PERMANENT AND TEMPORARY

KNOW ALL MEN BY THESE PRESENTS:
That we, SOUTHLAKE JOINT VENTURE, for and in consideration of the sum of Ten ($10)
Dollars and other good and valuable consideration in hand paid by Grantee herein, the receipt
and sufficiency of which is hereby acknowledged and confessed, have granted, sold and
conveyed, and by these presents do grant, sell and convey to the CITY OF SOUTHLAKE,
Grantee herein, of Tarrant County, Texas, a perpetual easement for the purpose of installing,
repairing, maintaining, altering, replacing, relocating and operating utilities in, into, upon, over,
across and under that land in Tarrant County, Texas, described as follows, to wit:
Permanent 15' Sanitary Sewer Easement:
See attached Exhibit' A' for metes and bounds description. See attached Exhibit
'B' for graphic depiction.
together with the right of ingress and egress as necessary for such purposes, and an additional
contiguous temporary construction easement for a period of one (1) year for the purpose of
installing utilities on the property known and described as follows, to wit:
Temporary Construction Easement:
Immediately adjacent to the above described easement in a configuration as
shown on Exhibit 'B.'
Such temporary and permanent easements shall include the right to excavate upon such
property, but Grantee shall replace any fence, improvements, or other fixtures upon said
property without cost of Grantor, or current owner thereof, and shall restore the property as
nearly as possible to its condition prior to entry thereon.
TO HAVE AND TO HOLD the above described easement, together with all and singular, the
rights and appurtenances thereto, anywise belonging unto the said Grantee, its successors and
assigns forever; and We do hereby certify that We are the owners of the property described
herein and bind ourselves, our heirs and assigns, to warrant and to forever defend all and
singular the premises unto the said Grantee, is successors and assigns, against every person
whomsoever lawfully claiming or to claim same or any thereof.

LEGAL DESCRIPTION
BEING a strip of land out of the P.J. HYDE SURVEY, Abstract No. 667 in the City of Southlake, Tarrant
County, Texas and being a part of the 210.99 acre tract conveyed to Southlake Joint Venture by deed
recorded in Volume 9719, Page 599, Deed Records of Tarrant County, Texas and the centerline of the
fifteen (15) foot easement, 7.50 feet on each side, being more particularly described as follows:
BEGINNING at a point for the intersection of the south line of TIMBER LAKE SECTION ONE, an addition
to the City of Southlake, Texas according to the plat thereof recorded in Cabinet A, Slide 484, Plat
Records of Tarrant County, Texas with the centerline of Timber lake Circle (50' ROW), from which
a 1/2" iron rod set bears South 57035'00" East, 228.68 feet;
THENCE with the centerline of the fifteen (15) foot easement, South 37000'00" West, a distance of
26.21 feet to a point for the beginning of a tangent curve to the left, having a central angle of
21021'00", a radius of 325.00 feet and a chord bearing and distance of South 26019'30" West,
120.40 feet;
THENCE southerly continuing with the said centerline and with the said curve, an arc distance of
1 21 .10 feet to a point for corner;
THENCE continuing with the centerline of the fifteen (15) foot easement, North 74021'00" West, a
distance of 24.11 feet to a point for the beginning of a tangent curve to the left, having a central angle
of 14039'00", a radius of 333.68 feet and a chord bearing and distance of North 81040'30" West,
85.09 feet;
THENCE westerly continuing with the said centerline and with the said curve, an arc distance of 85.32
feet to the point of tangency of said curve;
THENCE continuing with the centerline of the fifteen (15) foot easement, North 89000'00" West, a
distance of 32.73 feet to a point for the beginning of a tangent curve to the left, having a central angle
of 56000'00", a radius of 350.00 feet and a chord bearing and distance of South 63000'00" West,
328.63 feet;
THENCE southerly continuing with the said centerline and with the said curve, an arc distance of
342.08 feet to the point of tangency of said curve;
THENCE continuing with the centerline of the fifteen (15) foot easement, South 35000'00" West, a
distance of 195.73 feet to a point for the begining of a tangent curve to the left, having a cental angle
of 11040'00", a radius of 400.00 feet and a chord bearing and distance of South 29010'00" West,
81.31 feet;
THENCE southerly continuing with the said centerline and with the said curve, an arc distance of 81 .45
feet to the point of tangency of said curve;
THENCE continuing with the centerline of the fifteen (15) foot easement, South 23020'00" West, a
distance of 319.69 feet to a point for the beginning of a tangent curve to the left, having a central
angle of 06014'37", a radius of 400.00 feet and a chord bearing and distance of South 20012'42"

THENCE southerly continuing with the said centerline and with the said curve, an arc distance of 43.59
