KNOW ALL MEN BY THESE PRESENTS:
That I, Lance B. Hight, for and in consideration of the sum ofTen ($10) Dollars
and other good and valuable consideration in hand paid by Grantee herein, the receipt and
sufficiency of which is hereby acknowledged and confessed, have granted, sold and
conveyed, and by these presents do grant, sell and convey to the City of Southlake,
Grantee herein, of Tarrant County, Texas a permanent and perpetual utility easement for
the purpose of installing, repairing, maintaining, altering, replacing, relocating, and
operating utilities in, into, upon, over, across and under that land in Tarrant County, Texas
described as follows, to-wit:
Being a IS' permanent utility easement and 35' temporary construction easement,
described as follows:
See attached Exhibit 'A' for graphic depiction
See attached Exhibit 'B' for metes and bounds description together with the right
of ingress and egress as necessary for such purposes.
The above described utility easement will not affect the net area of the property if
and when the property is zoned and platted. The City will restore the disturbed areas to
original or better condition. All disturbed areas shall be block sodded following
construction of the sanitary sewer line. The City will provide a 4-inch sanitary sewer
service in a location specified by the owner for future connection. The City will waive the
associated sewer impact fee for the future construction of a new house on the property.
TO HAVE AND TO HOLD the above described utility easement, together with all
and singular, the rights and appurtenances thereto, anywise belonging unto the said
Grantee, its successors and assigns forever; and We do hereby certify that We are the
owners of the property described herein and bind ourselves, our heirs and assigns, to
warrant and to forever defend all and singular the premises unto the said Grantee, its
successors and assigns, against every person whomsoever lawfully claiming or to claim
same or any thereof

15' PERMANENT UTILITY EASEMENT
Field Notes
Being a 0.1344 acre tract of land in the Francis Throop Survey, Abstract No. 1511, City of
Southlake, Tarrant County, Texas and being a 15 foot wide strip ofland, over, through, and
across a 1.17 acre tract conveyed to Lance B. Hight, as recorded in Volume 12720, page
2353, Deed Records, Tarrant County, Texas, and being more particularly described as
follows:
Beginning at an iron rod found at the southeast comer of said Hight tract, also being in the
northerly line of Whispering Dell Estates, as recorded in Volume 388-143, page 40, Plat
Records, Tarrant County, Texas;
THENCE
West, along the southerly line of said Hight tract, and the northerly line of
said Whispering Dell Estates, a distance of 390.30 feet to the southwest
comer of said Hight tract, being in the easterly line of North Carroll Avenue;
THENCE
North, along the westerly line of said Hight tract, and the easterly line of
North Carroll Avenue, a distance of 15.00 feet;
THENCE
East, parallel with the southerly line of said Hight tract and the northerly line
of said Whispering Dell Estates, a distance of 390.30 feet to a point in the
easterly line of said Hight tract;
THENCE
South, along the easterly line of said Hight tract, a distance of 15.00 feet to
the Point Of Beginning, containing 0.1344 acre ofland or 5,855 square feet
of land, more or less, and being subject to all easements, restrictions, and
