valuable consideration in hand paid by Grantee herein, the receipt and
sufficiency of which is hereby acknowledged and confessed, have granted, sold and
conveyed, and by these presents do grant, sell and convey to the CITY OF
SOUTHLAKE, Grantee herein, of Tarrant County, Texas a permanent and perpetual
easerrent for the purpose of installing, repairing, maintaining, al tering ,
[replacing, relocating, and operating utilities in, into, upon, over, across and
under that land in Tarrant County, Texas described as follows, to-wi t:
Permanent 20 foot Wide Utility Easerrent:
See attached Exhibit I A I for metes and bounds description
See attached Exhibit 'B' for Graphic depiction
See attached Exhibit IC' for Special Conditions
together with the right of ingress and egress as necessary for such purposes,
and an additional contiguous temporary construction easerrent for a period of
one (1) year for the purpose of installing utilities on the property known and
described as follows, to-wi t:
Temporary 40 foot Wide Construction Easement:
Immediately adjacent to the above described easerrent in a configuration
as shown on the attached Exhibit 'B'.
See attached Exhibit IC' for Special Conditions
Such temporary and permanent easerrents shall include the right to excavate upon
such property, but Grantee shall replace any fences, improverrents, or other
fixtures upon said property without cost to Grantor, or current owner thereof,
and shall restore the property, the subject of the temporary and permanent
easements, as nearly as possible to its condition prior to entry thereon.
TO HAVE AND TO HOID the above described permanent easement, together with
all and singular, the rights and appurtenances thereto, anywise belonging unto
the said Grantee, its successors and assigns forever; and I/We do hereby bind
myself/ourselves, my/our heirs and assigns, to warrant and to forever defend all
and singular the premises unto the said Grantee, its successors and assigns,
against every person whomsoever lawfully claiming or to claim same or any
thereof.

EXHIBIT 'e'
CQIDITIONS FOR GRANTING EASEMENT
1. That the existing roadway be replaced in as good as, or better
than, its present condition, with adequate corrpaction with fill
to insure against future problems.
2. The City of Southlake shall agree to straighten the
drainage-way for the drainage coming along the east of Ginger
Creek Estates as per Mike Barnes and John Moore's verbal
agree/rent, which shall include tile relocation of the existing
drainage pipe as shown on the construction plans and the
installation of additional drainage pipes to be provided by
oUlers.
3. The City of Southlake will work with the home owners in Ginger
Creek Estates to request the Highway Departmmt of the State of
Texas to increase to a sufficient size the box culverts under
1709. Also, to request the Highway Departmmt to provide a
clear drainage approach channel to the box culvert within the
Highway Departrrent Hight-of-Way.
4. '1'he City will provide three sewer taps without charge; two to
provide service to Ule existing property as above mentioned;
and one to provide service to John H. Moore's Lot 8, Block 10
Ginger Creek Estates, said tie-ons to be installed as per Jo~
Moore's instructions when construction begins.
5. In the event it shall becane necessary for the City to enter
upon the subject property to repair, maintain, alter, replace,
relocate, or operate the utilities placed or maintained within
this easement, the City shall replace any fences, fixtures, or
improvements upon the subject property without cost to Grantor,
or the then current owner thereof, and shall restore the prop-
erty as nearly as possible to its condition prior to entry
thereon.
6. The easement, rights, and pri vi 1 eges granted herein shall be

maintain and operate utilities within the easement herein
granted.
7. The easement, rights, and privledges granted herein are non-
exclusive and Grantor reserves and retains the right to convey
similar rights, privileges, and easements to such other persons
as Grantor may deem proper so long as such conveyances do not
interfere with the easements, rights, and privileges granted
to Grantee herein.
8. The easement, rights, and privileges granted herelillder shall
tenninate when, or at such timo as, the purposes hereof cease

9. Grantor retains, reserves, and shall continue to enjoy the use
