KNOW ALL MEN BY P-IESE PRESENTS:
That I, ToliN? M4-~UN , for and in consideration of the sum ofTen ($10) Dollars
and other good and valuable consideration in hand paid by Grantee herein, the receipt and
sufficiency of which is hereby acknowledged and confessed, have granted, sold and conveyed, and
by these presents do grant, sell and convey to the CITY OF SOUTHLAKE, Grantee herein, of
Tarrant County, Texas a permanent and perpetual drainage and utility easement for the purpose
of constructing and maintaining said drainage and utility improvements upon, over, across and
under that land in Tarrant County, Texas described as follows, to-wit:
Being a IS' permanent drainage and utility easement and a 35' temporary construction easement,
described as follows:
See Exhibit "A" for graphic depiction
See Exhibit "B" for metes and bounds description
together with the right of ingress and egress as necessary for such purposes.
Such permanent easements shall include the right to enter for purposes of maintaining the drainage
improvements upon such property, but Grantee shall replace any fences, improvements, or other
fixtures upon said property without cost to Grantor, or current owner thereof, and shall restore
the property, the subject of the permanent easement, as nearly as possible to its condition prior
to entry thereon.
TO HAVE AND TO HOLD the above described easement, together with all and singular, the
rights and appurtenances thereto, anywise belonging unto the said Grantee, its successors and
assigns forever; and I/We do hereby certify that I/We are the owners of the property described
herein and bind myself/ourselves, my/our heirs and assigns, to warrant and to forever defend all
and singular the premises unto the said Grantee, its successors and assigns, against every person
whomsoever lawfully claiming or to claim same or any thereof.

35' Temporary Construction Easement
3F9-DUE
Being 0.055 of an acre of land, more or less, situated in the J.J. Freshour Survey, Abstract
No. 521, City of Southlake, Tarrant County, Texas and being a portion of a tract conveyed to
John P. Martin by deed in Volume 10889, P. 606 (D.R.T.C.T.), which 0.055 of an acre of
land, more or less, is more particularly described as follows:
BEGINNING at the southwest corner of said Martin tract;
THENCE
NORTH, for a distance of 15.00 feet to a point for corner, said point being in
the west property line of said M(lrtin tract;
THENCE
EAST, for a distance of 159.61 feet to a point for corner in the east property
line of said Martin tract and in the west right-of-way line of Sutton Lane;
THENCE
S 000 42' 00" E, for a distance of 15.00 feet to a point for a corner in the west
right-of-way line of Sutton Lane~ said point ,being the southeast corner of said
Martin tract;
THENCE
WEST, for a distance of 159.43 feet to the POINT OF BEGINNING,
containing within these metes and bounds 0.055 acres or 2,393 square feet of
land, more or less.
