KNCM ALL MEN BY THESE PRESENTS:
That (I) (We), Charles H. and Virginia F. Young
for and in consideration of the sum of Ten ($10) Dollars and other gocd and
valuable consideration in hand paid by Grantee herein, the receipt and
sufficiency of which is hereby aCknCMledged and confessed, have granted, sold and
conveyed, and by th~se presents do grant, sell and convey to the CITY OF
SOUTHLAKE, Grantee herein, of Tarrant County, Texas a permanent and perpetual
easerrent for the purpose of installing, repairing, maintaining, al tering,
replacing, relocating, and operating utilities in, into, upon, over, across and
under that land in Tarrant County, Texas described as follows, to-wit:
Permanent 20 foot Wide Utility Easerrent:
See attached Exhibit I A I for metes and bounds description
See attached Exhibit 'B' for Graphic depiction
See attached Exhibit IC' for Special Conditions
together with the right of ingress and egress as necessary for such purposes,
and an additional contiguous temporary construction easement for a period of
one (1) year for the purpose of installing utilities on the property kncwn and
described as follows, to-wit:
Temporary 50 foot Wide Construction Easement:
Immediately adjacent to the above described easement in a configuration
as shown on the attached Exhibit IB'.
See attached Exhibit IC' for Special Conditions
Such temporary easerrent shall include the right to excavate upon such property,
but Grantee shall replace any fences or other fixtures upon said property without
cost to Grantor, and shall restore the property, the subject of the temporary
construction easement, as nearly as possible to its condition prior to entry
thereon.
TO HAVE AND TO HOLD the above described permanent easerrent, together with
all and singular, the rights and appurtenances thereto, anywise belonging unto
the said Grantee, its successors and assigns forever; and I/We do hereby bind
myself/ourselves, my/our heirs and assigns, to warrant and to forever defend all
and singular the premises unto the said Grantee, its successors and assigns,
against every person whomsoever lawfully claiming or to claim sarre or any
thereof.

'l'arrant County, Texas, and being a portion of a tract owned by
Charles H. Young according to the deed recorded in V. 2595, P. 340,
DR1~, and the centerline of a 20' wide utility easement being more
particularly described by metes and bounds as fOllows;
BEX3INNING at a point in the west line of a tract of land owned by
Mekon, Inc. according to the deed filed in V. 8339, P. 1095, DRTCT,
and being in the east line of said Young Tract, said point being

CCtIDITlOOS FOR GRANTING EASEMENT
1.
Contractor may only rerrove trees which are described on the - . J<'
attached sheets.
/
2. The owner shall be reimbursed for any trees other than as
described in Item NO.1, damaged or rerroved at the rate of
$150.00 per caliper inch. .
3. The owner shall be reimbursed his actual cost for any other
damage done to. the property during or after construction.
4. In the event that the City of Southlake successfully negotiates
an agreement with the City of Colleyville or TRA for the right
to tie on to the existing 12" sewer line in Colleyville, then
this owner will have the right to tie on a min:i.mum of 12,?
residential units as well as sewer service for the commercial
tract.
5. The two existing sewer lines from the septic tank to the
lateral lines are to be left in service after construction.
If iines are damaged, contractor shall repair to satisfaction
of owner.
6. One sewer tap shall be granted to connect the existing
residence onto the sewer line once the line in placed into
service.
