Item 6 - Demonstration and PlansSIGN VARIANCE APPLICATION 1400 Main Street, Suite 310, Southlake, TX 76092 Phone: (817) 748-8215 Fax: (817) 748-8077 Revised January 2023 2 Demonstration Please demonstrate that the following conditions are applicable to the requested sign variance: 1.That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. 2.That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. 3.That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. 4.That the variance will be in harmony with the spirit and purpose of the sign ordinance. Consideration for the size increase for the Petfolk wall sign will avoid any unnecessary hardships by allowing exposure to all potential clients. The signs size requested is to allow customers to identify Petfolks location. Petfolk has the longest storefront and the current code makes their sign seem to be like a postage stamp on the wall. Only one sign per Tenant is permitted. Approval of all signage in the Center is subject to the absolute discretion of the Landlord. General Requirements for fascia signs installed above the storefront: l. All signage costs, including but not limited to, design, fabrication, penn1ttmg installation, maintenance, repair and removal, as well as the cost of any repairs or corrective action that may arise as a result of the installation or removal of the sign, are the sole responsibility of Tenant. 2. Tenant will ensure that all sign work is in accordance with all government codes and regulations and other Laws and that all required permits have been obtained. 3. The Tenant may use any qualified sign fabrication/installation company of its choice, provided that said company is licensed to fabricate, install and repair signage under all local and state requirements. Tenant must provide proof of the sign contractor's insurance coverages that meet Landlord's minimum requirements. 4. Length of the sign will not exceed the lesser of (i) two-thirds of the storefront or (ii) the storefront width less 2'6" from each end. The maximum height will not exceed twenty-four inches. 5. Prior to installing a sign, the fascia area that extends the full width of the store where the sign will be installed must be painted with material that matches the existing paint specifications and that has been approved by the Landlord. Landlord may waive this requirement if the fascia has been recently painted. 6. Metal or plastic letters, of script or block style, internally illuminated and with opaque face of colored plastic, will be individually applied to an un-corrosive raceway. Said raceway will be painted to match the color of the background fascia and will be attached with un-corrosive fasteners. Signs will be accurately centered at the vertical midpoint of the fascia. 7. Sign will be properly attached to meet all applicable codes and municipal requirements. All wall penetrations must be properly waterproofed in accordance with manufacturers' specifications. No penetrations may be made into any roofing material. 8. Wording of signs shall be limited to Tenant's trade name and logo only. 9. The size and location of all signs shall be limited. l 0. Only one sign will be permitted on the storefront, and all signs must be parallel to elevation. 11. All signs will be self-illuminated. 12. The following is not permitted and is expressly prohibited: (a) Signs with exposed neon or fluorescent tubing or exposed lamps; Petfolk Lease Agreement Southlake, TX Exhibit C-Page l DocuSign Envelope ID: FE2394D2-156A-46FC-BC6D-3CC4A2CE1150 (b) Signs with flashing, blinking, moving, flickering, animated or audible effects or type; ( c) Printed signs on fronts or show windows; ( d) Paper signs, stickers, banners or flags; (e) Exposed raceways, ballast boxes or electrical transformers; (f) Exposed sign company names or stamps; (g) Exposed sign illumination or illuminated sign cabinets or modules; (h) Painted signs on the exterior surface of any building; (i) Signs located at or on the side or rear of any building except for small identifying signs to facilitate deliveries, in accordance with Landlord's standard sign format for rear and service corridor doors, but no other signs will be permitted; (j) Roof top signs; (k) Sign boxes; and (l) Exterior illumination of signs from mall ceiling. Approval Procedure: 1. Tenant will submit to Landlord prior to installation and in duplicate: (a) Copies of the sign plans, including installation, wiring specifications that include wiring of the sign to the electric panel serving the Tenant's Premises and attachment details . (b) Elevation view of sign drawn to scale with dimensions of sign height, height of letters, and length of sign. ( c) Evidence of sign contractors Insurance coverages. (d) Copies of the installation permit and the Certification of Completion when issued. The requirements and obligations in this Exhibit C are in addition to, and not in lieu or limitation of, the requirements and obligations set out in the other provisions of this Lease. In the event of a conflict between the terms and conditions of this Exhibit C and the provisions of any applicable laws, codes and/or regulations, the provisions of such applicable laws, codes and/or regulations will apply.
