EXECUTIVE
SUMMARY: Michael and Kate Douglas are requesting a Variance to Zoning Ord. No. 480, Section
14.5.d, as amended, requiring a rear yard of not less than 35', provided that the lot is
fronting on a cul-de-sac, on property described as Lot 9, Block 2, Cambridge Place
Phase I and located at 703 Chaucer Ct, Southlake, Tarrant County, Texas. Current
Zoning: "SF-20A" Single Family Residential District. SPIN Neighborhood #8.
REQUEST: The purpose of this request is to seek approval for a Variance to Ordinance No. 480,
as amended, Section 14.5.d requiring a rear yard of not less than 35', provided that
the lot is fronting on a cul-de-sac, to add a cabana that will be attached to the principal
structure. The request is a reduction of the setback from 35' to 11' from the property
boundary. The existing pergola structure was constructed around 2003 (based on
aerial photography) and is approximately 25' from the property line.

HISTORY:
• The property was annexed in 1956 (Ordinance No. 45).
• Final Plat (ZA95-123) for Cambridge Place was filed in May 1996.
• A building permit for new residential home was granted in February
1997.
• A pool permit was issued in 2002.
WATER & SEWER: The property is served by a 6" water line in Chaucer Ct. and a 6" sewer line to
the west of the property.
STAFF COMMENTS: The application and exhibits are provided in this Staff Report.
To authorize in specific cases variances from the terms of this ordinance as
will not be contrary to the public interest, where due to special conditions, a
literal enforcement of the provisions of this ordinance would result in
unnecessary hardship and where the spirit of the ordinance is observed and
substantial justice is done. A variance shall not be granted by the Board of
Adjustment except in accordance with the following:
1) That special conditions and circumstances exist which are peculiar
to the land, structure, or building involved and which are not
applicable to other lands, structures, or buildings in the same
district;
2) That literal interpretation of the provisions of this ordinance would
deprive the applicant of rights commonly enjoyed by other
properties in the same district under the terms of this ordinance;
3) That the special conditions and circumstances do not result from
the actions of the applicant;
4) That granting of the variance requested will not confer on the
applicant any special privilege that is denied by this ordinance to
other lands, structures, or buildings in the same district.
