Agenda Item No. 2. Administrative Comments: There are no items this agenda.
Agenda Item No 3A Consent: Approval of the minutes from the October 23, 2007
Southlake Arts Council meeting -- If you have corrections to either meeting
minutes, please let Administrative Secretary Nancy Roper know in advance or
make it part of the motion for consideration. Nancy can be reached via e-mail at

3. Agenda Item No. 4. PUBLIC FORUM: This is the public's opportunity to address
the Council about non -agenda items. During this proceeding it is important that the
council not deliberate (discuss among yourselves) or take action on any item
brought up at this time. The councils' options during this topic are 1) to listen; 2)
ask questions and respond to the presenter only; 3) request staff to look into the
issue and report back to the council; and/or 4) request that the chair put the item
on a future agenda for the council to discuss or consider.
4. Agenda Item No 5A Consider: Recommendation on 2008 Community Service
Agreement with Apex Arts League — The Apex Arts League is a non-profit agency
seeking to enhance community awareness, participation, and appreciation of the
arts in the north central region of the Dallas/Fort Worth Metroplex. One of their
main objectives is to provide a venue for all performing and visual arts in the
region. The Apex Arts League seeks to secure funding, support, and partnerships
for this and other endeavors through local organizations, community groups, and
private businesses. The proposed agreement substantially contains the same
language and provisions as the 2007 agreement. The Apex Arts League has
requested funding of $5,000 for 2008 for services rendered to the community as a
part of these efforts, which is the same level of funding as the previous year.
Funding for this request is included in the approved FY 2008 budget.
5. Agenda Item No 5B Consider: Recommendation on 2008 Community Service
Agreement with ARTSNET — ARTSNET is a non-profit agency. For the past 25
years, ARTSNET in conjunction with the cities of North Tarrant County, has been
presenting visual and performing arts concerts through its Masterworks series free
and open to the public. Presenting local, national and international artists as well
as new emerging artists. As part of the proposed agreement, funding in the amount
of $23,400 will be paid to ARTSNET for support of the community calendar and

providing a minimum of fourteen Masterworks programs for the Recreation and
Library Divisions within the Community Services Department of The City of
Southlake. Funding is available in the approved FY 2008 motel occupancy tax for
this proposed expenditure.
6. Agenda Item No. 6A. Discussion: Art Work for City Roundabouts — This item is
placed on the agenda for the review and discussion of potential artwork concepts
to be incorporated in the roundabouts at Continental/South Carroll and
Continental/White Chapel.
7. Agenda Item No. 613. Discussion: FY 2008 Public Art Proiects — This item is placed
on the agenda to allow for continued discussion of potential locations for the
incorporation of public art in FY 2008.
Agenda Item No. 6C. Discussion: Public Arts Master Plan — This is a standing item
on the agenda for 2007-08 to allow for input, discussion and review of the on -going
development of a Public Arts Master Plan.

22 Agenda Item No. 1, Call to Order.-- Vice Chair Peggy Firestone called the meeting to
23 order at 6:11 p.m.

27 Agenda Item No. 2 — Administrative Comments.

29 A. Southlake Stampede Update — The now defunct Public Art Advisory Committee
30 assisted with the Southlake Stampede. The Longhorns are placed around town.
31 All of the Longhorns and calves are complete. Local artists decorated the steers
32 and the art was sponsored locally. After the steers and calves have been on
33 display of for one year, the art goes to an auction. The sponsor did have the
34 opportunity to reserve the artwork so it doesn't go to auction. The first auction is
35 scheduled this Saturday in Las Colinas for Altrusa DFW. Fifty percent of the
36 proceeds go to the charity and fifty percent go to Public Arts. This money will be
37 managed by the Southlake Arts Council. Auctions are planned for Metroport
38 Meals on Wheels, Metroport Rotary and Friends of the Southlake Library. There
39 will be one online E-Bay auction. The City is planning on keeping a few of the
40 steers to be placed in Town Square and some of the other parks in town.

Mr. Walter made a motion to approve the minutes. Ms. Messing seconded it and the
minutes were approved unanimously.
REGULAR AGENDA:
Agenda Item No. 4 - Public Forum.
Vice Chair Firestone opened and closed the public forum as there was no one to speak.
10 Agenda Item No. 5A Discussion — Art Work for City Roundabouts.

12 The Public Works Department will be installing 5 more roundabouts in addition to the
13 one at Continental and South Carroll over the next 5-10 years. This year the Arts
14 Council will concentrate on two roundabouts — the existing one and the one that will be
15 started in December 2007 at Continental and White Chapel. There is $60,000 per
16 roundabout set aside for the art and the installation of the art including lighting. As a
17 result of the 2025 Plan, Southlake is currently undertaking their detailed Urban Design
18 Study. This study is for the development of a median plan along side FM 1709, State
19 Highway 114 and Davis Boulevard. The purpose of the study is to create a unique and
20 attractive character for Southlake and enhance the City's visual quality. The scope will
21 include the City's three main roadway corridors and specifically roundabout design
22 concepts. The City Council wants a timeless and classic look. Mr. Tribble showed some
23 slides with the timeless and classic look that were included in the Urban Design Study
24 presented to the City Council and other Boards (P&Z, SPCD). These ideas have been
25 under review over the last six to eight months. The City Council wants the feel of a
26 vertical identity at the gateways to the City, whether it be FM 1709, Carroll Avenue,
27 Kimball Avenue, etc. They want people to feel that they have entered and arrived at a
28 unique place. Mr. Tribble explained the slides in more detail. The Arts Council members
29 asked questions and discussed the issues. Mr. Tribble stated that we don't want the art
30 to draw people to take a closer look, but to enhance the experience of the roundabout.
31 Mr. Tribble posed the question asking the members if they wanted a theme for all of the
32 roundabouts or to have grander art towards the center of the City and lesser towards
33 the fringes. Another idea presented is to have the art reflect a theme for any unique
34 location, for instance, an educational theme near Carroll ISD. More discussion by the
35 members ensued concerning style, themes, looks, artists and narrowing the focus of the
36 search. The Arts Council needs to tie in this work with the Urban Design Study. The Arts
37 Council and Mr. McGeath will research websites and email them to Mr. Tribble and Mr.
38 McGeath for the next meeting as well as what Mr. Tribble can find from past
39 presentations. The Arts Council needs to make a recommendation to the City Council in
40 nine months, which means that a decision needs to be made in eight months.

42 Agenda Item No 5B Discussion — Public Art Initiative

44 Mr. Tribble discussed the funding for Public Art. The City began collecting hotel
45 occupancy tax from the Hilton. $50,000 is set aside by the City Council to provide art for
46 the City during this fiscal year. It must be spent by the end of September 2008. For the

next fiscal year (2008-2009), the amount is undetermined as the City Council makes
this decision on a year-to-year basis. The Arts Council was reminded that fifty percent of
the proceeds from the sale of the Stampede Art will go to fund art. Mr. Tribble named
some possible locations (various parks), areas from the Urban Design Study and near
the log cabin that will be constructed in Bicentennial Park for the placement of the art.
Mr. Walter was interested in having art in McPherson Park near the Hilton. The rest of
the Arts Council was enthusiastic about targeting this park. Mr. Tribble will check to see
what line items are in the City and CIP budgets for art. He will also check the Master
Plan to find out the wording concerning art purchases. His understanding was that there
is a goal to try to provide one percent of the construction budget for art. Mr. Tribble
suggested staff write down some guidelines to become a discussion item for the next
meeting. Although there is a possibility of getting an outside consultant, Mr. Tribble feels
that the Arts Council has the expertise to go forward without a consultant. He proposes
the where and what in one document. The Parks Board will be contacted when a
placement decision is made for a particular park. Although the Arts Council decides
what the art will be, the Parks Board will decide where it will be placed. Once those
decisions have been finalized, then the information will be presented before City Council
for approval. Mr. Tribble will present a draft document for the next meeting.

THIS AGREEMENT is entered into by and between the City of Southlake, Texas,
a home rule municipal corporation located in Tarrant County and Denton County,
Texas, acting by and through its duly authorized Mayor (hereinafter referred to as
"City"), and Apex Arts League ("AAL"), a nonprofit organization operating in the City of
Southlake as an organization described in section 501(c)(3) of the Internal Revenue
Code, acting by and through its duly authorized Chairman.
WHEREAS, the purpose of AAL is to enhance community awareness,
participation and appreciation of the arts in the north central region of the Dallas / Fort
Worth Metroplex; and,
WHEREAS, AAL seeks to provide quality cultural, civic and educational
programs in a regional home for the arts; and,
WHEREAS, City and AAL desire to enter into an Agreement whereby AAL will
promote and provide educational arts to the citizens of Southlake;
NOW, THEREFORE, City and AAL do hereby covenant and agree as follows:
SECTION 1
SCOPE OF SERVICES
AAL shall work to provide the following services:
1. Create a regional focal point for the arts.
2. Enhance community awareness and appreciation for the arts.
3. Provide a meeting facility for civic and community groups.
4. Create a home for area arts groups offering space and support.
5. Provide a venue for all performing and visual arts in the region through efforts to
secure support, funding, and partnerships with various organizations, community
groups, and private businesses.
6. Promote educational instruction in the arts for all ages.

SECTION 2
AAL FUNCTIONS
1. AAL Board of Directors shall meet periodically. The time, date, place, and
agenda of these meetings shall be solely defined by AAL. The City liaison shall
be apprised of all board meetings, and the liaison may participate at all
scheduled meetings.
2. AAL shall operate in accordance with its own approved by-laws.
3. Administration of the educational art programs shall be coordinated by AAL.
4. The City shall have the right to review the books and records kept incident to the
services provided by AAL to the City.
SECTION 3
CITY FUNCTIONS
1. A liaison will be provided by the City to assist AAL in coordinating AAL and City
operations. The City liaison shall be apprised of all board meetings of AAL, and
the liaison may participate at all scheduled meetings.
2. City shall provide staff assistance, advice, and technical expertise where feasible
to aid AAL in advertising programs and processing of applications and fees for
classes. The nature, extent, and duration of such assistance shall be defined
solely by the City.
3. City shall provide administrative support to AAL, where feasible for such AAL
projects as: research for future facility, grants research, fundraising events or
other mutually agreed upon events/programs. The nature, extent, and duration of
this support shall be solely defined by the City.
4. The City, in accordance with current policies and guidelines, shall provide a
meeting space for AAL Board of Directors meetings.
5. The City, in accordance with current policies and guidelines, shall provide at no
cost to AAL the use of City facilities for events directly related to AAL including
educational programs involving AAL partner organizations. Requests for use of
City Buildings shall follow current reservation procedures.
SECTION 4
PAYMENT FOR SERVICES
City agrees to pay to AAL the sum of Five Thousand ($5,000) Dollars in payment for
services described in Section 1 to promote awareness, participation and appreciation of
the arts in the north central region of the Dallas / Fort Worth Metroplex and seek to
provide a venue for the future enjoyment of such arts for the period from the effective
date of signing until December 31, 2008. In this Agreement, "effective date of signing"
is the date the Agreement is executed by both parties.

SECTION 5
TERM OF AGREEMENT
1. The term of this agreement shall be for a period beginning January 1, 2008 and
ending December 31, 2008. This agreement may be renewed for up to three
successive one year periods beginning on January 1 and ending on December
31 of each year upon written agreement of both parties. Execution of the 2008
Agreement constitutes the first successive, one-year renewal period upon written
agreement of both parties.
2. Either party may terminate this Agreement upon 30 days written notice to the
other party. Upon termination, or if AAL ceases to provide services under this
Agreement, AAL shall return any unexpended funds paid pursuant to this
Agreement.
SECTION 6
INDEPENDENT CONTRACTOR
In performing the services hereunder, AAL is acting as an independent contractor, and
shall not be deemed an employee, agent or partner of the City. Neither party shall have
the authority to make binding representations or agreements on behalf of the other.
SECTION 7
NO WAIVER OF GOVERNMENTAL IMMUNITY
Notwithstanding any provision of this Agreement to the contrary, nothing
contained in this agreement shall be construed to limit or waive any governmental or
sovereign immunity of the City, or any immunity applicable to its officers, agents,
servants or employees.

Information: ARTSNET supports every aspect of artistic expression - from
painting and sculpture, to music, theatre, dance, and writing.
Whether you're an active participant or just actively involved in the
appreciation of the arts, for more than 30 years, ARTSNET has
accomplished its mission by providing grants, information, and
assistance to artists, arts organizations and the general public.
ARTSNET continues to look for innovative ways to encourage,
support and facilitate artistic cultural opportunities within the
communities of North Tarrant County.

THIS AGREEMENT is entered into by and between the City of Southlake, Texas,

as "City"), and the Arts Council of Northeast Tarrant County (ARTSNET), an
organization described in section 501(c)3 of the Internal Revenue Code, acting by and
through its duly authorized Executive Director (hereinafter referred to as "ARTSNET').
WHEREAS, the purpose of ARTSNET is to encourage, support and facilitate the
promotion of artistic cultural opportunities within the community; and
WHEREAS, the City of Southlake actively participates through partnerships and
program support of various art related activities to include ARTSNET and the
MasterWorks Music Series, Art in the Square, the APEX Arts League and the
Southlake Stampede program; and
WHEREAS, City and ARTSNET desire to enter into an Agreement whereby
ARTSNET will provide art related services to citizens of Southlake and others as
referred by City;
NOW, THEREFORE, KNOW ALL BY THESE PRESENTS: That City and
ARTSNET do hereby covenant and agree as follows:
SECTION 1
SCOPE OF SERVICES
ARTSNET shall provide the following services:
1. Assistance provided by ARTSNET for arts related projects and programs
to other non-profit organizations, arts organizations, schools, and
municipalities.
2. Provide summer art programs for youth in the area.
3. Provide a monthly event calendar with information pertinent to the citizens
of Southlake.
4. Provide a quarterly newsletter available to people in the area.
5. Make available various "arts" classes such as guitar, voice, piano, pottery,
painting, etc.
6. Provide citizens access and opportunity to participate in the arts, support
community cultural events, and provide educational programs to both
children and adults in the community.
7. Perform concert events, free to the public, between January 1, 2008 and
December 31, 2008. Proposed events include:

4 Winter MasterWorks Concert Series in the Library

8. Scheduling of concerts and make-up concerts, if necessary, will be by
agreement of the City Community Services Director and ARTSNET.
SECTION 2
ARTSNET'S OPERATIONS
1. Hours of Operations shall be solely defined by ARTSNET.
2. The City shall have the right to review the books and records kept incident
to the services provided by ARTSNET to the City.
SECTION 3
PAYMENT FOR SERVICES
City agrees to pay to ARTSNET the sum of TWENTY-THREE THOUSAND FOUR
HUNDRED ($23,400) Dollars in payment for services described in Section 1
hereinabove.
SECTION 4
The term of this agreement shall be for a period of one (1) year beginning January 1,
2008 and ending December 31, 2008.
