1996-04-22 BOA Minutes CITY OF SOUTHLAKE, TEXAS BUILDING BOARD OF APPEALS April 22, 1996 MEMBERS PRESENT: Chairman, Kosse Maykus; Vice-Chairman, Michael Lease. Members: David Carpenter, Don Light, Eddie Pierce, Chuck Fettinger, Bobby Harrell. MEMBERS ABSENT: STAFF PRESENT: Building Official, Paul Ward; Code Enforcement Officer, Glenda Jaynes and Secretary, Debbie Coomer. Agenda Item #1, Call to Order The meeting was called to Order at 7:00 p.m.. Agenda Item #2, Approval of the Minutes Bobby Harrell arrives for this agenda item. A motion was made to approve the minutes of the Regular Meeting, February 26, 1996 as written. With no objections the Chair deemed the minutes approved. Motion: Michael Lease Second: Don Light Ayes: Kosse Maykus, Michael Lease, David Carpenter, Don Light, Eddie Pierce, Chuck Fettinger, Bobby Harrell. Nays: None Approved: 7-0 vote Agenda Item #3, Administrative Comments A complaint and an update on B.B.A. case # 018 was given by Glenda Jaynes, Code Enforcement Officer. The complaint received was on a substandard structure located on Sweet Street which will be brought before the Board in May. B.B.A. Case #018, a title search was conducted on the property and trailer and the last record owners were notified. Agenda Item #4, BBA Case #018 Building Board of Appeals Meeting Minutes on April 22, 1996 Page 3 of 3 B.B.A. Case # 018, Substandard Building, being Tract 1B1V, Abstract 2003 out of the Christopher Dart Survey and further known as; 1645 Oaklane South, Southlake, Tx. Owner: Jerrell Bryant. A presentation was from Paul Ward, Building Official according to the inspection report dated 03/26/96. Photograph's were presented at the hearing by Glenda Jaynes, Code Enforcement Officer. Fire Marshall, Roger Stewart has determined the structure to be a fire hazard. PUBLIC HEARING Mr. Bob Koehler of 1585 Oak Lane South was present to speak in favor of the request. There was no other person wishing to speak either in favor or in opposition of the request. PUBLIC HEARING CLOSED A motion from the Building Board of Appeals based from the following specific finding regarding the subject property based on evidence presented at this hearing: That the conditions set forth in building official's report exist to the extent that the life, health, property or safety of the public are endangered; and that the building is infeasible of repair. That we therefore, ORDER that the building be demolished or removed, and all debris removed, within 30 days and that all utilities be shut off immediately. The building must be immediately secured to prevent children from any access to it and a clear inspection must be made making sure there are not any open wells or anything like that which could cause injury to a child. Kimball Ave. Southlake, Texas; and I WHEREAS, the records of office of the office of the county clerk indicate that Hazel Janet Hanna Miller is the record owners of the of the building and WHEREAS, notice of the public hearing was mailed to the property owner more than ten (10) days prior to the date of the hearing; and WHEREAS, the Board finds that the defects or conditions set forth on the Substandard Building Inspections Report, attached hereto as Exhibit "A" and incorporated herein for all purposes, are present in the building and WHEREAS, the Board finds from evidence presented at the public hearing that the buildings is in violation of the standards set forth in Ordinance No. 615 and that the defects or conditions exist to the extent that the life, health, property or safety of the public are endangered; and WHEREAS, the Board finds that the building is infeasible of repair. NOW, THEREFORE, THE BUILDING BOARD OF APPEALS HEREBY ORDERS THAT the structure describer) as a residence, a garage, and sheds and located on property-described as Lot 1 A, out of the Hanna Addition Subdivision, located at 1030 N. Kimball Ave., in Southlake, Te_vas; to repair in conformance with requirements of the codes of the City of Southlake, or demolish and the debris reproved within 60 days( 06/24/97-08/25/97) there shall be evidence made within 30 days or the Building Official has the authority to proceed. All utilities must be disconnected immediately. If the ordered action is not taken within the allotted time, the city will remove or demolish the building and charge the cost to the property. If the city is not promptly reimbursed for its expenses, the city will place alien on the property for the amount owed.
