INVOCATION: Bruce McCombs The Special City Council meeting was called to order by Mayor Pro Tem, Johnny Westerholm, as Mayor Latta is in the hospital. Ordinance No. 299 was approved, ORD. NO. McCombs x X setting the tax rate at .1810 per 299 Eubanks x X 100% valuation. TAX RATE The break down is: Bone X Debt Service .0380 General Fund .1430 There were no comments during the public hearing. Ordinance No. 300 was approved, ORD. NO. McCombs x which will adopt the Fiscal Year 300 Eubanks x x 1985 Budget. FY85 Bone x x BUDGET Ordinance No. 301, setting the new ORD. NO. McCombs x water rate schedule was approved. 301 Eubanks x x The new water rates will go into WATER Bone x x effect October 1. The schedule RATES is made apart of the minutes. Revenue Sharing funds for Entitle- REVENUE ment Periods 14 & 15 was discussed. SHARING A public hearing was held to comply FUNDS with the revenue sharing requirements, however, there were no comments from the audience. As suggested at the previous city council meeting, a fire attach truck was recommended by city council members. Bone x x With no further business, the meet- ing was adjourned. i ATTEST: J City Secretary ORDINANCE NO. 300 AN ORDINANCE ADOPTING THE REGULAR BUDGET FOR THE CITY OF SOUTHLAKE FOR THE FISCAL PERIOD OCTOBER 1, 1984, THROUGH SEPTMEBER 30, 1985; PROVIDING FOR INVESTMENT OF IDLE FUNDS; AND DECLARING AN EMERGENCY. WHEREAS, in accordance with Articles 689a-13, 689a-14 and 689a-15 of the Revised Civil Statutes of Texas, the Mayor of the City of Southlake, Texas, has, at least 30 days prior to the beginning of the 1984-1985 budget year submitted to the City Council a budget, at which time the Council determined that a public hearing should be held at a time and place which was set forth in a public notice published at least seven days prior to said hearing; and WHEREAS, such public hearing on the budget was duly held and all interested persons given an opportunity to be heard for or against any item therein; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Sec. 1 THAT the regular budget for the City of Southlake, Texas, for the fiscal period beginning October 1, 1984, and ending September 30, 1985, in words and figures as shown therein is adopted and approved as filed herewith. Sec. 2 THAT the Mayor or his designate be and is hereby authorized to invest any funds not needed for current use in any lawful manner. Interest accrued from investments shall be deposited to the interest income account of the funds from which the principal was invested. Sec. 3 THAT this Ordinance is hereby declared to be an emergency measure which shall have and take effect from and after its present reading for the reasons that the fiscal year commences October 1, 1984 and fixing the rate and levy of taxes for the 1984 must be had prior to October 1, 1984, and after approval and adoption of this Budget; it is for the immediate preservation of public property and business, and provides for the daily operations of all municipal departments and lays a predicate for the appropriation of money to defray current and other expenses. AND IT IS SO ORDERED. Smith City Attorney It ORDINANCE NO. 301 AN ORDINANCE AMENDING THE EXISTING WATER RATES OF THE CITY OF SOUTHLAKE, TEXAS TO INCREASE WATER RATES, ESTABLISH A DISTINCTION IN RATES BETWEEN RESIDENTIAL AND COMMERCIAL USERS, ESTABLISH ELDERLY/HARDSHIP RATES FOR RESIDENTIAL USERS, DECLARING AN EMERGENCY AND DECLARING AN EFFECTIVE DATE. WHEREAS, the , City Council is committed to the principal of establishing water rates adequate to pay the costs of such services, including both operating costs and debt services; and, WHEREAS, operating costs have increased due to increased costs for power, personnel, materials, and treated water from Southlake's wells and from the City of Fort Worth; and, WHEREAS, the additional debt service will be incurred in the immediate future due to the installation of major capital improvements to the water supply system of the City of Southlake; and, WHEREAS, the City Council is of the opinion that the rates hereinafter set out are adequate to meet the financial needs of the City with respect to providing water service; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Sec. 1 The following rate schedule is hereby adopted for water rates for Residential and Commercial Subscribers to the Southlake Municipal Water System, effective October 1, 1984, and continuing in effect until otherwise amended: RESIDENTIAL SUBSCRIBERS: I. Subscribers living within the corporate limits of the City of Southlake: A. Standard Rate: lst 2,000 gallons used -------$18.00 Each 1,000 gallons or any portion thereof in excess of 2000 gallons used ----------$2.25 B. Elderly/Hardship Rate: 1st 2,000 gallons -------------$9.00 Per 1,000 gallons over 2,000 --$2.25 II. Subscribers living outside of the corporate city limits of the City of Southlake, Texas but within the service area of the Southlake Municipal Water System: A. Standard Rate: 1st 2,000 gallons ------------$24.00 Per 1,000 gallons over 2,000 -$2.25 COMMERCIAL RATE: I. Standard Rate for all Commercial Subscribers: A. Minimum Rate regardless of usage based upon meter size: 1" for 1st 3,000 gallons 31.50 1 1/2" " It 5,000 It 52.00 2" " " 7,000 If 72.50 3" if 11 10,000 11 104.00 4" 12,000 124.50 6" " 15,000 156.00 8" of 18,000 187.50 Per 1,000 gallons over minimum 2.25 B. All usage in excess of amount set forth for minimum rate shall be charged at the rate of $2.25 per 1,000 gallons, or any portion thereof, used. Sec.2 There is hereby established a minimum usage rate category to be known as "Elderly/Hardship Rate" which shall be defined to be a subscriber who is 65 years of age or over and the household to which the water is furnished has a household income of less than 2000 of the Federal Poverty Guidelines for the month during which such water is furnished. Such "Elderly/Hardship Rate" shall be the rate set forth therefore in Section 1 above and a subscriber shall be eligible therefore as follows: A. It is the burden of the subscriber to notify the Southlake Municipal Water Department of the eligibility fo the subscriber for such special rate treatment. B. The Subscriber shall furnish the Southlake Municipal Water Department with acceptable documentation and proof of income of the subscriber and any working member of the household to which such water is supplied. C. The subscriber shall provide updated financial income of the subscriber and other income earning adults of the household to which the water is furnished, on an annual basis or more frequently if requested, to verify eligibility for such special rate treatment. D. Subscribers and households qualifying for the special "Elderly/Hardship Rate" shall be entitled to have such special rate applied to their water rate charges beginning thirty (30) days after the application and documentation of income have been furnished as set forth hereinabove and accepted by the Southlake Municipal Water Department. E. At any time that it is determined that a subscriber or household is no longer eligible for the "Elderly/Hardship Rate", such special rate treatment shall cease immediately. Sec. 3 ALL Ordinances or parts of Ordinances in conflict herewith are hereby repeated. Sec. 4 WHEREAS, the financial integrity of the Southlake Municipal Water System requires the immediate passage of this ordinance increasing water rates to provide adequate revenues, therefore an emergency exists requiring immediate passage of this Ordinance to place such new rates into effect by October 1, 1984. Sec. 5 IF any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto to any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Passed, approved and adopted by the affirmative vote of the City Council of the City of Southlake, Texas, this 27 day of September, 1984 by a vote of yeas to nays and abstaining. Smith City Attorney ORDINANCE NO. 299 AN ORDINANCE LEVYING TAXES FOR THE YEAR 1984 TO BE ASSESSED ON ALL TAXABLE PROPERTY WITHIN THE LIMITS OF THE CITY OF SOUTHLAKE, TEXAS, AND DECLARING AN EMERGENCY. WHEREAS, all notices required by law prerequisite to the establishment of the tax rate for the City of Southlake have heretofore been published and public hearings held and the budget established in the amount to be so raised has been passed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: Sec. 1. THAT there shall be and there is hereby levied the following taxes on each One Hundred Dollars ($100.00) of valuation on all taxable property within the City of Southlake, Texas, to be assessed and collected by the Tax Assessor/Collector for the year 1984 for the purposes hereinafter stipulated, to-wit: (a) For the general fund levied on the $100.00 valuation: $.143 (b) For the debt service fund levied on the $100.00 valuation: $.038 Total levy: $.181 Sec. 2 The necessity of adopting this tax levy prior to the beginning of the budget year so as to enable the City to collect taxes, creates an emergency making it unnecessary to read and consider this ordinance more than one time, and this ordinance shall become effective immediately upon passage.
