That I, wI?; 1-1i Chl4/JR-) LLC, GRANTOR herein, for and in
consideration of the sum of Three 'thousand four hundred eighty-nine ($3,489.00)
Dollars and other good and valuable consideration in hand paid by the CITY OF
SOUTHLAKE, home rule municipal corporation of the County of Tarrant, State of Texas,
GRANTEE herein, the receipt and sufficiency of which is hereby acknowledged and
confessed, do hereby grant, sell and convey unto the said GRANTEE a permanent and
perpetual drainage easement for the purpose of installing, repairing, maintaining, altering,
replacing, relocating, rebuilding, removing, and operating drainage facilities in, into, upon,
over, across, under and through all that land in Tarrant County, Texas described as
follows, to-wit:

SEE ATTACHED EXHIBIT B for graphic description
GRANTOR covenants and agrees that GRANTOR and GRANTOR's heirs,
representatives, successors and assigns shall at no time erect, place or construct, or cause
to be erected, placed or constructed in, into, upon, over, across or under any drainage
easement granted herein any temporary or permanent structures, and it is further agreed
that GRANTEE shall have the right to excavate and fill upon said permanent drainage
easement and to remove from said permanent drainage easement, any fences, buildings or
other obstructions as may now be found upon said permanent drainage easement.
It is further intended that the Permanent Drainage Easement herein granted to the
GRANTEE shall run with the land and forever be a right in and to the land belonging to
GRANTOR, and GRANTOR'S successors and assigns, and said grant is expressly
excepted from any right of reversion of said premises under any prior deeds in
GRANTOR's chain of title. The Permanent Drainage Easement, rights and privileges
granted therein are exclusive, and GRANTOR covenants that it will not convey any other
easement or conflicting rights within the area covered by the grant to any other person or
entity.
TO HAVE AND TO HOLD the above described permanent drainage easement
with the right of ingress and egress thereto, together with all and singular the rights and
appurtenances thereto in any wise belonging unto GRANTEE, its successors and assigns,
forever, and GRANTOR does hereby bind himself, his heirs, successors and assigns to
warrant and forever defend, all and singular, the said premises unto the GRANTEE its
successors and assigns, against every person whomsoever lawfully claiming or to claim the
same or any part thereof.

SITUATED in the City ofSouthlake, Tarrant County, Texas and being a strip ofland out of the Larkin Chivers
Survey, Abstract No. 300, said strip being out of a tract of land conveyed to White Chapel L.L.C as "Tract III"
by deed as recorded in Volume 12665, Page 2287 of the Deed Records of Tarrant County, Texas (D.R.T.C.T.),
said strip of land being herein described as a proposed variable width Permanent Drainage Channel Easement
and being herein more particularly described by metes and bounds as follows:
BEGINNING at the southwest property comer of the remainder of the said White Chapel tract, said point being
on the easterly right-of-way line of White Chapel Boulevard;
THENCE, North 0 degrees 41 minutes 45 seconds West, along the westerly property line of the said White
Chapel tract and along the said right-of-way line, 17.84 feet to a point;
THENCE, North 40 degrees 32 minutes 08 Seconds East 74.83 feet to a point;
THENCE, South 49 degrees 27 minutes 57 seconds East 16.40 feet to a point on the southeasterly property line
of the said White Chapel tract, said point being on the northwesterly property line of a Tract 1, Block 1 of the
Chivers Addition, being an addition to the City of South lake according to the plat as recorded in Volume 388-
142, Page 47 of the Plat Records of Tarrant County, Texas;
THENCE, South 43 degrees 32 minutes 40 seconds West, along the said property lines, 88.37 feet to the
POINT OF BEGINNING.
The proposed variable width Permanent Drainage Channel Easement herein described contains (0.0267 acres
1,163 sq. ft.) of land.
