for and in consideration of the'sum of Ten ($10) Dollars and other good and
valuable consideration in hand paid by Grantee herein, the receipt and
sufficiency of which is hereby acknowledged and confessed, have granted, sold and
conveyed, and by these presents do grant, sell and convey to the CITY OF
SOUTHLAKE, Grantee herein, of Tarrant County, Texas a temporary construction
easement for a period of one (1) year for the purpose of installing sanitary
sewer on Ule property known and described as follows, to-wit:
Temporary 20 foot Wide Construction Easement:
See attached Exhibit 'A' for metes and bounds description
See attached Exhibit 'B' for Graphic depiction
Such temporary easements shall include the right to excavate upon such property,
but Grantee shall replace any fences, improvements, or other fixtures upon said
property without cost to Grantor, or current owner, thereof, and shall restore the
property, the subject of the temporary easen~nt, as nearly as possible to its
condition prior to entry thereon.
TO HAVE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said
Grantee, its successors and assigns forever; and I/We do hereby bind
myself/ourselves, my/our heirs and assigns, to warrant and to forever defend all
and singular the premises unto the said Grantee, its successors and assigns,
against every person whomsoever lawfully claiming or to claim same or any
t.hereof.

PARCEL FIVE
BEING A 20-FOOT WIDE TEMPORARY CONSTRUCTION EASEMENT SITUATED
IN LOT 4, BLOCK FIVE OF THE PROPOSED CHAPEL DOWNS SUBDIVISION
(UNRECORDED AT THIS TIME), OWNERS BEING CHAPEL DOWNS JOINT
VENTURE, LOCATED IN THE W. W. HALL SURVEY, ABSTRACT NO. 687, AND
BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS
FOLLOWS:
COMMENCING for reference at the intersection of the east line of proposed
Saratoga Drive (50 feet wide) with the North line of proposed Chapel Downs Drive
(64 feet wide), and being in a curve to the right having a radius of 706.07 feet;
THENCE S 470 52' 37" E, leaving said line, a distance of 82.93 feet to a point in the
North line of proposed Lot 4 and in the South line of proposed Chapel Downs Drive,
and being in a circular curve to the right having a radius of 642.07 feet, and being
the POINT OF BEGINNING;
THENCE along said line and curve to the right, an arc distance of 22.58 feet,
thro~h a central angle of 020 00' 53", and having a chord which bears
N 84 54' 50" E, a distance. of 22.58 feet to a point in the West line of a proposed
10-foot wide utility easement;
THENCE S 150 29' 58" W, along said line, a distance of 201.08 feet to a point in the
South line of said Lot 4 and the South line of said proposed Chapel Downs Drive, and
being in the North line of Lot 4, Block 1 of Mission Hill Estates, an Addition to the
City of Southlake recorded in Volume 388-163, Page 88, of the Plat Records of
Tarrant County, Texas (PRTCT), and conveyed to Milton C. Taylor and Rosemary
Taylor, recorded in Volume 8223, Page 1580, of the Deed Records of Tarrant
County, Texas (DRDCT);
THENCE S 880 59' 01" W, along said common line, a distance of 20.86 feet;
THENCE N 150 29' 58" E, leaving said common line, a distance of 199.53 feet to the
POINT OF BEGINNING, and containing 0.092 acre of land.
Bearings are grid bearings based on the Texas State Plane Coordinate System, North
Central Zone.
It is the intention to describe a 20-foot wide temporary construction easement
situated in Lot 4, Block Five of the proposed Chapel Downs Subdivision, being
bounded on the North by proposed Chapel Downs Drive, being bounded on the East
by a proposed 10-foot wide utility easement, and being bounded on the South by
Lot 4, Block 1 of Mission Hill Estates.
