Subject: Approve an Encroachment and Joint Use Agreement for a
retaining wall located within a drainage and utility easement at
213 Eastwood Drive.
Action
Requested: Approve an Encroachment and Joint Use Agreement for a retaining
wall located within a drainage and utility easement at 213 Eastwood
Drive.
Background
Information: The purpose of this item is to seek City Council approval of an
Encroachment and Joint Use Agreement for a retaining wall located
within a 30' drainage and utility easement, with 15' being located on
213 Eastwood Drive and the other 15' being located on the
neighboring property line at 211 Eastwood Drive. The property
owner of 213 Eastwood Drive is proposing to remove the existing
retaining wall along the north property line and construct a new
retaining wall within the drainage easement along the north property
line. The existing residence was built in 1983 and is proposed to be
demolished and a new residence built. An encroachment and joint
use agreement is being requested with the new construction since
an existing encroachment agreement for the existing retaining wall
was not provided with the original construction.
This agreement will allow the developer to place a retaining wall
within the easement along the north side of the property. There are
no City utilities or infrastructures within the 15' portion of the 30'
drainage and utility easement on 213 Eastwood Drive. The drainage
and utility easement was dedicated to allow for a drainage swale and
sanitary sewer pipe within the easement. Per the grading plan
prepared by J.S. Ground Engineering, the existing drainage swale
and sanitary sewer pipe are located on the neighboring property, 211
Eastwood Drive, and are not located on 213 Eastwood Drive. The
proposed retaining wall will also be located further south into the
property than the existing retaining wall and will be located further
away from the existing drainage swale and sanitary sewer pipe.
Based on this information, the retaining wall encroachment will not

impede the drainage flow or encroach onto the sanitary sewer pipe.
The proposed retaining will also not cause adverse impacts for the
properties located along the southern end of Eastwood Drive since
the natural drainage flow is from west to east onto the neighboring
property at 400 S. Kimball Avenue.

Considerations: This is a no cost agreement.
