EXECUTIVE
SUMMARY: Michael Morrell, on behalf of Matthew and Linda Feldman, are requesting a Special
Exception Use to Zoning Ord. No. 480, Section 44.12(6), as amended, for a reduction
in the required setback from property lines for a residential accessory building on
property described as Lot 2R, Block C, Lakewood Ridge Addition and located 4383
Soda Ridge Rd., Southlake, Denton County, Texas. Current Zoning: "SF-1 A" Single
Family Residential District. SPIN Neighborhood #1.
REQUEST: The purpose of this request is to seek approval for a Special Exception Use to reduce
the required 40-foot rear yard setback for a residential accessory building over 500
square feet in the "SF-1 A" zoning district. The property owners are planning to build a
1,080 square foot barn with a covered porch 10 feet from the rear yard property line.
The enclosed area is 720 square feet, and the covered porch is approximately 360
square feet.

HISTORY:
• The property was annexed in 1988 (Ordinance No. 432) and zoned
"SF-1A" with the adoption of Zoning Ordinance No. 480 in 1989.
• A building permit for new residential home was granted in October
1993.
• An Amended Plat (ZA07-166) was approved in December 2007 and
filed in March 2008.
WATER & SEWER: The property is served by an 8" water line in Soda Ridge Rd. City sewer is not
available to the property. The existing home uses a septic system.
STAFF COMMENTS: The application and exhibits are provided in this Staff Report.
The requirements for Special Exception Use Permit for a reduction in the
required setback from property lines for an accessory structure in Zoning Ord.
480, Section 44.12(6) are below:
1) No special exception shall be granted unless the Board finds that the
requested exception is specifically permitted by the zoning ordinance;
2) That the location of the proposed activities and improvements is
clearly defined on the concept plan or plot plan, and
3) That the special exception is wholly compatible with the use and
permitted development of adjacent properties either as filed or subject
to such limitations and requirements as the board deems to be
necessary to protect adjacent properties.

Reason for Application:
There is one location on our property that would allow for a 40-foot setback and at that location
the structure would be uncomfortably close to the house and block the view we have of the rest
of our property. Allowing the structure to be closer to the property line is practical and better fits
the aesthetic of the neighborhood as our surrounding neighbors have accessory buidings that
are within a 10 foot setback.
EXPIRATION OF GRANTED REQUEST.
ZONING BOARD OF ADJUSTMENT RULES OF PROCEDURE, Section 7.1
Any special exception or variance granted or authorized by the Board shall authorize the issuance of a
building permit and/or a Certificate of Occupancy, as the case may be, for a period of one year from the
date of the favorable action of the Board unless said Board shall have in its action approved a different
period of time and has so shown such specific period of time in the minutes of its action. If the building
permit and/or Certificate of Occupancy shall not have been applied for within said one year period or
such extended period as the Board may have specifically granted, then the special exception or
variance shall be deemed to have been waived and all rights thereunder terminated. All applications
for a request which have been denied shall be deemed to be denied with prejudice unless stated
otherwise in the Board's written decision.
