Subject: Request for City Manager's Signature [Tommy's Car Wash
Encroachment License Agreement]
PURPOSE
The purpose of this signature request is to sign the Encroachment License Agreement
forthe Tommy's Car Wash development. The Encroachment License Agreement is to
allow the Tommy's Car Wash developmentto encroach into the existing utility easement
where two city water mains are located.
BACKGROUND
The paved private drive and carwash lane, concrete curb, and screening wall for
Tommy's Car Wash development are located within the utility easement. Typically,
pavement is an allowed encroachment into utility easements, however, if repairs are
necessary on the city water mains, a disruption to business may occurwhich would
require a signed agreement between the City and the property owner. The
Encroachment License Agreement is a form created by TOASE to ensure that the City
cannot be held liable for any damages or losses incurred if the City needs to make
repairs to the water mains within the easement.
BUDGET IMPACT
This section does not apply to the Encroachment License Agreement. There is no
impact to the budget.
COMPLIANCE & LEGAL REVIEW
The Encroachment License Agreement was created and reviewed by TOASE.
ALTERNATIVES CONSIDERED
The other alternative would be for the development to not be construct on this property.
RECOMMENDATION
It is recommended that the Encroachment License Agreement be signed by the city so
we can approve the permit, and the developer can begin construction.
