KNOW ALL MEN BY THESE PRESENTS:

for and in consideration of the sum~ Ten ($10) Dollars and other good and valuable
consideration in hand paid by Grantee herein, the receipt and sufficiency of which is
hereby acknowledged and confessed, have granted, sold and conveyed, and by these
presents do grant, sell and convey to the CITY OF SOUTHLAKE, Grantee herein, of
Tarrant County, Texas a temporary construction easement for a period of one (1) year
for the purpose of installing sanitary sewer on the property known and described as
follows, to-wit:
Temporary Construction Easement:
See attached Exhibit 'A' for metes and bounds description
See attached Exhibit 'B' for Graphic depiction
Such temporary easements shall include the right to excavate upon such property, but
Grantee shall replace any fences, improvements, or other fixtures upon said property
without cost to Grantor, or current owner thereof, and shall restore the property,
the subject of the temporary easement, as nearly as possible to its condition prior
to entry thereon.
TO HAVE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said
Grantee, its successors and assigns forever; and r/We do hereby certify that r/We are
the owners of the property described herein and bind myself/ourselves, my/our heirs
and assigns, to warrant and to forever defend all and singular the premises unto the
said Grantee, its successors and assigns, against every person whomsoever lawfully
claiming or to claim same or any thereof.

EST A TES, AN ADDITION TO THE CITY OF SOUTHLAKE, RECORDED IN VOL-
UME 388-181, PAGE 71 OF THE PLAT RECORDS OF TARRANT COUNTY, TEXAS
(PRTCT), AND CONVEYED TO STEVEN K. SCOTT AND UNDA SCOTT, AND RE-
CORDED IN VOLUME 9684, PAGE 1487 OF THE DEED RECORDS OF TARRANT
COUNTY, TEXAS (DRTCT), LOCATED IN THE W. W. HALL SURVEY, ABSTRACT
NO. 687, AND BEING MORE PARTICULARLY DESCRIBED BY METES AND
BOUNDS AS FOLLOWS:
COMMENCING for reference at the southwest corner of said Lot 3R, same being
the southeast corner of Lot 2R, conveyed to J. David Gowdy and N orlene Gowdy, re-
corded in Volume 9357, Page 1158, DRTCT, and being in the North line of Emerald
Boulevard (variable width) and being in a circular curve to the right having a radius
of 906.27 feet;
THENCE along the South line of said Lot 3R and the North line of Emerald
Boulevard, an arc distance of 5.00 feet, through a central angle of 000 18' 58", and
having a chord which bears-S 840 37' 07" E, a distance of 5.00 feet to ~he POINT OF
BEGINNING;
THENCE N 050 13' 24" E, leaving said line and along the East line of a drainage and
utility easement created by said Plat, a distance of 257.59 feet;
THENCE S 160 37' 35" E, leaving said line, a distance of 40.28 feet;
THENCE S 050 13' 24" W, a distance of 220.41 feet to a point in the South line of
Lot 3R and in the North line of Emerald Drive, and in a circular curve to the left
having a radius of 906.27 feet;
THENCE along the South line of said Lot 3R and the North line of Emerald
Boulevard, an arc distance of 15.00 feet, through a central angle of 000 56' 54", and
having a chord which bears N 830 59' 11" W, a distance of 15.00 feet to the POINT
OF BEGINNING, and containing 0.082 acre of land.
Bearings are grid bearings based on the Texas State Plane Coordinate System, North
Central Zone.
It is the intention to describe a variable-width temporary construction easement
which extends across First Installment Replat, Diamond Circle Estates, Lot 3R,
Block 1, being bounded on the West by a drainage and utility easement, and being
bounded on the South by Emerald Boulevard.
