CHANGE ON A CERTAIN TRACT OR TRACTS OF LAND
WITHIN THE CITY OF SOUTHLAKE, TEXAS BEING LEGALLY
DESCRIBED AS LOTS 13R1-13R5, T. M. HOOD NO. 706
ADDITION SOUTHLAKE, CITY OF SOUTHLAKE, TARRANT
COUNTY, TEXAS, BEING APPROXIMATELY 3.04 ACRES, AND
MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A"
FROM "S-P-1" DETAILED SITE PLAN DISTRICT TO "S-P-1"
DETAILED SITE PLAN DISTRICT, SPECIFICALLY ADDING
"COMMERCIAL SCHOOL/TUTORING ACADEMY" AS A
PERMITTED USE AS DEPICTED ON THE APPROVED SITE
PLAN ATTACHED HERETO AND INCORPORATED HEREIN AS
EXHIBIT "B", SUBJECT TO THE SPECIFIC REQUIREMENTS
CONTAINED IN THIS ORDINANCE; CORRECTING THE
OFFICIAL ZONING MAP; PRESERVING ALL OTHER
PORTIONS OF THE ZONING ORDINANCE; DETERMINING
THAT THE PUBLIC INTEREST, MORALS AND GENERAL
WELFARE DEMAND THE ZONING CHANGES AND
AMENDMENTS HEREIN MADE; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A
PENALTY FOR VIOLATIONS HEREOF; PROVIDING A
SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE
OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Texas Local Government Code; and,
WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the
authority to adopt a comprehensive zoning ordinance and map regulating the location and use
of buildings, other structures and land for business, industrial, residential and other purposes,
and to amend said ordinance and map for the purpose of promoting the public health, safety,
morals and general welfare, all in accordance with a comprehensive plan; and,
WHEREAS, the hereinafter described property is currently zoned as "S-P-1" Detailed
Site Plan District under the City's Comprehensive Zoning Ordinance; and,
WHEREAS, a change in the zoning classification of said property was requested by a
person or corporation having a proprietary interest in said property; and,
WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called
by the City Council did consider the following factors in making a determination as to whether
these changes should be granted or denied: safety of the motoring public and the pedestrians
using the facilities in the area immediately surrounding the sites, safety from fire hazards and
damages; noise producing elements and glare of the vehicular and stationary lights and effect
of such lights on established character of the neighborhood; location, lighting and types of signs
and relation of signs to traffic control and adjacent property; street size and adequacy of width
for traffic reasonably expected to be generated by the proposed use around the site and in the
immediate neighborhood; adequacy of parking as determined by requirements of this
ordinance for off-street parking facilities; location of ingress and egress points for parking and
off-street loading spaces, and protection of public health by surfacing on all parking areas to
control dust; effect on the promotion of health ad the general welfare, effect on light and air;
effect on the over -crowding of the land; effect on the concentration of population, and effect on
transportation, water, sewerage, schools, parks and other public facilities; and,
WHEREAS, the City Council of the City of Southlake, Texas, further considered among
other things the character of the districts and their peculiar suitability for particular uses and the
view to conserve the value of the buildings, and encourage the most appropriate use of the
land throughout this City; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a
public necessity for the zoning changes, that the public demands them, that the public interest
clearly requires the amendments, and that the zoning changes do not unreasonably invade the
rights of those who bought or improved property with reference to the classification which
existed at the time their original investment was made, and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes
in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other
dangers, promotes the health and the general welfare, provides adequate light and air,
prevents the over -crowding of land, avoids undue concentration of population, and facilitates
the adequate provision of transportation, water, sewerage, schools, parks and other public
requirements; and,
WHEREAS, the City Council of the City of Southlake, Texas, has determined that there
is a necessity and need for the changes in zoning and has also found and determined that
there has been a change in the conditions of the property surrounding and in close proximity
to the tract or tracts of land requested for a change since the tract or tracts of land were
originally classified and therefore feels that the respective changes in zoning classification for
the tract or tracts of land are needed, are called for, and are in the best interest of the public at
large, the citizens of the city of Southlake, Texas, and helps promote the general health, safety
and welfare of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake,
Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is
hereby amended so that the permitted uses in the hereinafter described areas be altered,
changed and amended as shown and described below:
Being described as Lots 13R1-13R5, T. M. Hood No.706 Addition, Southlake,
Texas, and located at 1310-1360 N. White Chapel Blvd., and more fully and
completely described in Exhibit "A" from "S-P-1" Detailed Site Plan District to "S-
P-1" Detailed Site Plan District to include "commercial school/tutoring academy"
as a permitted use as depicted on the approved Site Plan attached hereto and
incorporated herein as Exhibit "B", and subject to the following conditions:
September 17, 2024; 1st Reading (APPROVED 6-0) on the Consent Agenda
subject to Staff Report dated September 10, 2024.
October 1, 2024: 2"d Reading (APPROVED 7-0) subject to Staff Report dated
September 10, 2024, and noting the following:
- Approving the zoning change and site plan from S-P-1 Detailed Site Plan
District to S-P-1 Detailed Site Plan District to include a commercial
school/tutoring academy as a permitted use as presented.
SECTION 2.
That the City Manager is hereby directed to correct the Official Zoning map of the City
of Southlake, Texas, to reflect the herein changes in zoning.
SECTION 3.
That in all other respects the use of the tract or tracts of land herein above described
shall be subject to all the applicable regulations contained in said Zoning Ordinance and all
other applicable and pertinent ordinances for the City of Southlake, Texas. All existing sections,
subsections, paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance
are not amended hereby, but remain intact and are hereby ratified, verified, and affirmed.
SECTION 4.
That the zoning regulations and districts as herein established have been made in
accordance with the comprehensive plan for the purpose of promoting the health, safety,
morals and the general welfare of the community. They have been designed, with respect to
both present conditions and the conditions reasonably anticipated to exist in the foreseeable
future; to lessen congestion in the streets; to provide adequate light and air; to prevent over-
crowding of land; to avoid undue concentration of population; and to facilitate the adequate
provision of transportation, water, sewerage, drainage and surface water, parks and other
commercial needs and development of the community. They have been made after a full and
complete hearing with reasonable consideration among other things of the character of the
district and its peculiar suitability for the particular uses and with a view of conserving the value
of buildings and encouraging the most appropriate use of land throughout the community.
SECTION 5.
That this ordinance shall be cumulative of all other ordinances of the City of Southlake,
Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in
those instances where provisions of those ordinances are in direct conflict with the provisions
of this ordinance.
SECTION 6.
That the terms and provisions of this ordinance shall be deemed to be severable and
that if the validity of the zoning affecting any portion of the tract or tracts of land described
herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the
balance of said tract or tracts of land described herein.
SECTION 7.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcement of any of the provisions of this ordinance shall be
fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a
violation is permitted to exist shall constitute a separate offense.
SECTION 8.
All rights and remedies of the City of Southlake are expressly saved as to any and all
violations of the provisions of Ordinance No. 480, as amended, or any other ordinances
affecting zoning which have accrued at the time of the effective date of this ordinance; and, as
to such accrued violations and all pending litigation, both civil and criminal, whether pending in
court or not, under such ordinances, same shall not be affected by this ordinance but may be
prosecuted until final disposition by the courts.
SECTION 9.
The City Secretary of the City of Southlake is hereby directed to publish the proposed
ordinance in its entirety on the City website together with a notice setting out the time and place
for a public hearing thereon at least ten (10) days before the second reading of this ordinance,
and it this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation
of any of its provisions, then the City Secretary shall additionally publish this ordinance in the
official City newspaper one time within ten (10) days after passage of this ordinance, as
required by Section 3.13 of the Charter of the City of Southlake.
SECTION 10.
This ordinance shall be in full force and effect from and after its passage and publication
as required by law, and it is so ordained.

Re: Narrative request
To whom it may concern:
Tutor of Dragons is an ala-cart educational service working in parallel with the Carroll ISD. That is
not to say that we do not offer other instructional services but rather to emphasize our primary
objective, support the education and success of our" Dragons".
To offer understanding of our hours of operation and potential occupancy at any given time I have
attached a few scheduling calendars as illustrations. You will note that classes start in the late
afternoon and can run late into the evening. Classes over the weekend may begin earlier but still
tend to run late into the evening. Mornings are used for preparation of materials, private 1 on 1 of
off block students or tutoring of college students, home school students and parent meetings.
If the entire staff was onsite and tutoring simultaneously, morning occupancy would not exceed 15
souls, or so. That number assumes all students attend in person. Total in -person attendance is
uncommon. Majority of college students are tutored remotely via zoom or other like methods.

Unknown factor would be if a parent waits inside or is meeting with a tutor.
Afternoon and Evening Classes are the highest in attendance, however not all in person. We offer
classes as in -person and simultaneous zoom attendance. For those who are unable to attend due
to other activities we offer video recordings of the missed class. Although not ideal we recognize
our students lead busy lives and we take any opportunity to educate.
We have 3 classrooms in service and the ability to add 1 at such time as we need it. At no time will
we utilize more than 2 classrooms at one time due to the potential sound levels and other logistics
such as tutors doing 1 on 1 instruction, parent meetings and other prep work. The only time I might
consider bringing a 3" room online would be in the event one of the classes swings predominantly
online or recorded. This is a non -qualifiable event until the day it happens. I can assure you that we
will use best judgement in that event, Safety First!
During any given week, white school is in session, Tutor of Dragons LLC will visit with some 280
students in some fashion. That is current and must expect an increase as the school year
develops. For this discussion, we will assume 350 students in total between all venues. The
majority of these students will be in classes held between 4pm and 10pm Monday thru Friday and
8am to 9pm Saturday and Sunday. We will not deduct for 1 —1 private session as we find a good
number of them also attend select classes as they need. In a perfect world there might be a
calculation to provide you with a constant answer. Our attendance and scheduling are fluid as we
attempt to foilowthe CISD curriculum. We have the privilege of tutoring approx. 22 different
subjects taught in the district by as many different teachers with each having a differing
interpretation of the guidelines set by the ISD. This makes a static attendance/occupancy number
impossible to calculate. I will attempt to come close based upon our 18 years of experience and
what I deem a worst -case scenario.
ASSUMPTIONS
a. (Forgiving morning hours Monday— Friday) There are 56 teachable class hours in a week. (6hrs a
day M -F and 13hrs a day Sat and Sun)
b. Average Class is 60 minutes
c. 4 tutors and 1 intern
d. 2 support staff
e. 2 classrooms operating in any given hour
f. 3 singles in any given hour (potentially)
d. Looking back at attendance tells us that in -person attendance of Subject Focused Classes is
approximately 40%, Online 40% and video recordings 20%
Given the forgoing assumptions and our experience I would not expect more than 40 individuals to
be in the building during any 60-minute period. As alluded to this is worst case. Asa practical
matter not, all classes are attended equally. One room may have 20 in person attendees while the
other may only have 5 or 6. In the next hour each room could only have 5 in -person attendees. It is
Very Fluid in that each subject has its easy and its more difficult sections. If the student is
comfortable with their level of understanding they may elect not to attend that class.
Together with our commitment to control of the learning environment and to producing the finest
students, I feel this is a fair evaluation of what may be expected.
am aware your inquiry did not include parking, but I feel the need to address it before it becomes a
question. In creating the schedule care is taken to consider parking needs. The classes scheduled
during what may be considered normal business hours of our neighbors are those of the younger
students who are dropped off and then picked up by their parents or guardian and therefore do not
tax the parking lot. The older students who may be of driving age are scheduled later when the
other businesses are closed, and the parking lot is mostly empty.

shall constitute a separate offense.

The U.S.Environmental Protection
Agency Region 6 will be conducting
the seventh five-year review of rem-
edy implementation and performance
at the Bio-Ecology Systems,Inc.Su-
perfund site (Site)in Grand Prairie,
Texas.From 1972 until 1978,the Site
was permitted as a Class 1 industrial
solid waste management facility.Solid
waste management activities at the
Site contaminated soil and groundwa-
ter with heavy metals and volatile or-
ganic compounds.The Site includes
fenced,open space and vegetated
areas.The Site is bounded in all direc-
tions by private,commercial property
and to the east and south by Mountain
Creek.The sitewide remedy includes
raising the elevation of the Site above
the 100-year floodplain,stabilizing
waste and disposing of it in an on-site
capped landfill,constructing a fence
to limit site access and groundwater
monitoring.All on-site activities have
been completed.The five-year re-
view will determine if the remedy is
still protective of human health and
the environment.The five-year review
is scheduled for completion in June
2025.

SECTION 8
Any person,firm,or corporation who
violates,disobeys,omits,neglects,
or refuses to comply with or who re-
sists the enforcement of any of the
provisions of this ordinance shall be
deemed guilty of a misdemeanor and,
upon conviction thereof,shall be pun-
ished by a fine as provided in Section
1-13 of the Saginaw City Code.Each
day that a violation is permitted to ex-
ist shall constitute a separate offense.

NOTICE TO BIDDERS
This project primarily consists of constructing center street with concrete pave-
ment,drainage improvements,hike and bike trail,sidewalk,streetlights,water
and sewer improvements and traffic signals.The Engineer’s estimate for this
project is $14,288,512.40.
Sealed bids will be received by the City of Arlington,Texas,at the Office of the
Director of Public Works,2nd Floor,City Hall,101 W.Abram Street,Arlington
TX,76010,until 2:00 p.m.on Friday,October 11,2024,for the construction of
EXTENDING CENTER STREET (BARDIN ROAD TO SE GREEN OAKS BOULE-
VARD),CSJ NO.0902-90-228,FEDERAL AID PROJECT NO:STP 2023(098)MM
as listed in the contract documents,at which time and place they will be publicly
opened and read aloud in the Public Works Conference Room.Any bid received
after closing time will be returned unopened.
All bidders and subcontractors on this project must be pre-qualified in the ap-
propriate work category as outlined in the Instructions to Bidders of the contract
documents.Contract documents,including plans,specifications,and adden-
dums may be reviewed and/or downloaded from the City’s vendor/supplier por-
tal,IonWave,accessible via the City’s web page,https://arlingtontx.gov/city_hall/
departments/finance.Look for “Vendor/Supplier”under “Services”.
A cashier’s check or an acceptable Bidder’s Bond payable to the City of Arling-
ton,Texas,in an amount of not less than five percent (5%)of the largest possible
total for the bid submitted,must accompany the bid.
A Performance Bond and a Payment Bond,each for one hundred percent
100%)of the contract price,will be required.
Not less than the prevailing wage rates adopted by the City of Arlington,Texas,
and as set forth in the contract documents,must be paid on this project.
The City reserves the right to request bidders to provide Disadvantaged Busi-
ness Enterprises (DBE)information,no preference shall be given to MWBE Prime
bidders.All bidders are required to comply with the TxDOT’s Civil Right’s Office
Policy and Procedures,including any contract specific goals or good faith effort
requirements.
In case of ambiguity or lack of clearness in stating prices in the Proposal,the
City reserves the right to accept the most advantageous construction thereof to
the City or to reject the proposal.
The City reserves the right to reject any or all bids and waive any or all informal-
ities.No bid may be withdrawn until the expiration of ninety (90)days from the
date bids are opened.
All inquiries must be submitted to the City in accordance with the Instructions to
Bidders of the contract documents.
A PRE-BID MEETING/TELECONFERENCE will be held for this project on Monday,
September 30,2024,at 2:00 PM in the Public Works Conference Room,2nd
Floor,City Hall,101 W.Abram Street,Arlington,TX 76010.Prospective bidders
