Demonstration
Please demonstrate that the following conditions are applicable to the requested sign variance:
1. That a literal enforcement of the sign regulation will create an unnecessary hardship or practical
difficulty on the applicant.
2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected
property and is not self imposed.
3. That the variance will not injure and will be wholly compatible with the use and permitted
development of adjacent properties.
4. That the variance will be in harmony with the spirit and purpose of the sign ordinance.
The property located at 2120A E. Southlake Boulevard present a number of issues that would make
literal enforcement of the sign ordinance impractical. Due to the landscaping, other buildings, and
distance of setback, the visibility is obscured. It is for these reasons we respectfully request a
variance to increase the size of both signs.
The property is a multi-tenant shopping center with various obstacles that obscure visibility to passing
motorist. The physical obstacles coupled with a 546' setback at the storefront, and 194' setback at the
rear facade, create a situation where the limits imposed by the sign ordinance are not practical. This is
a unique situation where the ordinance allows an increase in letter height to compensate for the
setback, but the maximum square footage does not change. For instance, if we increase the letter
height to offset the distance from the road, we exceed the square footage allowed.
Hallmark is a household name with an instantly recognizable logo. The proposed signage is consistent
with the other signs at this location, and has already been approved by they landlord.
Although, we seek a variance for the proposed signage, we feel it follows the spirit of the ordinance
and maintains the overall aesthetic of the property.
