for and in consideration of the sum lIars nd other good and valuable
consideration in hand paid by Grantee herein, th receipt and sufficiency of which is
hereby acknowledged and confessed, have granted, sold and conveyed, and by these
presents do grant, sell and convey to the CITY OF SOUTHLAKE, Grantee herein, of
Tarrant County, Texas a temporary construction easement for a period of one (1) year
for the purpose of installing sanitary sewer on the property known and described as
follows, to-wit:
Temporary Construction Easement:
See attached Exhibit 'A' for metes and bounds description
See attached Exhibit 'B' for Graphic depiction
Such temporary easements shall include the right to excavate upon such property, but
Grantee shall replace any fences, improvements, or other fixtures upon said property
without cost to Grantor, or current owner thereof, and shall restore the property,
the subject of the temporary easement, as nearly as possible to its condition prior
to entry thereon.
TO HAVE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said
Grantee, its successors and assigns forever; and I/We do hereby certify that I/We are
the owners of the property described herein and bind myself/ourselves, my/our heirs
dnd assigns, to warrant and to forever defend all and singular the premises unto the
said Grantee, its successors and assigns, against every person whomsoever lawfully
claiming or to claim same or any thereof.

BEING A 20-FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT SITUATED
IN LOT 5, BLOCK 1, MISSION HILL ESTATES, AN ADDITION TO THE CITY OF
SOUTHLAKE, RECORDED IN VOLUME 388-163, PAGE 88 OF THE PLAT RE-
CORDS OF T ARRANT COUNTY, TEXAS (PR TCT), AND CONVEYED TO
MILTON C. TAYLOR AND ROSEMARY TAYLOR, AND RECORDED IN VOL-
UME 8223, PAGE 1580 OF THE DEED RECORDS OF TARRANT COUNTY, TEXAS
(DRTCT), LOCATED IN THE W. W. HALL SURVEY, ABSTRACT NO. 687, AND
BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS
FOLLOWS:
COMMENCING for reference at the southwest corner of said Lot 5, same being the
southeast corner of Lot 4, conveyed to Michael T. O'Leary and Mary Ann O'Leary,
recorded in Volume 8699, Page 2182, DRDCT, and being in the North line of Mission
Drive (50-foot right-of-way), and being in a circular curve to the right having a
radius of 630.00 feet;
THENCE along the South line of said Lot 5 and the North line of said Mission Drive,
an arc distance of 20.00 feet, through a central angle of 010 49' 09", and having a
chord which bears S 720 35' 57" E, a distance of 20.00 feet to the POINT OF
BEGINNING;
THENCE N 160 29' 27" E, leaving said line and along the East line of a drainage and
utility easement created by said Plat, a distance of 315.86 feet to a point in the
North line of said Lot 5, same being in the South line of proposed Lot 4, Block 5, of
the proposed Chapel Downs, an unrecorded subdivision at this time;
THENCE N 880 59' 01" E, along said common line, a distance of 20.97 feet;
THENCE S 160 29' 27" W, leaving said line, a distance of 323.12 feet to a point in
the North line of said Mission Drive and South line of said Lot 5, and being in a
circular curve to the left having a radius of 630.00 feet;
THENCE along said common line, an arc distance of 20.00 feet, through a central
angle of 010 49' 09", and having a chord which bears N 700 46' 45" W, a distance of
20.00 feet to the POINT OF BEGINNING, and containing 0.147 acre of land.
Bearings are grid bearings based on the Texas State Plane Coordinate System, North
Central Zone.
It is the intention to describe a 20-foot wide temporary construction easement
which extends across Mission Hill Estates, Lot 5, Block 1, being bounded on the
South by Mission Drive, being bounded on the West by a drainage and utility
easement, and being bounded on the North by proposed Chapel Downs Lot 4, Block 5.
