Subject: Approve an Encroachment and Joint Use Agreement for a
wrought iron fence within the drainage easement being
located at 300 Sanctuary Circle and 904 Stacy Drive.
Action
Requested: Approve an Encroachment and Joint Use Agreement for a wrought
iron fence within the drainage easement being located at 300
Sanctuary Circle and 904 Stacy Drive.
Background
Information: The Developer of 300 Sanctuary Circle and 904 Stacy Drive, Holmes
Builders, is requesting to construct a wrought iron fence within a
drainage easement located along the rear of both properties. City
Council previously approved an encroachment and joint use
agreement, at the 12/19/2023 meeting, for the fence located on 900
Stacy Drive which is located between 300 Sanctuary Circle and 904
Stacy Drive.
The purpose of this item is to seek City Council approval of an
Encroachment and Joint Use Agreement for the installation of a
wrought iron fence within the drainage easement at 300 Sanctuary
Circle and 904 Stacy Drive. This agreement will allow the developer
to place a wrought iron fence along the rear of both properties and
along the south side yard of 904 Stacy Drive. There are no City
utilities or infrastructure within this easement. The drainage
easement was dedicated for the adjacent creek, a tributary of Big
Bear Creek, located west of the properties within the neighboring
subdivision. Per the drainage memo prepared by Cardinal
Strategies, the proposed wrought iron fence will not impede the
drainage flow.
Staff is requesting City Council to consider the proposed drainage
easement encroachment for the proposed improvements within 300
Sanctuary Circle and 904 Stacy Drive.
Financial
Considerations: This is a no cost agreement.
