Subject: Approve an Encroachment and Joint Use Agreement for a
retaining wall and sport court located within a drainage
easement at 1112 Linnea Lane.
Action
Requested: Approve an Encroachment and Joint Use Agreement for a retaining
wall and sport court located within a drainage easement at 1112
Linnea Lane.
Background
Information: The purpose of this item is to seek City Council approval of an
Encroachment and Joint Use Agreement for a retaining wall and
sport court located within a 35' drainage easement. This agreement
will allow the developer to place a retaining wall and sport court within
the easement along the south side of the property. There are no City
utilities or infrastructures within this easement.
The drainage easement was dedicated to allow for cross lot drainage
and the proposed retaining wall and sport court will not impede the
drainage flow from the neighboring property to the south. Based on
site observations and the drainage memo by Bellagio Design and
Construction, the existing drainage swale along the south of the
property will remain and will continue to allow drainage to flow from
the west to east toward the existing drainage inlet at the front of the
property.
Financial
Considerations: This is a no cost agreement.
