STANDARD UTILITY EASEMENT
THE STATE OF TEXAS
COUNTY OF TARRANT
I<N<:M AIL MEN BY THESE PRESENTS:
That (I) (We), MEKON, INC.
for and in consideration of the sum of Ten ($10) Dollars and other good and
valuable consideration in hand paid by Grantee herein, the receipt and
sufficiency of which is hereby acknowledged and confessed, have granted, sold and
conveyed, and by these presents do grant, sell and convey to the CITY OF
SOUTHLAKE, Grantee herein, of Tarrant County, Texas a permanent and perpetual
easement for the purpose of installing, repairing, maintaining, altering,
replacing, relocating, and operating utilities in, into, upon, over, across and
under that land in Tarrant County, Texas described as follows, to-wit:
Permanent 20 foot Wide Utility Easement:
See attached &dlibit 'A' for metes and bounds description
See attached Exhibit 'B' for Graphic depiction
See attached Ddlibit 'c' for Special Conditions
together with the right of ingress and egress as necessary for such purposes,
and an additional contiguous temporary construction easement for a period of
one (1) year for the purpose of installing utilities on the property known and
described as follows, to-wit:
Temporary 50 foot Wide Construction Easement:
Immediately adjacent to the above described easement in a configuration
as shown on the attached Exhibit 'B'.
See attached Exhibit IC' for Special Conditions
Such temporary and permanent easements shall include the right to excavate upon
such property, but Grantee shall replace any fences or other fixtures upon said
property without cost to Grantor, and shall restore the property, the subject of
the temporary and permanent easements, as nearly as possible to its condition
prior to entry thereon.
TO HAVE AND TO HOLD the above described permanent easerrent, together with
all and singular, the rights and appurtenances thereto, anywise belonging unto
the said Grantee, its successors and assigns forever; and I/We do hereby bind
myself/ourselves, my/our heirs and assigns, to warrant and to forever defend all
and singular the premises unto the said Grantee, its successors and assigns,
against every person whomsoever lawfully claiming or to claim same or any
thereof.

BEING a tract of land out of the W. Crooks SUrvey, Abstract 295,
Tarrant County, Texas, and being a portion of a tract owned by
Mekon, Inc. according to the deed recorded in V. 8341, P. 1247;
V. 8177, P. 1105; and V. 8533, P. 1977, DRTCT, and the centerline of
a 20' wide utility easement being more particularly described by
metes and bounds as follows;
BEGINNING at a point in the east line of said tract of land owned by
Mekon, Inc. and being in the west line of the C.H. Young Tract, said
point being N 89037'13" E 1,215.84 feet and S 00007137" W 152.94
feet from a 5/8" iron pin found at the northwest corner of said
Mekon, Inc. tract.
THENCE N 660 23' 43" W a distance of 221. 44 feet to a 5/8" iron rod
set for a centerline deflection point;
THENCE N 12014118" E a distance of 66.87 feet to its intersection
with north line of said Mekon, Inc. tract; said point being

caIDITIONS FOR GRANTING EASEMENT
1. Contractor may only remove trees which are described on the
attached sheets.
2. The owner shall be reimbursed for any trees other than as
described in Item No.1, damaged or removed at the rate of
$150.00 per caliper inch.
3. The owner shall be reimbursed his actual cost for any other
damage done to the property during or after construction.
4. In the event that the City of Southlake successfully negotiates
an agreement with the City of Colleyville or TRA for the right
to tie on to the existing 12" sewer line in Colleyville, then
this owner will have the right to tie on a minimum of 125
residential units as well as sewer service for the commercial
tract.
