KNOW ALL MEN BY THESE PRESENTS:

for and in consideration of the sum of Ten ($10) Dollars and other good and
valuable consideration in hand,paid by Grantee herein, the receipt and
sufficiency of which is hereby acknowledged and confessed, have granted,
sold and conveyed, and by these presents do grant, sell and convey to the
CITY OF SOUTHLAKE, Grantee herein, of Tarrant County, Texas a temporary
construction easement for a period of one (1) year for the purpose of
installing sanitary sewer on the property known and described as follows,
to-wit:
Temporary Variable Width Construction Easement:
See attached Exhibit 'A' for metes and bounds description
See attached Exhibit 'B' for Graphic depiction
Such temporary easements shall include the right to excavate upon such
property, but Grantee shall replace any fences, improvements, or other
fixtures upon said property without cost to Grantor, or current owner
thereof, and shall restore the property, the subject of the temporary
easement, as nearly as possible to its condition prior to entry thereon.
TO HAVE AND TO HOLD the above described easement, together with all
and singular, the rights and appurtenances thereto, anywise belonging unto
the said Grantee, its successors and assigns forever; and I/We do hereby
bind myself/ourselves, my/our heirs and assigns, to warrant and to forever
defend all and singular the premises unto the said Grantee, its successors
and assigns, against every person whomsoever lawfully claiming or to claim
same or any thereof.

ATED IN LOT 2R, BLOCK 1, THE FIRST INSTALLMENT REPLAT DIAMOND
CIRCLE ESTATES, AN ADDITION TO THE CITY OF SOUTHLAKE, RECORDED IN
VOLUME 388-181, PAGE 71 OF THE PLAT RECORDS OF TARRANT COUNTY,
TFXAS (PRTCT), AND CONVEYED TO J. DAVID GOWDY AND NORLENE GOWDY,
AND RECORDED IN VOLUME 9357, PAGE 1158 OF THE DEED RECORDS OF
TARRANT COUNTY, TEXAS (DRTCT), LOCATED IN THE W. W. HALL SURVEY,
ABSTRACT NO. 687, AND BEING MORE PARTICULARLY DESCRIBED BY METES
AND BOUNDS AS FOLLOWS:
COMMENCING for reference at the southeast corner of said Lot 2R, same being the

It is the intention to describe a variable-width temporary construction easement
which extends across First Installment Replat Diamond Circle Estates Lot 2R,
Block 1, being bounded on the South by Emerald Boulevard, being bounded on the
East by a drainage and utility easement, and being bounded on the North by Replat
of Lot 2, Block 4, Mission Hill ~states.
