Sign Variance for the Shops of Southlake
PROJECT:
REQUEST: Variance to the Sign Ordinance No. 704-B requirements for sign height and area of a
temporary development sign. The development is located at the southeast corner of
South Carroll Avenue and F.M. 1709. The specific variances requested are as

BACKGROUND INFORMATION
OWNER/APPLICANT: Carroll/1709 Ltd.; Cencor Realty Services
PROPERTY SITUATION: The development is located on the southeast corner of South Carroll Avenue
and F.M. 1709.
REQUEST: The applicant is requesting a variance to the requirements for sign height and
area of a temporary development sign. The proposed development sign is a
single-sided sign with a sign face of approximately 160 s.f. and a total height
of approximately 13.5 feet. Development signs are allowed for a period of
one (1) year or upon issuance of a certificate of occupancy for commercial
developments.
STAFF COMMENTS: The sign criteria, site plan and application are attached to this report. The
following variances are requested:
Ord. 704-B, Section 21.D.2.a. MAXIMUM HEIGHT: The maximum
permitted height is five (5) feet.
The applicant is requesting a maximum sign height of 13.5 feet.
Ord. 704-B, Section 21.D.2.b. MAXIMUM AREA: The maximum
permitted area is sixty-four (64) square feet with a maximum of thirty-
two (32) square feet per sign face.
The applicant is requesting a single-sided sign with a maximum area of
160 s.f.
The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704-B, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in this
ordinance, including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a
practical difficulty on the applicant, that the situation causing the
unnecessary hardship or practical difficulty is unique to the affected property
and is not self-imposed, that the variance will not injure and will be wholly
compatible with the use and permitted development of adjacent properties,
and that the granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance. A person may request a variance from the
Sign Ordinance by filing the request with the Building Official. Any request
for variance shall be accompanied by a completed application and a non-
refundable filing fee in the amount specified in the current fee schedule
adopted by City Council.
