Item 9 - Demonstration and Plans 111'Q% SOUTHLAKE PLANNING&DEVELOPMENT SERVICES SIGN VARIANCE APPLICATION Demonstration Please demonstrate that the following conditions are applicable to the requested sign variance: 1. That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. Executive Medicine of Texas is a tenant on the 3rd floor of a multi-story buiding. The current sign code does not allow for signage above the first floor. However, there is no available space other than the proposed area which falls within the lease area owned by Executive Medicine. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The current sign code does not allow for signage above the first floor. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. The proposed reverse ("halo") illuminated sign is consistent with signage of the other tenants within the the property. These other tenants include Keller Williams, CTI Foods, and CH Robinson, all of which have reverse illuminated logos and letters above the 1 st floor. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. Several existing tenants, including Keller Williams, CTI Foods, and CH Robinson, have already been granted sign placements above the first floor. In line with this precedent, we believe granting the same consideration to Executive Medicine is both fair and consistent with the established practices. Furthermore, this signage is appropriate for the lease space occupied by Executive Medicine and consistent with all other sign codes. Placing the sign at the second floor would provide necessary visibility from both the street and parking areas, helping to avoid confusion and enhancing the flow of traffic for within the complex. Given these considerations, we kindly ask for an exception to the sign code to maintain consistency with other tenants and ensure adequate visibility for Executive Medicine.
