That I, .~ L f I / A ~ , GRANTOR herein, for and in consideration
of the sum of Ten ($10.00) Dollars and other good and valuable consideration in hand
paid by the CITY OF SOUTH LAKE, home rule municipal corporation of the County of
Tarrant, State of Texas, GRANTEE herein, the receipt and sufficiency of which is
hereby acknowledged and confessed, do hereby grant, sell and convey unto the said
GRANTEE a permanent and perpetual easement for the purpose of installing, repairing,
maintaining, altering, replacing, relocating, rebuilding, removing, and operating
Water facilities in, into, upon, over, across, under and through all that land in
Tarrant County, Texas described as follows, to-wit:
A 15 foot wide Permanent Water Easement containing
approximately acres and a 1.L foot wide Temporary Construction
Easement, as more particularly described in Exhibit "A" and shown on
Exhibit "B" attached hereto and incorporated herein.
together with the right of ingress and egress as necessary for such purposes.
It is further understood that The Developer of Shyam Harin Estates, Jay
Sabahaya, will abide by the items listed and described in the attached Exhibit
"e".
GRANTOR covenants and agrees that GRANTOR and GRANTOR's heirs,
representatives, successors and assigns shall at no time erect, place or construct, or
cause to be erected, placed or constructed in, into, upon, over, across or under any
easements granted herein any temporary or permanent structures, and it is further
agreed that GRANTEE shall have the right to excavate and fill upon said permanent
easement and to remove from said permanent easement, any fences, buildings or other
obstructions as may now be found upon said permanent easement.
It is further intended that the Permanent Water Easement herein granted to
the GRANTEE shall run with the land and forever be a right in and to the land belonging
to GRANTOR, and GRANTOR'S successors and assigns, and said grant is expressly
excepted from any right of reversion of said premises under any prior deeds in
GRANTOR's chain of title. The Permanent Water Easement, rights and
privileges granted therein are exclusive, and GRANTOR covenants that it will not
convey any other easement or conflicting rights within the area covered by the grant to
any other person.

Legal Description
Being a tract of land situated in the City of South lake, Tarrant County, Texas, said tract of land
being a portion of Lot 12, Block B, Quail Creek Estates, an addition to the City of Southlake,
Tarrant County, Texas according to the plat recorded in Volume 388-118, Page 92 of the Plat
Records of Tarrant County, Texas, said tract of land being described as follows:
BEGINNING at a found 3/8 inch rebar at the most easterly comer of said Lot 12, said found 3/8
inch rebar also being on the cul-de-sac right-of-way line of South Quail Run Court, a sixty-foot
(60') right-of-way;
THENCE
SOUTH 38 degrees 48 minutes 52 seconds WEST, along the southeasterly line
of said Lot 12, a distance of 230.16 feet to the intersection ofthe North line of a
ten foot (10') utility easement as shown on said plat with the southeasterly line
of said Lot 12;
THENCE
SOUTH 89 degrees 39 minutes 36 seconds WEST, along the North line of said
ten foot (10') utility easement, a distance of 19.34 feet;
THENCE
NORTH 38 degrees 48 minutes 52 seconds EAST, a distance of 244.55 feet to a
point on the northeasterly line of said Lot 12, said point also being on the cul-de-
sac right-of-way line of said South Quail Run Court, said point also being at the
beginning of a non-tangent curve, concave northeasterly, having a radius of 60.00
feet and a chord bearing of SOUTH 42 degrees 57 minutes 12 seconds EAST;
THENCE
Southeasterly, along said curve, and along the northeasterly line of said Lot 12,
an arc length of 15.20 feet to the POINT OF BEGINNING, containing 3,555
square feet.
The basis of bearings for this description is the East line of South Quail Run Court as shown on
the attached Exhibit "B". (NORTH)

The Developer of Shyam-Harin Estates, Jay Sabahaya, agrees to the following for
consideration of said water easement as described in Exhibit "A" and Exhibit "8":
The Developer of Shyam-Harin Estates, Jay Sabahaya will connect the Grantor of
the water easement to City sanitary sewer system at the property located at
2602 Quail Run Court, Southlake, Texas, 76092.
The Developer of Shyam-Harin Estates, Jay Sabahaya agrees to comply with the
City of Southlake ordinances and construction policies in the installation of the water
line.
