KNOW ALL MEN BY THESE PRESENTS:
That we, KOCH PETROLEUM GROUP, LP (FORMERLY KNOWN AS KOCH REFINING
COMPANY) for and in consideration of the sum ofTen ($10) Dollars and other good and valuable
consideration in hand paid by Grantee herein, the receipt and sufficiency of which is hereby acknowledged
and confessed, have granted sold and conveyed, and by these presents do grant, sell and convey to the City
of South lake, Grantee herein, of Tarrant County, Texas a permanent and perpetual easement for the
purpose of installing, repairing, maintaining, altering, replacing, relocating, and operating utilities in, into,
upon, across and under that land in Tarrant County, Texas described as follows, to wit:
Being a 15' permanent utility easement and temporary construction easement, described as follows:
See attached Exhibit' A' for metes and bounds description togelher WIth the right of ingress and
egress as necessary for such purposes.
See attached Exhibit 'B' for graphic depiction
The easement and rights hereby granted are subject to all other easements, exceptions, reservations, rights
and encumbrances either of record or evidenced physically on our premises, and are granted without any
warranty of title, express or implied, by us.
We hereby reserve for ourselves, and our successors and assigns, the right to use the easement area for any
purpose and in any manner, including, but not limited to, the right to construct or to permit others to
construct other pipelines alongside of and/or adjacent to Grantee's facilities, the right to cross or to permit
others to cross under or over Grantee's facilities with pipelines, roads, streets, railroads, water lines, sewer
lines, and other utilities or facilities, so long as such use does not unreasonably interfere with the rights of
Grantee hereunder.
If Grantee fails to actively use the easements for purposes intended during a continuous period of twelve
(12) months, this easement shall terminate, and Grantee, at its sole cost and expense, shall immediately
remove its facilities installed hereunder and restore the easement area to reasonably satisfactory to us. Upon
termination of this easement for any reason, all rights hereunder shall automatically revert to us, and
Grantee shall without unreasonable delay execute and record in the applicable county records a release of
this easement.
TO HAVE AND TO HOLD the above cribed easement, together with all and singular, the rights and
appurtenances thereto, anywise belon g unto the said Grantee, its successors and assigns forever.

Dedication of a
15' Sanitary Sewer Easement
Being a strip of land 15 feet in width situated in the C. B. Mc Donald Survey, Abstract
No. 1013, City of South lake, Tarrant County, Texas, being a portion of that certain Lot 2,
Block 1, Fina Addition, an addition to the City of Southlake, as recorded in Cabinet A,
Slide 1476, Plat Records, Tarrant County, Texas and being a portion of that certain tract
of land as described in deed to Koch Refining Company, as recorded in Volume 11269,
Page 1852, Deed Records, Tarrant County, Texas, and being more particularly described
by metes and bounds as follows:
COMMENCING at a 5/8" iron rod set for the intersection of the northwesterly right-of-
way line of State Highway No. 26, ( a variable width right-of-way) with the westerly
right-of-way line of Mustang Drive, ( a 64' wide right-of-way), said 5/8" iron rod also
being on the southeasterly right-of-way line of the Dartpac Railroad ( a 100' wide right-
of-way);
THENCE North 10011 '33"East, with said westerly right-of-way line of Mustang Drive, a
distance of 36.51 feet to a 5/8" iron rod set;
THENCE North 36009'51"West, continuing with said right-of-way line, a distance of
111.54 feet to a 5/8" iron rod set for the beginning of a curve to the left having a radius of
768.00 feet and long-chord bearing North 38005' 15"West, a distance of 51.54 feet;
THENCE continuing with said right-of-way line and with said curve, in a northwesterly
direction through a central angle of 03050' 46", an arc distance of 51.55 feet to a point on
the westerly line of that certain tract of land as described in deed to Foremost Petroleum
Company of Texas, Inc and Citgo Petroleum Corporation as recorded in Volume 9384,
Page 2202, said Deed Records;
THENCE North 00047'45"West, departing said westerly right-of-way line and with the
westerly line of said Citgo tract, a distance of 277.40 to a point on the easterly line of a
proposed 15' Sanitary Sewer Easement;
THENCE North 38028' 11 "East, departing said westerly line of said Citgo tract and with
the easterly line of said proposed easement, a distance of 113.76 feet;
THENCE North 00047'45"East, continuing with easterly line of said proposed easement,
pass the northerly line of said Citgo tract at 552.67 feet, and continuing in all a distance
of 73 7 .67 feet to a point on the northerly line of that certain tract of land as described in
deed to Conoco, Inc. as recorded in Volume 11555, Page 1312, said Deed Records;
