Subject: Approve an Encroachment and Joint Use Agreement for a
retaining wall within the drainage easement being located at
1100 Raven Bend Court.
Action
Requested: Approve an Encroachment and Joint Use Agreement for a retaining
wall within the drainage easement being located at 1100 Raven Bend
Court.
Background
Information: The purpose of this item is to seek City Council approval of an
Encroachment and Joint Use Agreement for the installation of a
retaining wall within the drainage and utility easement being located
at 1100 Raven Bend Court. The property owner of 1100 Raven Bend
Court is requesting to construct a retaining wall within a drainage and
utility easement located along the north property line.
This agreement will allow the developer to place a retaining wall five
feet into the easement along the north side of the property. There are
no city utilities or infrastructure within this easement. The drainage
easement was dedicated to allow for cross lot drainage and the
applicant's engineer of record has certified that the proposed
retaining wall will not impede the drainage flow from the neighboring
property to the east.
Financial
Considerations: This is a no cost agreement.
