KNOW ALL MEN BY THESE PRESENTS:
That we, Daniel 1. and Nancy A. Sutherland, for and in consideration of the sum of Ten
($10) Dollars and other good and valuable consideration in hand paid by Grantee herein, the
receipt and sufficiency of which is hereby acknowledged and confessed, have granted, sold
and conveyed, and by these presents do grant, sell and convey to the City of Southlake,
Grantee herein, of Tarrant County, Texas a permanent and perpetual easement for the
purpose of installing, repairing, maintaining, altering, replacing, relocating, and operating
utilities in, into, upon, over, across and under that land in Tarrant County, Texas described as
follows, to-wit:
Being a Permanent Utility Easement described as follows:
See attached Exhibit 'A' for graphic depiction
See attached Exhibit 'B' for description together with the right of ingress and egress as
necessary for such purposes.
TO HA VE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said Grantee, its
successors and assigns forever; and We do hereby certify that We are the owners of the
property described herein and bind ourselves, our heirs and assigns, to warrant and to forever
defend all and singular the premises unto the said Grantee, its successors and assigns, against
every person whomsoever lawfully claiming or to claim same or any thereof.

Prior to entering the property The City of Southlake agrees
to provide to the Sutherlands in writing all details of the
proposed construction including but not limited to:
1) the route of all equipment to be used on the property;
2) where any digging will take place; 3) any brush, bushes
or trees to be altered; and 4) the location of dirt created
during digging. In addition the City- of Southlake agrees to
have staked all areas where digging will occur including
beginning and ending points and width indicators prior to
any equipment entering the property. The City of
Southlake further agrees to limit digging to only those areas
so staked.

Beginning at a 3/4" iron rod found at a southeasterly comer of Lot 16, Block 3, Cross
