Councilperson Bone announced that the new IBM Computer is to be delivered on January 15,1983. A discussion was held concerning DISANNEXA- the request for disannexation of the TION Oak Hills Mobile Home Park. Records REQUEST show the property was annexed into OAK HILLS Southlake in 1970 MOBILE under Ordinance No. 175 and Ordinance HOME PAR] No. 180. The petition for dis- annexation was presented to the City Secretary on November 10,1982, by Attorney, Scott Keesham, represent- ing the property owners of the mobile home park. During the discussion, it was established that.the mobile home park is currently served with police and fire protection from the City of Southlake. The owner, Margaret Robertson, was not present but was represented by Greg Moffet. During the public hearing the follow- ing persons commented: Marty Cloin, representing Gulf Oil Corporation, Ann Flannegan, Gerald Thompson. Screening of the property was discusse . Latta moved to approve the .4126 acre tract of land to Light Industrial Zoning District subject to the incorp- oration of a privacy screening to protect adjacent property owners. Motion died for lack of a second. Westerholm made a motion to approve the zoning request subject to access on FM1709 only. Motion died for lack of a second. Bone made the motion to approve ZA 82-43 based upon the commitment made by the applicant. The motion died for lack of a second. A representative from Spectrum Planning Inc., Robert Donahue was present and approached Council on the possibility of placing a Micro Wave Relay Station on the same property as the City water tower, whic if purchased, will be the Ragan Property. He informed Council that his Company is a subsidiary of the Times Mirror Company out of Los Angeles, California. The tower will be less than 200' and will have a 10' dish on top of the tower. Council ask questions of Mr. Donahue, who in turn agreed to present a pro- posal to Council as soon as possible. McCombs x Bone x Resolution 83-1 was approved which RESOLUTION will serve as an indorsement on the AP83-1 PROVED part of the City of Southlake, requesting FM1709 be upgraded from Keller to State Highway 114. The Resolution which is the same as one presented from the City of Keller. Latta stated that there is only 1/10 of.the funds available at the State level that is currently needed for street repairs. Campbell: I am enclosing a copy of the recorded Deed Restrictions requiring underground utilities in Dove Estates. ;,s you know the hocneo~.vner3 in DGva Es'Lat_s Joint Venture vehemently oppose any above ground utilities i n the subdivision. The City of Southlake has had calls from at least six to eight homeowners opposing any type of above ground utilities. My understanding from the City of Southlake is you did not get permission from the Mayor to do such but he simply stated that he didn't care. One of the builders in the subdivision who is under contract for ten lots is also a licensed electrician. He assures me that the breaks and underground electrical lines can be found by using a resistance type method to locate and repair the breaks. We certainly have no objection to you digging up any of your easements or coming on the property to repair this thing. In fact, as of today, I am drawing contracts in excess of twenty lots to be developed the first part of next year. I feel sure any investment you make in repairing the underground utilities will rapidly be repaid by the new construction in the area. I also received a phone call last night of another builder wanting to close on another six to eight lots before the beginning of the year which would bring the total somewhere between 28 and 30 lots to be closed and built on in the first quarter of 1983. Of course, all these builders want and expect underground utilities from Tri-County. -1- r Mr. Campbell Page 2 December 28, 1982 You expressed a concern as to the development time of the first developer. As you can see by the number of. contracts which I will be happy to copy to hear your counsel, we are moving forward at a very rapid pace and hope to have the entire subdivision developed within a two year period, if not sooner. If you do not wish to go along with the Deed Restrictions as enclosed, I would only have two alternatives: 1. A lawsuit wherein substantial damages could be shown for damages to trees as well as lost of sale lots. 2. Perhaps contracting with Texas Power and Light and having you release your easements to them. obviously we would prefer to stay with you and work with you in every manner possible to an expedient development and conclusion of this problem. Please notify me or have your attorney or your superior notify me of your decision as soon as possible so that we may take appropriate action. Thank you for your time and consideration.
