinabove provided.
Whenever the CITY or fire department above is responding to a call out-
side the city limits of' the CITY or the normal jurisdictional limits of the, fire
department, as the case may be, it shall operate under the fire code which is in
effect within the, city limits of such CITY or fire department.
Any fire marshal, investigator, or other personnel who respond from
Tarrant County to a fire scene which is under the control of the CITY or the, fire
department named herein, whether within or without the city limits, shall' be
governed by the fire code of the CITY witnin whose limits the fire department
normally operates.
The parties hereto further agree that the COUNTY will pay to Cx Y fv
emergency ambulance service within the limits herein set forth. The COUNTY has,
for the year 1983, budgeted the sum of Twenty-Four Thousand, Seven Hundred Fifty
Dollars ($24,750.00) for such ambulance service to the unincorporated areas of
Tarrant County which sum shall be paid to the participating CITY on a per response
fractional basis. Emergency ambulance responses entitled to reimbursement under
this Contract shall consist of those responses made to calls for emergency ambul-
ance service to the CITY as well as responses to fire department emergency calls
which result in the ambulance or rescue unit being utilized to make any emergency
ambulance run to a hospital or a clinic for the purpose- of transporting a person
in need of medical attention.
The payment provided for in connection with fire responses and emergency
ambulance service shall be in accordance with rules and reporting requirements pro-
mulgated by the Tarrant County Fire Marshal and shall be limited to those fire
responses and emergency ambulance service calls that are certified to as being
qualifying by the appropriate police department, fire department, or sheriff's
department personnel.

The distribution or allocation of the funds:.budgeted,,by
the County of Tarrant for fire protection An the unincorporated
areas of the County shall be calculated or determined as~follows:
From the total sum budgeted by Tarrant County for
unincorporated area fire protection shall first be deducted the
sum of the payments made equal to 2.2% of said County budget which
is to be paid to the five (5) unincorporated area volunteer fire
depeiztments immediately upon the execution of this contract.
The total sum budgeted by County shall be divided by the
:
total number of fire responses made by all contracting fire
departments to determine the per response allocation chargeable
against the unincorporated area volunteer fire departments
receiving lump sum payments. This per response allocation shall
then be divided into the lump sum payment to determine the number
of calls made by unincorporated volunteer fire departments which
are covered by the lump sum payment, before such unincorporated,
volunteer fire departments are entitled to share in the -balaPca1'.,: f
the County's budgeted amount.
The balance, after deduction of the total of the. l.umg
sum payments paid to the unincorporated volunteer fire
departments, remaining of the total sum budgeted by the County
shall then be divided by the total number of unincorporated area
fire responses made by departments not receiving lump sum payments

volunteer fire departments, 5x (2.2% of A);
A-B=C Balance remaining to be distributed upon a per response
basis to all participating fire departments;
