WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Texas Local Government Code; and,
WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the
authority to adopt a comprehensive zoning ordinance and map regulating the location and use
of buildings, other structures and land for business, industrial, residential and other purposes,
and to amend said ordinance and map for the purpose of promoting the public health, safety,
morals and general welfare, all in accordance with a comprehensive plan; and,
WHEREAS, the hereinafter described property is currently zoned as "AG" Agricultural
District under the City's Comprehensive Zoning Ordinance; and,
WHEREAS, a change in the zoning classification of said property was requested by a
person or corporation having a proprietary interest in said property; and,
WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called
by the City Council did consider the following factors in making a determination as to whether
these changes should be granted or denied: safety of the motoring public and the pedestrians
using the facilities in the area immediately surrounding the sites; safety from fire hazards and
damages; noise producing elements and glare of the vehicular and stationary lights and effect
of such lights on established character of the neighborhood; location, lighting and types of signs
and relation of signs to traffic control and adjacent property; street size and adequacy of width
for traffic reasonably expected to be generated by the proposed use around the site and in the
immediate neighborhood; adequacy of parking as determined by requirements of this
ordinance for off-street parking facilities; location of ingress and egress points for parking and
off-street loading spaces, and protection of public health by surfacing on all parking areas to
control dust, effect on the promotion of health ad the general welfare; effect on light and air;
effect on the over -crowding of the land; effect on the concentration of population, and effect on
transportation, water, sewerage, schools, parks and other public facilities; and,
WHEREAS, the City Council of the City of Southlake, Texas, further considered among
other things the character of the districts and their peculiar suitability for particular uses and the
view to conserve the value of the buildings, and encourage the most appropriate use of the
land throughout this City; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a
public necessity for the zoning changes, that the public demands them, that the public interest
clearly requires the amendments, and that the zoning changes do not unreasonably invade the
rights of those who bought or improved property with reference to the classification which
existed at the time their original investment was made; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes
in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other
dangers, promotes the health and the general welfare, provides adequate light and air,
prevents the over -crowding of land, avoids undue concentration of population, and facilitates
the adequate provision of transportation, water, sewerage, schools, parks and other public
requirements; and,
WHEREAS, the City Council of the City of Southlake, Texas, has determined that there
is a necessity and need for the changes in zoning and has also found and determined that
there has been a change in the conditions of the property surrounding and in close proximity
to the tract or tracts of land requested for a change since the tract or tracts of land were
originally classified and therefore feels that the respective changes in zoning classification for
the tract or tracts of land are needed, are called for, and are in the best interest of the public at
large, the citizens of the city of Southlake, Texas, and helps promote the general health, safety
and welfare of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake,
Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is
hereby amended so that the permitted uses in the hereinafter described areas be altered,
changed and amended as shown and described below:
Being described as portions of Tract 1A, Harrison Decker Survey Abstract 438,
and Tracts 2E04, 2E06 and a portion of Tract 2E07A, John N. Gibson Survey
Abstract 591, City of Southlake, Tarrant County, Texas and located at 1719 E.
Continental Blvd. and 1451 — 1537 Brumlow Ave and more fully and completely
described in Exhibit "A" from "AG" Agriculture District to "TZD" Transitional Zoning
District as depicted on the approved Development Plan attached hereto and
incorporated herein as Exhibit "B", and subject to the following conditions:
• Staff Report dated August 27, 2024, and subject to Development Plan Review
Summary No. 5 dated August 27, 2024.
• Noting Council will require that the applicant work with City Staff and the City
Attorney to craft a note to be placed on future plats for the residential portion
of the development, acknowledging adjacency of the intensive non-
residential industrial type use and operations, including the future municipal
service center and public safety training tower facility.
• The applicant has agreed that the design approvals for the commercial
portion of this project must remain a generally consistent design nature to
gain approval at site plan review.
• The applicant has agreed the builders cumulatively will provide a minimum of
5 architectural elevations in the residential portion of this development
(motion amended to maximum of 5 of the same architectural elevations within
the residential area).
• The applicant has agreed no lots would be delivered to builders to begin
vertical construction prior to June 4, 2026.
• Landscape Plan is approved as presented, noting that Council is granting
authority to the City's Landscape Administrator to require less installation than
is represented in the green space, if it is determined by the Landscape
Administrator that that is in the best interest of the long-term maturation and
development of this property.
• The applicant has agreed to either sod and/or seed the green space.

8/26/2024 AND WE OFFER THE FOLLOWING STIPULATIONS. THESE STIPULATIONS ARE
HEREBY MADE CONDITIONS OF SITE PLAN APPROVAL UNLESS SPECIFICALLY AMENDED BY

The Development Regulations (Zoning Booklet) need the following revisions or considerations:
Clearly designate a setback for the properties that have the 40' pipeline
easement encumbrance. Please provide a specific setback for these lots. It
should be clearly stated in as many places as possible to ensure no confusion
in the future between homeowners, permit techs, plans reviewers, etc. Also, a
note must be provided on the Development Plan and future plat per Sec.
9.6.298 of Ordinance. No. 880, as amended, stating that a pipeline crosses the
property within 100 feet. Furthermore, prior to any approval of the subdivision, a
waiver and hold harmless agreement per Sec. 9.6.299 of Ordinance. No. 880,
as amended, must be executed and recorded in the County records.
2. Setbacks should not be measured from easement edges, but rather property boundaries. Lots
24, 23, 49, and 50 should have setbacks shown correctly from the property boundary.
3. Provide a note, on the plan that sidewalks will be provided. No sidewalks are shown, though
Development Regulations require them.
4. There is no dumpster on the plan. Dumpsters may not be located in required buffer yard areas
and may not take up required parking.
5. Revise all plans to reflect the new "median island" at the north end of the development.
The following are informational comments:
A formal Site Plan application will be required at a future date for the commercial portion. See
Section 47.8 of the Zoning Ordinance for details as to the processing of Development Plans
vs. Site Plans in the "TZD" Transition Zoning District.
• A Preliminary Plat and a Final Plat must be filed for this property, and the entirety of all
properties where boundaries are amended must be part of these plats. This includes land area
outside of the proposed area of development.
• Though the "TZD" Transition Zoning District allows for flexibility, the category does provide
specific guidance for development. The following are notable applicable standards of the
Transition Zoning District regulations found in Section 47.7 that do not appear to be followed:
o The first floor elevation of single-family dwellings shall be raised a minimum of two (2)
feet above the finished level of the public sidewalk/trail in front of the residential
structures. It is unclear if the residential portion meets this requirement.
o The "TZD" District guidance states: "Cul-de-sacs are prohibited unless natural features
such as topography or stream corridors prevent a street connection." A Cul-de-sac is
shown on the plans.
o The "TZD" District provides guidance for 6' sidewalks. The applicant proposes 5'
sidewalks for the development.
o It is unknown if the commercial structures will comply with Section 47.7(b) and (c)
regarding building standards and design. Subsection (e) further states, "To ensure
compatibility of building types and to relate new buildings to the building traditions of
the region, architectural design shall be regulated, governed, and enforced through
architectural design standards proposed by the applicant. The applicant shall submit
the proposed standards as a part of the development plan application for all
development in the TZD. The Planning and Zoning Commission shall make a
recommendation and the City Council shall approve them at the time of approval of the
Development Plan. Architectural design standards for a proposed Transition Zoning
District shall: i. specify the materials and configurations permitted for walls, roofs,
openings, street furniture, and other elements; ii. be based on traditional building
precedents from the region; iii. include the following: a. architectural compatibility
among structures within the neighborhood; b. human scale design; c. pedestrian use of
the entire district; d. relationship to the street, to surrounding buildings, and to adjoining
land uses; and e. special architectural treatment of gateways/civic buildings. This is
presumed to read that the architectural components of the district are to be compatible
with each other. No specific materials are mentioned with this development plan. It is
noted that conceptual elevations are provided for the development and shall provide
guidance as to the
Tree Conservation/Landscape Review
TREE CONSERVATION COMMENTS:
* If the proposed development was straight zoning it would not comply with the Existing Tree
Cover Preservation Requirements of the Tree Preservation Ordinance. There is 12.61 % of existing
tree cover on the property and a minimum of 70% of the existing tree cover would be required to be
preserved. A minimum of 72.14% is proposed to be removed and a maximum of 27.86% is proposed
to be preserved.
* Except as provided by subsection 7.2.b. of the Tree Preservation Ordinance, a Tree
Conservation Analysis or Tree Conservation Plan shall be approved if it will preserve existing tree
cover in accordance with the percentage requirements established by Table 2.0. If the property has
previously received a tree permit related to development, the percentage of existing tree cover at the
time the first such permit was issued shall be used to calculate the minimum existing tree cover that
must be preserved under this section.

*The minimum percentage of existing tree cover to be preserved shall exclude any area in public
rights -of -way as approved by City Council.
For property sought to be zoned for the Downtown zoning district or a planned development zoning
district, including an S-P-1 Site Plan, S-P-2 Site Plan, Transition, Rural Conservation, Planned Unit
Development, or Employment Center zoning district, the City Council shall consider the application for
a Conservation Analysis or Plan in conjunction with the corresponding development application (as
established in Table 1.0). The Planning and Zoning Commission shall review the application and
make a recommendation to the City Council regarding the application. The City Council shall approve
the Plan or Analysis if the Council finds that the Plan or Analysis provides for the:
i. placement of building pads, parking areas, driveways, streets, and utility easements so as to
maximize the preservation of environmental features of the property including mature tree stands,
natural creeks and ponds, and significant grades;
ii. maximizes the preservation of tree cover preservation areas indicated on the Environmental
Resource Protection Map;
iii. maximizes the preservation of existing tree stands with the potential to buffer residential areas
from the noise, glare, and visual effects of nonresidential uses;
iv. maximizes the preservation of existing trees, if any, adjoining a natural or man-made drainage
creek;
V. maximizes the preservation of existing protected trees along rural roadways and other streets
as identified and prioritized in the Street Typology designation; and
vi. mitigation of altered trees through proposed tree replacement procedures pursuant to this
Ordinance.
Please be aware that all existing trees shown to be preserved on the City Council approved
Tree Conservation Plan must be preserved and protected during all phases and construction of the
development. Alteration or removal of any of the existing trees shown to be preserved on the
approved Tree Conservation Plan is a violation of the Tree Preservation Ordinance and the zoning as
approved by the Southlake City Council. Please ensure that the layout of all structures, easements,
utilities, structures grading, and any other structure proposed to be constructed do not conflict with
existing trees intended to be preserved.
LANDSCAPE COMMENTS:
1. The planter/planting strip width between the curb and sidewalk within the residential portion of
the proposed development is required to be a minimum six feet (6) wide in the TZD district. Street
trees are required but is flexible upon the proposed design standards.
2. Provide the interior landscape ground cover and seasonal color calculations within the Interior
Landscape Summary Chart.
3. Existing tree credits seem to be taken for preserved trees within bufferyard areas. Please
provide the proposed existing tree credits within the Bufferyards Summary Chart.
Existing tree credits shall only be granted if the tree/s are in healthy condition and all requirements of
the Tree Preservation Ordinance have been met as determined at the time of inspection for a
Permanent Certificate of Occupancy.
5. Provide at least the minimum required canopy trees for the south bufferyard adjacent to the
residential property. Correct the canopy tree calculations within the Bufferyards Summary Chart.
6. Within the office portion of the development all parking planter islands in parking areas shall
contain a minimum of one (1) canopy tree with the remaining area in shrubs, ground cover,
ornamental grasses or seasonal color. Planter islands which have light poles for lighting the parking
areas may substitute two (2) understory/accent trees for the required canopy tree.
The south bufferyard portion of the proposed office use of the development is proposed to be
a 6' — F1 bufferyard. The bufferyards regulations of the Zoning Ordinance require the minimum of a
10' — F1 bufferyard. The proposed dumpster would also be located within the required bufferyard.

Public Works/Engineering Review
GENERAL COMMENTS:
1.
Cul-de-sacs shall have a radius of 60'.
2.
Label the radius at the street intersections with Brumlow and Continental, street
centerline radius, and round -a -bout radius.
3.
Label fire lane and fire lane radius.
4.
Show and label proposed sidewalk. Sidewalk is required along Brumlow frontage and
Continental frontage.
5.
Walls within the Pipeline easement shall require approval from the pipeline company.
6.
What are the red tick marks on the Development Plan.
7.
The northeast commercial building is shown encroaching into the proposed sanitary
sewer easement along the eastern side. The southeast commercial building is also
encroaching into the utility easement. These buildings shall be relocated outside of
the easement.
8.
Public Works strongly recommends against the development of Lots 55 and 56 due to
the following:
a. Drainage concerns for both lots
b. Driveway spacing and having a private drive entering onto Continental.
c. At a minimum there needs to be a note that the driveway crossing for lot 55
will be maintained by the property owner. However, we would caution
against this due to future maintenance costs and burden on the
homeowner.
9.
Correct the fence key map to reflect a wrought iron privacy fence along the southern
boundary that adjoins to the MSC site.
10.
Verify that the driveway spacing along Brumlow to the proposed driveway for the new
MSC development meets minimum separation requirements.
11.
Please be aware that when Brumlow is expanded to full build -out, a four lane divided
roadway, there will not be a curb cut for Brumlow East, only the MSC.
A note shall be added to the plat that specifies the residents shall be made aware that the
Service Center operational hours are 24 hours, 7 days per week and the City's operations shall not be
impeded.
GRADING AND DRAINAGE:
12. Label the proposed storm drain pipe.
The drainage area map shall also include the offsite area from the north of Continental that
flows into the channel since the channel is being redefined to ensure there is adequate capacity.
The proposed drainage channels shall be located within a dedicated drainage easement.
A LOMR will be required to be approved by FEMA prior to receiving final acceptance of the
Public Works Permit as well as filing the final plat.
UTILITY
Lot 18 has two water meters shown.
The waterline serving Lots 55 and 56 shall be located within an easement
Water meters shall not be located in parking stalls.
Ensure that the required separation distance is met between water and sewer.
Ensure that the water line, fire hydrants, and water meters are located within a water
easement for the commercial development.
Fire Department Review
The required backflow protection (double check valve) for the sprinkler systems can be located on the
riser if the riser is within 100 feet of the water main, measured linearly along the length of the pipe. If
the riser is further than 100 feet from the main, the double check valve shall be in a vault.
Riser rooms shall be a minimum of 5'X5' if the double check is located in a vault, or a minimum of
6'X6' if it is located on the riser. (Label riser room location and indicate size of the riser room)
Fire apparatus access needs to be an all-weather surface, asphalt or concrete, 24 feet wide on the
commercial and residential portions as long as all structures are being protected throughout with
automatic fire suppression systems. (Minimum of 85,000 pounds GVVV). (Label the fire lanes on the
plans to ensure that the fire lane indicated on the commercial portion of the plans connects to the
residential street and meets all of the requirements for emergency access)
Fire hydrants are over spaced between the commercial and residential portions of the development,
add an additional fire hydrant near the entrance into the residential area. (Add a fire hydrant as
required)

General Informational Comments
No review of proposed signs is intended with this plan. A separate building permit is required
prior to construction of any signs.
All lighting must comply with the Lighting Ordinance No. 693, as amended.
All development must comply with the Drainage Ordinance No. 605 and the Erosion and
Sediment Control Ordinance No. 946, as amended.
All development must comply with the standards of the "TZD" Transition Zoning District unless
deviations or variances are otherwise approved as part of a Development Plan or Site Plan.
The applicant should be aware that prior to issuance of a building permit a Plat must be
processed and filed in the County Plat Records, a fully corrected site plan, landscape plan,
irrigation plan, and building plans, must be submitted for approval and all required fees must be
paid. This may include but not be limited to the following fees: Park Fee, Roadway Imapct Fee,
Water & Sewer Impact and Tap Fees, and related Permit Fees.
Note that impact fees will be levied on this project at the time of construction, if approved. No
park dedication is noted. Fees in lieu of dedication will be required. In addition to the City of
Southlake impact fees, please be aware that through the wholesale water customer contract
with the City of Fort Worth, all new water connections are required to pay the City of Fort Worth
impact fee. The City of Fort Worth impact fee assessment is based on the final plat recordation
date and building permit issuance. The applicant is encouraged to review the City of Fort Worth's
assessment and collection of Impact Fees Guide to determine the fee amount.

SECTION 2.
That the City Manager is hereby directed to correct the Official Zoning map of the City
of Southlake, Texas, to reflect the herein changes in zoning.
SECTION 3.
That in all other respects the use of the tract or tracts of land herein above described
shall be subject to all the applicable regulations contained in said Zoning Ordinance and all
other applicable and pertinent ordinances for the City of Southlake, Texas. All existing
sections, subsections, paragraphs, sentences, words, phrases and definitions of said Zoning
Ordinance are not amended hereby, but remain intact and are hereby ratified, verified, and
affirmed.
SECTION 4.
That the zoning regulations and districts as herein established have been made in
accordance with the comprehensive plan for the purpose of promoting the health, safety,
morals and the general welfare of the community. They have been designed, with respect to
both present conditions and the conditions reasonably anticipated to exist in the foreseeable
future; to lessen congestion in the streets; to provide adequate light and air; to prevent over-
crowding of land; to avoid undue concentration of population; and to facilitate the adequate
provision of transportation, water, sewerage, drainage and surface water, parks and other
commercial needs and development of the community. They have been made after a full and
complete hearing with reasonable consideration among other things of the character of the
district and its peculiar suitability for the particular uses and with a view of conserving the value
of buildings and encouraging the most appropriate use of land throughout the community.
SECTION 5.
That this ordinance shall be cumulative of all other ordinances of the City of Southlake,
Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in
those instances where provisions of those ordinances are in direct conflict with the provisions
of this ordinance.
SECTION 6.
That the terms and provisions of this ordinance shall be deemed to be severable and
that if the validity of the zoning affecting any portion of the tract or tracts of land described
herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the
balance of said tract or tracts of land described herein.
SECTION 7.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcement of any of the provisions of this ordinance shall be
fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a
violation is permitted to exist shall constitute a separate offense.
SECTION 8.
All rights and remedies of the City of Southlake are expressly saved as to any and all
violations of the provisions of Ordinance No. 480, as amended, or any other ordinances
affecting zoning which have accrued at the time of the effective date of this ordinance; and, as
to such accrued violations and all pending litigation, both civil and criminal, whether pending in
court or not, under such ordinances, same shall not be affected by this ordinance but may be
prosecuted until final disposition by the courts.
SECTION 9.
The City Secretary of the City of Southlake is hereby directed to publish the proposed
ordinance in its entirety on the City website together with a notice setting out the time and place
for a public hearing thereon at least ten (10) days before the second reading of this ordinance,
and it this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation
of any of its provisions, then the City Secretary shall additionally publish this ordinance in the
official City newspaper one time within ten (10) days after passage of this ordinance, as
required by Section 3.13 of the Charter of the City of Southlake.
SECTION 10.
This ordinance shall be in full force and effect from and after its passage and publication
as required by law, and it is so ordained.

Zoning Case No. ZA24-0007
A. Introduction
The subject of this zoning request is a 32.8 acre tract of land, situated along the
east side of Brumlow Avenue, south of East Continental Blvd., in the City of
Southlake, Texas.
The property is made up of several existing parcels, occupied by older homes which
would be removed as a part of this development. The adjacent land uses are varied,
including the future Southlake Municipal Service Center to the South, Medium -
Density Residential to the West, across Brumlow (Timarron addition), Office/ Light
Industrial adjacent to the North and West, Medium -Density Residential across
Continental to the North, and mostly Manufactured Home Residential (transitioning
to 5F Residential) to the East.
The property is currently zoned Agriculture (AG). The Future Land Use Plan
designates this area for "Mixed -Use" and "Industrial"- which we would request
partially changing to Mixed -Use. We are proposing to develop the entire property
under the Transition (TZD) Zoning Ordinance.
The property presents unique challenges and opportunities for development, and is
adjacent to a wide variety of land uses- including Industrial and Residential. It
gains access from both Brumlow Avenue and Continental Blvd. We propose to
buffer the activity and noise of the Municipal Service Center to the South from
the Residential portion with the Neighborhood Edge (Office/ Warehouse) portion
of the project. The residential portion of the project provides a better neighbor to
the existing residential on either side of the northern leg of the property, than the
existing plan for Industrial; something we heard from speaking with some of those
neighbors.
The scale and orientation of the development has been designed to provide for and
encourage a safe and inviting place, desirable architecture and a high -quality
environment, compatible with the rest of the city.
B. Statement of Intent and Purpose:
The purpose and intent of this zoning application is to allow for the creation of a
multi -use community that meets the following objectives:
1. Results in a high quality, well -designed and attractive neighborhood, meeting
the needs of a diverse and vibrant city, in a manner complimentary to the
high -quality existing neighborhoods and commercial developments of
Southlake.
2. Allows for a mixture of complimentary land uses and density, including
housing and service commercial uses in such a way so as to provide an
effective transition from the more industrial land uses to the south, to the
residential land uses bordering the site to the north, west and east.
3. Provide for open space areas, specifically located to provide a pleasant
pedestrian and visual linkage through the community.
4. Reinforce streets as public places that encourage pedestrian and bicycle
travel.
5. Encourage efficient use of the land by facilitating compact development.
E. Master Plan
The following exhibits show, in detail, how the conceptual themes identified above
have been developed and applied specifically to the property.
The Tree Conservation Analysis show how the Master Plan fits on the existing site
features, and which trees are to be preserved.
The Development Plan graphic brings it all together into a summary site plan
rendering, showing all the features of the project.
The Neighborhood Landscape Plan shows the overall landscaped areas and
specifically the trees requested by each of our neighbors which we have agreed to
install when the homes are built adjacent to their lots.

Neighborhood Edge (Office - Office/Warehouse):
The Neighborhood Edge will be made up of a Garden Office building along Brumlow,
and a series of Office/ Warehouses in the rear.
Parking will be provided at a ratio of one space for every 333 square feet of office
space; one space for every 200 square feet of Office/Warehouse space. Such
parking will be provided through a dedicated off-street parking lot.
The Development Plan shows a general layout; a subsequent Site Plan approval will
require detailed plans and elevations, but we have submitted sample photographs of
suggested design and materials anticipated. The front garden office will be faced
with unit masonry or authentic 3-step stucco, and the rear Office/ Warehouses will
either be unit masonry or tilt -wall with masonry accents and articulated surfaces,
and will have a common architectural theme with a harmonious feel and
comprehensive look.
Residential Neighborhood:
The Neighborhood contains single-family type residential units, and open space
areas. All lots along the northern entry road (adjacent to Tealwood) shall be a
minimum of 60' in width; the two lots on the east side of the drainage shall be
unique lots- as shown on the Development Plan. All other lots shall be a minimum of
50' in width.
-The 53 lots will feature a single-family detached product, ranging in size
from a minimum of 2,500 s.f. (for the 50' lots); 3,000 sf (for the remainder)
to approximately 5,200 s.f.
Each unit will have at least an enclosed two -car garage and two off-street, driveway
parking spaces. All garages will be recessed from the front of the home by a
minimum of 5'.

H. Other Considerations
TZO Modification:
1) Brumlow Avenue Sidewalk Width: Modification of the TZD requirement for
a b' sidewalk along Brumlow Avenue to 5', which is consistent with the normal
requirements of the Subdivision Ordinance.
Proposed Project Schedule:
This project infrastructure is proposed to be developed in a single phase, with
detailed design beginning immediately after zoning approval; submittal for final
approvals and construction is planned to proceed as soon as is possible after that.
All open spaces areas within the Residential Neighborhood will be improved in Phase
I. The Commercial area will be developed as the market allows.
Two or more model homes will be built initially, followed by for -sale or build -to -suit
homes as sales progress.
Open Space Management Plan:
All Common Open Space shall be owned and maintained by a Homeowners/ Property
Owners Association (H/POA). Open Space Easement areas shall also be maintained
by the H/POA. All other areas shall be the responsibility of the individual property
owners, including the front yards and required streetscape elements of the
residential lots. All property owners shall be required to be a member of the
H/POA. Dues assessments, required for the maintenance of the common areas and
other H/POA activities, shall be mandatory.
The H/POA shall be responsible for the maintenance and operation of the
protected open space within the development. The expenses required to maintain
the common areas at a quality level shall be estimated annually by the H/POA
Board, and dues shall be determined and assessed on each property owner in an
equitable fashion at such a rate as necessary to maintain such a level of quality.
Authority to enforce these requirements, and to place a lien on the property if such
dues are not paid, shall be in the form of written Deed Restrictions and Covenants,
agreed to by all property owners at purchase, and shall run with the land.
Provisions shall be made, in the H/POA bylaws and Deed Restrictions, that in the
unlikely event the H/POA fails to maintain all or a portion of the protected open
space in reasonable order and condition, the City of Southlake may, but is not
required to, assume responsibility for its maintenance and take corrective action,
including the provision of extended maintenance. The costs of such maintenance
may be charged to the H/POA or individual property owners that make up the
H/POA, and may include administrative costs and penalties which shall become a lien
on all property in the development.

ply have not thrown the
dice enough.
Since 2005,the Cow-
boys have consistently
been a “good”to a “very
good”team.They’ve had
12 winning seasons in that
stretch,including eight
years where they won at
least 10 games.
Wouldn’t you think that
in this stretch the law of
averages would work in
their favor one time that
they would at least stum-
ble into the one,or two
postseason,wins neces-
sary to reach a conference
title game?
Since the Cowboys last
reached the conference
title game,every other
NFC team but one has
made it to the NFL’s “Final
Four.”That one is team in
Washington D.C.That
franchise has gone through
three different names since
the Cowboys last reached
the NFC game.
In this stretch,the Rams
have moved from St.Louis
to Los Angeles and
reached the title game
twice.
Hell,the Detroit Lions
have now been in more
NFC title games than the
Cowboys this century.
Since 2000,the Arizona
Cardinals have made it to
NFC championship Sun-
day more than the Cow-
boys.
On the AFC side,the
Bengals have reached two
conference title games in
this span.The only other
franchises that are on a
worse streak are the Mia-
mi Dolphins,Cleveland
Browns and Houston Tex-
ans.
The difference between
the Cowboys and the rest
of that sad lot is they have
been better across the
board,and yet the post-
season success looks the
same.
Since they last reached
the NFC title game,in
1995,the Cowboys are
0-6 in divisional round
games;in that stretch
includes the Dez Bryant
“The Catch?”game in
Green Bay,and Packers
quarterback Aaron Rodg-
ers miracle throw to win at
AT&T Stadium in 2016.
The Cowboys have
become a franchise whose
identity is anchored not by
their ability to win Super
Bowls,but by their consis-
tent inability to even come
within a game of it.
On first,or even second
or third,glance the critic
says they are in this mad-
dening position because
they are doing what Ein-
stein says;changing noth-
ing while expecting differ-
ent results.
On fourth,or maybe
109th glance,the optimist
says what they are really
doing is following Ber-
noulli’s law of probability;
that,eventually,by throw-
ing enough dice they’ll
eventually win it again.
For now,for the sake of
our sanity,hope the Cow-
boys are going with Ber-
noulli even if we know by
mid January what they’ve
really done is confirm

question on how we (Cow-
boys)felt about CeeDee
Lamb,”Jones said.
“I don’t see any rewards
or I don’t see any penal-
ties on a timer,”Jones
said.“Does he get on the
field and does he get on
the field when he ought to
be out there?So,I had no
urgency at all to getting
him to the field.”
Jones said there were
multiple reasons that it
took the franchise so long
to sign Lamb.Chiefly,he
Jones was looking at the
long-term plan.
“I have to look three
years down the road,if
you will,sometimes five
years down the road,”
Jones said.“I have a really
good feel,as good as any-
body,about what the
future is going to be for
the teams in the NFL
regards to revenue.
“This is a long-range life
that you have to deal with
...CeeDee’s contract had
everything to do with how
important he was to the
Dallas Cowboys ...but
also had everything to do
with how he was going to
fit into our picture years
down the road.”
And part of the long-
term plan includes signing
pending free agent Dak
Prescott to a new contract.
But,it’s a difficult deci-
sion.
“Dak is a long-term
decision for the Dallas
Cowboys,”Jones said.“I
think Dak,one of his
unique things ...what he is
as a person and as a quar-
terback,will age well as
you look at quarterback
age and viability ...I think
he is the kind of quarter-
back who gets better and
better.
“I think he got better
with Mike (McCarthy)as
his offensive coordinator.
....He was definitely bet-
ter last year with room to
get better,room to grow.”
“When you look at what
he brings to the table,”
Jones said,“as opposed to
the alternative.The al-
ternative is not a one-year
alternative,it’s a several-
year alternative.So when
you look at the prospects of
him knocking on that (Sup-
er Bowl)door the next five
years,I like those odds.”
“It’s very important that
we find a way to reconcile
this with Dak,”Jones said.
“We got to ask ourselves
‘Can we have the kind of
success that Dak deserves,
we deserve,his teammates
deserve,our fans deserve,
can we do that and get in
the range to afford Dak?’I
think we can.”

Horned Frogs still have
more than enough to win
