THAT I, Maria P. Gonzalez, for and in consideration of See Exhibit "C" and other good and valuable
consideration in hand paid by Grantee herein. the receipt and sufficiency of which is hereby acknowledged and
confessed. have granted. sold and conveyed, and by these presents do grant, sell and convey to the City of
Southlake, Grantee herein, of Tarrant COlmty. Texas a permanent and perpetual Easement for the purpose of
installing. repairing. maintaining, altering, replacing, relocating, and operating utilities in, into, over, upon, across
and under that land in Tarrant County, Texas described as follows, to-wit:
Being a Pennanent Drainage and Utility Easement, described as follows:

See attached Exhibit 'B' for metes and bounds description together with the right of ingress and egress as
necessary for such purposes.

TO HA VE AND TO HOLD the above described easement, together with all and singular, the rights and
appurtenances thereto, anywise belonging unto the said Grantee, its successors and assigns forever; and We do
hereby certit:r that We are the owners of the property described herein and bind ourselves, our heirs and assigns, to
warrant and to forever defend all and singular the premises unto the said Grantee, its successors and assigns, against

10' Permanent Drainage and Utility Easement
3F7-DUE
Being 0.059 of an acre ofland, more or less, situated in the 1.1. Freshour Survey, Abstract No.
521, City of Southlake, Tarrant County, Texas and being a portion of a tract conveyed to
Maria P. Gonzalez by deed in Volume 8355, P. 1132 (D.R.T.C.T.), which 0.054 of an acre of
land, more or less, is more particularly described as follows:
Being a 10 foot wide strip of land having a centerline south, a distance of 5.0 feet from the north
property line of said Gonzalez tract, and being continuous across the limits of said tract, and also
having a centerline east, a distance of 5.0 feet from the west property line of said Gonzalez tract,
and being continuous across the limits of said tract, containing 0.059 acres or 2,561 square feet of
land.

EXHIBIT "C"
In return for this Easement the City of Southlake will construct a new (6) six-foot wood privacy fence
with metal posts and clips to match the existing fence posts. Said new fence will run from the southwest
corner of the property along the western property line to the northwest comer of the property and east along
the northern property line to a point in the northern property line to be determined by property owner. Any
fences removed due to construction will be realigned in accordance with property owner's direction.
Additionally the City of Southlake will engineer and grade property owners lot so as to prevent drainage
and water flow under the Doublewide Mobile Home upon the subject property.
When construction is finished and the above-described fence is installed, the property owners yard will be
shaped and hydro mulched with bennuda yard grass. Immediately around the doublewide to be sodded
with bermuda grass to prevent erosion.
Any grates or inlets will be at grade level or below so as to allow a riding lawn mower to pass over
unobstructed.
Further the City of Southlake will maintain the integrity of the pipe and grates within the easement so long
as they remain upon the property. In the event there is any abnonnal settlement or drainage restrictions
within the grates. the City of Southlake will cause the restrictions or settlement to be cleared or repaired, or
replaced.
Any trees removed, as a result of construction ,vill be replaced with like kind trees or shade trees of
property owners choice.
