That I, Berney R. Tucker, GRANTOR herein, for and in consideration of the sum
of Ten ($10.00) Dollars and other good and valuable consideration in hand paid by the
CITY OF SOUTHLAKE, home rule municipal corporation of the County of Tarrant, State
of Texas, GRANTEE herein, the receipt and sufficiency of which is hereby
acknowledged and confessed, do hereby grant, sell and convey unto the said
GRANTEE a permanent and perpetual easement for the purpose of installing, repairing,
maintaining, altering, replacing, relocating, rebuilding, removing, and operating drainage
facilities in, into, upon, over, across, under and through all that land in Tarrant County,

A 15 foot wide Permanent Drainage and Utility Easement containing .~:
approximately 0.04 acres, as shown on Exhibit "A" and more particularl
described in Exhibit "B" attached hereto and incorporated herein.

together with the right of ingress and egress as necessary for such purposes.

GRANTOR covenants and agrees that GRANTOR and GRANTOR's heirs,
representatives, successors and assigns shall at no time erect, place or construct, or
cause to be erected, placed or constructed in, into, upon, over, across or under any
easements granted herein any temporary or permanent structures, and it is further
agreed that GRANTEE shall have the right to excavate and fill upon said permanent
easement and to remove from said permanent easement, any fences, buildings or other
obstructions as may now be found upon said permanent easement.
It is further intended that the Permanent Drainage Easement herein granted to
the GRANTEE shall run with the land and forever be a right in and to the land belonging
to GRANTOR, and GRANTOR'S successors and assigns, and said grant is expressly
excepted from any right of reversion of said premises under any prior deeds in
GRANTOR's chain of title. The Permanent Drainage Easement, rights and privileges
granted therein are exclusive, and GRANTOR covenants that it will not convey any
other easement or conflicting rights within the area covered by the grant to any other
person.

ACROSS THE PROPERTY OF
BERNEY R. TUCKER
(LOT 25, BLOCK 3 OF VISTA TRAILS ADDITION AS RECORDED IN
VOLUME 38895, PAGE 3 OF THE DEED RECORDS OF TARRANT COUNTY TEXAS)
Being a 0.04 acre tract of land for permanent drainage easement generally IS-feet in width
located in the J. J. Freshour Survey, Abstract Number 251 of Tarrant County, Texas, and being
over, under and across a tract of land conveyed to Berney R. Tucker and platted as Lot 25,
Block 3 of Vista Trails Addition as recorded in Volume 38895, Page 3 of the Deed Records of
Tarrant County Texas (DRTCT), said permanent drainage easement being more particularly
described as foilows:
BEGINNING at a point in the south line of an existing 10.00 foot electric easement conveyed to
Tri-County Electric Company by a deed now of record in Volume 4077, Page 427 of the Deed
Records of Tarrant County, Texas, said point being in the north line of said Tucker tract, 30.00
feet from and perpendicular to the east line of said Tucker tract, said point also being
S 89051 '00" E, a distance of 190.57 feet from a 5/8-inch iron rod found for the intersection of the
east right-of-way line of Overland Trail (a 50.00 foot right-of-way), the northwest comer of said
Berney R. Tucker tract and the southwest comer of a tract of land conveyed to Gary D. Green
and platted as Lot 24, Block 3 of Vista Trails Addition as recorded in Volume 38895, Page 3,
DRTCT;
THENCE S 89051 '00' E, a distance of 15.00 feet to a point for a comer, said point being 15.00
feet from and perpendicular to the east line of said Tucker tract;
THENCE S 00032 '26" E, being at all times 15.00 feet from and parallel with the east line of said
Tucker tract, a distance of 110.00 feet to a point for a comer in the common line between said
Tucker tract and the north line of a tract of land conveyed to Darrick L. Walls and platted as Lot
26, Block 3 of Vista Trails Addition as recorded in Volume 38895, Page 3, DRTCT;
THENCE N 89051 '00" W, along the common line between said Tucker tract and said Walls tract
a distance of 15.00 feet to a point for a comer;
THENCE N 00032'26" W, being at all times 30.00 feet from and parallel with the east line of
said Tucker tract a distance of 110.00 to the POINT OF BEGINNING, said permanent drainage
easement containing 0.04 acres (1,650 square feet) of land, more or less.
